Mediation and Probation service in the Czech Republic - The Enforcement of Community service

The topic of the thesis is one of the most used alternative punishments in the Czech Republic, the community service punishment. The aim of the thesis was to evaluate the development of sentencing of this kind since its implementation to legal order of the Czech Republic, with the focus on the structure of an offender, who is imposed the sentence on, and the effectiveness of this punishment execution. Further the aim is to find out the evaluation of prepared legislative changes regarding this punishment by the workers of Probation and Mediation Service in the Czech Republic. Theoretical part outlines main thoughts of restorative justice, from which alternative punishment sentencing results. It describes the kinds of alternative punishments used in the Czech Republic; it focuses on the definition of community service punishment and its current legal regulations. It also introduces Probation and Mediation Service in the Czech Republic, first of all its activity within the execution of community service punishment and its realization. Finally, the theoretical part presents forthcoming legislative changes concerning the community service punishment. The practical part is divided into two parts. In the first part the development of sentencing and execution of community service punishment is evaluated by means of the analysis of secondary data. In the second part the workers of Probation and Mediation Service in the Czech Republic were interviewed on the basis of structured dialogues and their evaluation of prepared legislative changes in the sphere of community service punishment was found out. The thesis may serve as a general survey of these problems.

Proper law of contract under the Rome Convention and the Rome I Regulation

The aim of my thesis is to analyze the proper law under the Rome Convention and the Rome I Regulation and find out the differences and similarities between them. The reasons for my research are my interest in this topic and importance of such legal forms for contractual obligations mentioned above for the development of the European Union. The thesis is composed of introduction, four parts and conclusion. Parts One and Two are general and introductory. The core of this thesis is represented by the part Three, which has analytic character, and the part Four, which is summarizing the previous text. Part One is subdivided into five chapters. Chapter One describes Private International Law and explains the notion and methods of regulation. Chapters Two, Three, Four and Five deal with the European Private International Law (EPIL). They characterize notion, meaning, and sources of law and principles of application of EPIL. Part Two is concerned with the Rome Convention and the Rome I Regulation in general. It outlines creation, structure, scope of the Convention and the Regulation; and describes international element. Analysis of factors affecting the market for pension funds in the Czech Republic

The theme of my thesis is the analysis of the factors influencing the market of pension funds in the Czech Republic. The aim of this work is to analyze the factors affecting the pension market in the last ten years. The theoretical part is focused on the overview of a given issue, the definition of legislative terms and basic concepts. There is described the basic characteristics of the pension funds and the legal framework. A separate chapter is devoted to the management of pension funds and state supervision of pension funds. There is also an overview of the development of the pension fund in the Czech Republic and other terms associated with it. In the practical part there is monitored an impact of individual factors (the gross domestic product, unemployment, inflation and wage developments) on indicators of the pension market, with evaluation by using regression and correlation analysis. The aim is to determine whether there is a relationship of macroeconomic variables on the characteristics of the pension market, or how to tight the binding between them. In the second part of the practical work was monitored the performance of each pension fund.

Companies in Private International Law with a Special Focus on the Relocation of the Seat of a Company within the European Union

The purpose of my thesis is to analyse the current legal situation, both from the Czech and European legislation point of view, concerning the transfer of the seat of a company within the area of the European Union. As evident from the title, the paper focuses on the topic from the European perspective primarily and the issue of the relocation of the seat from, or into, a non-member state is not dealt with in details. The thesis consists of four chapters. The first one introduces a necessary terminology connected with the relocation of the company's seat. Firstly the terms "personal status" on the one hand and "nationality" of the company on the other hand are compared. Then the incorporation theory and the real seat theory are briefly outlined, as well as the conflict that may arise between these doctrines. The second chapter relates to the relevant Czech legislation in this matter which is currently in force. The chapter is divided into three subchapters. The impact of the Media's perceived image on the No Bases civic initiative's development

