Motivation of the parents to admit a child in foster care
STROLENÁ, Adéla
This bachelor is developing on the theme of Motivation of the parents to admit a child in foster care. Foster care is a state-guaranteed form of foster care. Children that are suitable for foster care are not legally free. Foster care is always created by a court decision, which also can be canceled for serious reason by the court. Foster care expires at the day of legal age of the child. If the child is still preparing for their future career, foster care last until age 26. In the first chapter of the bachelor thesis I deal with the family. The following chapters will focus on foster care, where I deal with different types of foster care. In one of the chapters I deal with the specifications of foster care. In the next charter I deal with intermediation of foster care. Then I mention motives reported in the literature. These are the motives of public, private and hidden. At the end of the theoretical part I deal with the support of foster care. For the practical part of the bachelor I chose a qualitative research method of half-structured interviews. Data collection I conducted with foster parents, who came from the city Most. I did an interview together with five foster parents. The interview consisted of nine themes, which contained several questions. The main goal of these interviews was to identify the motives leading to admit a child in foster care. The operational goal was to find out what are the advantages and pitfalls provide foster care. To achieve these goals, I have chosen the following research questions: 1. What is the motivation of parents to admit a child in foster care. The respondents' answers to this research question differed. Two of the five foster parents reported that the main motivation which leads them to become foster parents, was to help own family. Another motivation was the inability of the married couple to have their own children and thats why they decided to become foster parents. The motivation for the next married couple was overcoming the marriage crisis. One of the families reported that their main motivation was to help a child who has been abandoned and needed help. By respondents answers, motives can be devided into public, private and hidden. As a public motive may be indicated inability to have their own child for health reasons and that is infertility. As next public motive was reported help to the child. As privat motives two respondents answered mainly the help to their families. These are the foster parents of the children who started to focus mainly on the basis of kinship. As hidden motive was to overcome marital crisis. As another hidden motive we can deduce financial support that respondents mentioned in the first line. Among the motive which comes from the unconscious, we can classify an attempt to atone for the bad manners of their children. Results of the research show that the motives that lead foster parents become foster parents are different. The motivation of applicants very important, because it derives from the whole approach to fostering. Foster parents should go mainly for the welfare of the child. 2. What are the advantages and pitfalls provided foster care. The main problem foster parents have seen in a long time dealing with all formalities. Also coincided with the fact that the foster care is relatively little awareness. As an additional obstacle sees establish an emotional relationship to foster parents, which may be interrupted. Respondents positively evaluated help a crisis centre or support from the state. The research shows that the biggest help that foster families appreciate is mainly financial help from the state. This bachelor thesis may serve other students as a source of information. The work can be used as a literature data for people interested in foster care because it contains opinions and motivations to admit a child in foster care.
Third-party custody according to § 45 of the Family Code Act.No 94/1963 Coll.
STELLNEROVÁ, Alena
Abstract The focus of this thesis is to determine the issues of Third-party custody according to § 45 of the Family Code. Third-party custody is a form of foster care. A custody request according to § 45 of the Family Code is generally submitted by child's grandparents, but also other relatives. Yet it is possible for a person who is not related to the child by blood to apply for custody if they can guarantee a proper education. Third-party custody is determined primarily upon child's interests. The aim of my work was to establish reasons behind submitting a custody request. The research pool included families under supervision of municipal authority Dačice that have a single child or more children in custody. The pool consisted of 13 families, 17 adults and 22 minors. In order to reach the objective the qualitative research was chosen, I employed survey research, semi ? structured interview with individual respondents who have a child in custody and content analysis. 17 families with children in custody under supervision of municipal authority Dačice participated in the interviews. Questions were open. Every respondent was given a chance to make their own statement. Interviews were held in January and February 2013 either at municipal authority Dačice's offices or in the respondents' household, in one case the interview was conducted at respondent's workplace. The interview took approximately 1 hour for each respondent. Respondents were given an explanation why the interview was being conducted and were assured that all information given during the interview will remain anonymous. All respondents agreed to the semi-structured interview. Additional information was obtained from case files of minors, who were placed in custody of third adult by court and are overseen by social care department of municipal authority Dačice. All cases are overseen by the appropriate municipal authority based on minor's permanent residence. The research indicates that the reasons behind the third-party's custody requests according to § 45 of the Family Code lies within a dysfunctional biological family. In many cases the reason behind a custody request was a combination of various factors. Most often the reason was an unfit mother who either didn't want custody of the child or was incapable of caring for the child due to drug or alcohol abuse. The fact that these are mostly single or divorcing mothers plays a role too. In other cases there were fathers who failed at caring for their children due to the mother dying or abandoning the family. Research shows that the maternal grandparents are those who request custody most often. Only one respondent wasn't related to the child by blood. Considering the issue of grandparents being awarded custody most frequently the reasonable question is that of an average age of the respondents which was between 60 and 70 years. That it is primarily the grandparents who apply for custody is undoubtedly result of them having an emotional connection to the child and they feel morally obliged to take care of their grandchildren. They are aware of the family situation, they know what is going on within the family and how the parents wield or don't wield their parental responsibility. Children in custody of their blood relatives with close family ties adapt easier. It is to be expected that such children won't suffer from identity perception disorder. They know their roots, family values and rituals; they know where they come from.
