Software piracy Abstract This diploma thesis is focused on the topic of "Software piracy", especially with regard to the legal regulation of the Czech legal order, primarily to the regulation of the Act No. 121/200 Coll., on Copyright and Rights Related to Copyright and on Amendment to Certain Acts (the Copyright Act), as amended. The main goal of this diploma thesis is to describe in complexity the software piracy, its types and present the individual kinds of malware, with regard to the two possible approaches to the topic. Formally, the thesis is divided into eight chapters which are further divided into individual subchapters. The first chapter is devoted to a brief outline of the history and current trends in software piracy. The second chapter deals with the definition of the term software and describes the basic properties of computer programme. In the third chapter, individual areas of the legal protection of computer programmes are described, i.e. areas of international law, European law, and copyright, administrative and criminal law of the Czech Republic. Copyright aspects in creation of webpages

The topic of this Master's degree thesis is Copyright aspects in creation of webpages. The reason for this topic was especially in general economic significance of webpages in this age, which is very often without appropriate consequences in contractual practice of its creation. The author realizes that problematic of the webpages creation brings whole range of legal issues so he has to focus on creation of the one part of webpages to make beneficial academic and legal practice outcomes. Author's decision was to deal with content management system, which is in his opinion the most important part of the majority of current webpages. It was necessary to lay down an elementary terminology in the beginning of the thesis in order to comprehend all legal issues in essential technical context. Another reason is that some legal conclusions required also non-legal (technical) knowledge. Following chapter of the thesis analyzes legal nature of webpages in respect of technical context. The topic of the diploma thesis is the copyright protection of webpages that connects law and webpages and its maintenance and administration performed by website operator. The webpage can be perceived and interpreted in two ways, i.e. as a set of individual elements or as single all-embracing and complex unit that is formed by those elements. The main goal is to analyze the legislation in both ways and to present impacts of it. The initial chapter provides essential basics of copyright law that applies to the rest of the thesis and explains the terminology that is used in following chapters. Second chapter deals with source code that is crucial information for a functioning of every webpage and that stays unknown to most of the webpage users. Third chapter aims at visual identity of a webpages, that means at appearance and design, every element that webpage user can perceive. This chapter also presents conditions under which the individual elements are eligible to be protected in accordance with Czech Copyright Act. This diploma thesis deals with video games as a problematic part of software law that is constantly growing in importance. It focuses on legal difficulties that were a byproduct of their growing economic potential. It further explains relevant aspects of copyright law in this matter and, to a limited degree, also related problematic from different branches of law, namely criminal law, administrative law and civil law. During the writing, I was focusing on distinctive aspects of video games as specific kind of software, and their distinctions from different kinds of works, especially from "classic" computer programs. An introduction to the problematics, an establishment of aims of this work and a brief summary of video games from the forties to the present times can be found in the first chapter. Basic terminology that is used in this work is in chapter two. The thesis further continues with legal concepts such as author, work and computer program. It proceeds with thoughts on a possible subsumption of video game under a certain kind of work as it is defined in the copyright act and considers establishing an individual category for video games. The text is divided into six chapters, which gradually present the reader to the topic. Firstly, this thesis approaches and explains the basic technical terms used further in the text. After this introductory chapter, the thesis deals with the cornerstone of copyright protection of computer programs which is the computer program itself as the object of the copyright and the nature of its copyright protection. 1 Abstract: Brain injury is a heavy burden on our society and one of the consequences of brain injury is cognitive impairment. Cognitive functions are essential to self-sufficiency and participation in the life of man. The aim of this work is to describe the use of a computer program CogniPlus from Vienna Test System Schuhfried for the training of cognitive functions for patients after brain injury. The theoretical part provides information on the issues of brain injury and its consequences and describes cognitive functions and their disorders. Furthermore, this section describes the options for neurorehabilitation and neuropsychology and there's also described the role of occupational in training of cognitive functions. Conclusion The theoretical part focuses on the use of computer programs and their advantages and disadvantages, and lastly, there is a detailed description of the computer program CogniPlus. The practical part is focused on the possibility to use a computer program for training (CogniPlus) of cognitive function of patients after brain injury. The practical part contains two case studies. The field of copyright protection of computer programs and resale of a copy of a computer program is not free of many substantial problems which are even supported by a fast technological development and which will probably soon result in substantial revision of both national and international copyright law. This thesis is to analyze and assess selected aspects of copyright protection of computer programs with main focus on resale of a copy of a computer program in both theoretical area and jurisprudence of European and US-American courts. This thesis reflects jurisprudence of the European Court of Justice, German and Dutch courts and court decision available in the USA. The general introduction in the theme and related issues is followed by a thorough analyze of the jurisprudence, including two decisions of the European Court of Justice in the UsedSoft case and related decisions of German courts, as well as the decision in Vernor vs. Autodesk case, which is relevant for the US-American jurisprudence. The goal of this diploma thesis is to provide an overview of the increasingly more important world of copyright protection as it concerns computer programs. The focus of this overview being primarily that of the national law of the Czech Republic, however this diploma thesis takes into account international law where applicable as well. The thesis begins with an introduction into the very concept of copyright law, the definition of a copyrightable work and that of computer programs and terms related therein. What follows is a brief account of the history of computer programs and computer programing in general as a basis for the following legal perspective into the matter. An international overview of the subject matter follows, including a look at key moments from an international perspective at the field of copyright protection of computer programs, including a brief overview of the Berne Convention, the TRIPS Agreement as well as aspects of European Law. A design of software applicable in occupational therapy A design, realization and evaluation of a PC program for shopping practice for people with cognitive deficits

The main goal of this thesis was to design a computer program applicable in occupational therapy in cognitive rehabilitation. I designed a PC program focused on shopping practice. Its main advantages are: the absence of any charges, the possibility of using it on an ordinary PC and the accessibility via the Internet. The designed program, named Trénink nakupování (~Shopping training), had been implemented in a beta version. Afterwards, it was tested and evaluated with a questionnaire by five stroke patients. The results show that all patients evaluated the program very positively and they believe in its benefits for the rehabilitation. The theoretical part describes cognitive training and shopping from the perspective of an occupational therapist. Four PC training programs focused on shopping training are described. Other sections provide detailed information about the designed program. The practical part consists of testing, the evaluation of questionnaires and suggesting ways to improve the program in the future. Copyright protection of computer programs This thesis deals with copyright protection of specific works of authorship - computer programs. The thesis deals with the definition of works of authorship and the conditions in which the computer program is a work of authorship, at least as a legal fiction. For the term computer program, the thesis is trying to find a suitable definition that is sufficiently general, but also accurately captures it's notion. Various known forms of expression of the computer program (source code, machine code, but also a code in an intermediate language) are described and the thesis explains, why it is appropriate to protect the computer program in any form. The thesis clarifies, why the term "software" and the term "computer program" are not identical and arbitrarily exchanging them can cause problems. Furthermore, the thesis deals with the author of the computer program and co-authorship. The next part deals with the rights of the author of the work. The exclusive rights of the author (the moral rights of the author and copyright) are discussed. The thesis describes the rights of exploitation of a computer programs, with a focus on differences againts other works of authorship.