The thesis is focused on influence of media image on folowing-up activities of the social movement. Thesis analyses the interaction of created media image and subsequent reaction or change of argumentation of the social movement. The analysis deals with the interaction between the media and activists - members of one of the largest civic initiatives of post-revolutionary period - the No Bases Initiative, and the analysis is time-bounded from the foundation of this initiative to the end of 2007. The main part of this thesis is the analysis of several key events organized by the initiative and the media response of these actions. It is outlined how the media analysis were performed - by the testimony of former members. In accordance, the research questions - how was the activity of initiative influenced by interpretations of media outputs and he extent to which the initiative was successful in asserting their arguments and frameworks in the media? The methods of research are participant observation, document analysis, discourse analysis of media coverage and interviews with key players in the initiative. Selection of the analyzed events was based on the fact whether the action was organized in order to attract media attention, search has been consulted with key research respondents.

Legal and economic aspects of termination

This thesis focuses on the institute termination of employment from the legal and economic point of view. From a legal perspective, it is mainly about the presentation of the most common ways of termination of employment, including acquainting the reader with a steady legal interpretation. From a microeconomic point of view, the termination of employment relates to the consequences for employers and employees and from a macroeconomic perspective, with consequences for the whole society. This is followed by a practical part which connects the foregoing and the current example of OKD Inc., which employs nearly 10 thousand employees and currently finds itself in serious financial difficulties, the state estimates the costs associated with the mass redundancies at different alternatives. These variants are bankruptcy or reorganization provided financial assistance to the state. At the conclusion of the two calculations are compared and outlines a list of partial measures to mitigate the effects of similar events in the future.

Impact of Quality Management and Lean Six Sigma Practical on leanness level of organizations in Czech Republic

The aim of this work is to determine a methodology to measure the leanness level of the organizations that have an internship in the framework of the minor specialization of Quality Management and Lean Six Sigma at University of Economics. The theoretical part of the Thesis presents issues of Lean Six Sigma methodology, describes basic characteristics and main Lean Six Sigma tools. The Thesis also describes process of a research, on which was applied the proposed measurement methodology of an internship impact on organizations. The research methodology describes leanness measurement approach, process of data collection and its subsequent analysis and evaluation. The last chapter includes conclusion of results, suggestions and recommendations to improve Quality Management and Lean Six Sigma Practical.

1 Abstract/ Financial derivatives The purpose of this thesis is to provide an introduction to financial derivatives which has been, from the legal perspective, described in a not satisfactory manner as quite little literature that can be found about this topic. The main objectives of this thesis are to define the term "financial derivatives" and its particular types and to analyse legal nature of these financial instruments. The last objective is to try to draft future law regulation of financial derivatives and to determine the guidelines that future legislation will follow. The thesis is divided into four chapters; a short introduction is followed by a chapter concerning the origin of financial derivatives. In this chapter we learn that financial derivatives originate from commodity derivatives, which have their origins in a period ages before Christ. The second chapter is firstly concerned with determination of the term "derivative" and it further states the main reasons for which derivatives agreement are concluded. The reasons are hedging, speculation and arbitrage. Afterwards, four well- known types of derivatives, i.e. options, futures, forwards and swaps are defined in this chapter. The Development of Local Government in the Municipality of Klatovy

This thesis is entitled The development of local government in the municipality of Klatovy. The main aim of this work is to analyse municipal policies and political mechanisms in local self-government within the election period since 2014 to 2018, and to identify unique aspects of self-government particular to this locality. This project has been divided into two parts: theoretical and practical. The theoretical part outlines basic concepts relating to municipality, local self-government members, municipal election processes, formation of coalitions, and civil and political participation. The practical part is focused on the town of Klatovy: socioeconomic indicators, summary of election results since 1994, characteristics of local municipal policy during the election period since 2014 to 2018, self-government members and relationships between them, and their co-operation in the running of the municipality. This work also focuses on current problems in local municipal policy and possibly solutions.