Protection of the foster Family in the Czech Law
BÍNOVÁ, Lenka
This bachelor´s work deals with the protection of the alternative family in the Czech law. The aim of the work was to find out whether the legal system of the alternative family care doesn´t show lacks and whether it really protects the interests and rights of minor children and their alternative parents. This work is devided upon two basic parts, the theoretical and the practical part. In the theoretical part the present conditions of the alternative family care in the Czech Republic are described. It especially concentrates on foster care and adoption. The following chapter is dedicated to confirming of the alternative family care in laws. I deal here more with actual questions of the law system of the alternative family care ? the amendment about social-law protection of the children and a new Civil Code. The last chapter of the theoretical part describes the own process of intermediation of the alternative family care and it points on pitfalls and problems connected with this issue. The practical part concentrates on the description of the technique of information collection and result evaluation. The qualitative method of the semi-structured interview. 12 specialtist answered the questions ? 4 judges and 8 social workers. It´s clear from the results that in these days the state ensures sufficient protection for alternative families according to the specialts. The respondents alerted to changes that are brought by law amendment about the social-law children protection, about family even the new Civil Code. These changes which especially concern the support and professional accompanying of the alternative family along with the respect of the children´s rights to know his origin, they can provide the alternative family according to the opinion of the respondents with increased protection and decrease the risks of malfunction. It is safe to say that the contribution of the law changes will be verified in practise in the course of time. Even though the most of the respondents evaluate the new law amendments of the alternative family care positivly, they express their concerns on how it will succeed to bring the changes into practise. According to the respondents the NRP system is not ready enough by the personal, institutional and professional points of view. The practise wil show us if it will be succeeded to remove the obstacles and the current law amendment will ensure for the alternative family in the Czech Republic more suitable conditions for creating and preservation of the functioning family environment. By the social workers and even by the judges evoked questions concerning the foster care for a temporary period and informing the child about the adoption before entering the school rather stormy reactions. During the interviews another question related with this topic has arisen. Almost all of the respondents take for a serious problem the growing number of families with inconvinient property and economical conditions. These questions are more introduced in the discussion. The work has fulfiled its aim. It has pointed on the alternative family care problems and it has also pointed on many points which could be more analyzed in the thesis.

Fostering in Classical Czech Foster Families and Fostering in Special Institutions for Foster Care-Big Foster Families. A Collation of These Two Forms.
WENDLIGOVÁ, Michaela
The thesis is a probe into the picture of alternative family care in the Czech Republic, oriented to the foster care. In the theoretical part a description of alternatice foster care for children removed from their biological family is given. It is concerned with vital needs of such children and their psychical deprivation. It tries to show why mothers waive their child and shows some aspects of social work in this field. The practical part of the thesis is concerned with the qualitative research that compares fostering in classical Czech foster families with fostering in special institutions {--} so called Big Foster Families. Research investigations are taken from the point of view of teenaged children being in foster care, and research is based on principles of modern (professional) fostering. The research investigations contain six interviews with children from classical families and four with children from special instituions for foster care. (The research is not concerned with SOS villages) Good quality of the foster care does not depend too much on the fact whether it is provided with a classical foster family or with a fostering institutions. It depends, first and foremost, on the character foster parent, i.e. if he/she is able to create positive relationships with the child and if he/she is able to adopt and accept the child unconditionally.
