The association of unit owners as a legal person

The Association of owners of units is the quite specific legal person. The purpose of my thesis was to define specialties of this legal person and describe its existence in wider connections. In my thesis I lay special stress on problems resulting from exact wording of legislation. Whole thesis is divided into nine parts. Short introduction is followed by seven capitols, after which the conclusion follows. Each capitol thinks of existing problems from different point of view. First chapter deals with the theoretic delimitation of pivotal terms, namely the term legal person, corporate body and Association of owners of units. Second chapter considers the historical view; it describes the development of legal regulations of the Association of owners of units. Individual subchapters mention the most important statutory rules solving these problems. Third chapter describes valid legal regulations of the Association of owners of units. It is divided into five subchapters, which attend to the creation and end of the Association of owners of units, object of the activity of this legal person, membership in Association of owners of units, its authorities and Articles of Association. Acquisition of real property by non-residents in the Czech Republic

Name of the thesis in English: The real property acquisitions by the non- residents in the Czech Republic. This thesis tries to resume the development of the legal regulation of real property acquisitions by non-residents in Czech Republic because this topic became very important by the 1st of May 2009, when the first transition period of exemption from the free movement of capital within EU has ended in Czech Republic. At the beginning of the thesis I am trying to set up the topic from the view of the theory of International Private Law. In this part the thesis explains aspects of imperative law regulations which have to be applied every time, no matter which law rules the contract. Then the thesis explains the difference between obligation statute of the contract and effects of the contract on property rights, especially on the ownership transfer with respect to the regulations included in the Act on international private law. In next chapter the thesis summarizes the development of the legal regulation of real property acquisitions by non-residents before the Czech Republic enters in EU. Rights of a child under the competence of bodies responsible for social and legal protection of children

70 Resumé In my thesis named " Rights of a child within the scope of the social-legal child protection authorities" I tried to focus on the activity of different entities relating to the social-legal protection of children. I have chosen this theme because I think this problem is very important and each advanced society should protect and take care of children as they can't take care of themselves. The thesis provides an initial introduction to the statutory regulations relating to the social-legal protection of children, which are primarily set out in Act No. 359/1999 Sb., on social-legal protection of children. In the present work I offer a brief overview of the most important child protection institutes, with focusing on the specific activity of the public authorities and the private entities operating in this area. My thesis is conceptually devided into seven, logically linked chapters in which I am trying to demonstrate the protection of children. In the first chapter there is a brief overview of the historical evolution of the social-legal protection of children, then, in the second chapter I am mentioning the most important law sources relating to the delineated issue. Impact of the REACH, the Regulation of the EU, on the Czech Chemical Industry

In June 2007 the new European law REACH - Regulation, Evaluation, Authorization and Restriction of Chemicals, regulating chemicals and chemical sector, entered into force. This legislative influences the whole manufacturing industry and especially the chemical industry. Bachelor thesis "Impact of the REACH, the Chemical Regulation of the EU, on the Czech Chemical Industry" deals with effects of the implementation of the REACH legislation on the companies operating in the Czech Republic. There are three parts included in this thesis: The historical overview of the development of the chemical sector, concise explanation of the REACH and the fees and charges problem connected with REACH regulation and the analysis of the financial impacts on firms, primarily differences between the groups of the companies according to their sizes.

The Liability for Damage in the Commercial Law

The bachelor thesis deals with problems of the liability for damage in the Czech commercial law. The main aim of this thesis is to provide well-arranged information about the liability for damage in the Czech commercial law. At the beginning there is the definition of the liability and in the following part there is the explanation of the liability according to the Civil Code and Commercial Code. This part of the thesis includes the general and special legal regulations and also the noncontractual liability. The conclusion of the thesis is devoted to the examination of the causality and the example of the liability insurance of the private limited liability company.

Gambling Industry in The Czech Republic

This thesis engages in discribing Czech gambling law and it's recent development in preparing a very new gambling act. The goal of this diploma thesis is to point out at the biggest problems of so far existing gambling act and at what way they should be dealt in the new one. I use two main economic theories to explain reasons of issuing new act. The first one is The Theory of Interest Groups and the other one is Theory of Public Interest which are applied at the case of Czech Republic. Next goal of this thesis is an analysis of popularity of all gambles according to sum of money gambled and money paid back. I also describe a historic development of gambles and it's regulation and show that the ability to innovate new ways to evade the law had very often no limits and the regularors have never been able to make up a clear set of rules that would be unavoidable.

Thereinafter it is targeted at representation of basic characteristics Slovak accounting including accounting principles, from with legal regulations coming-out. It refers to legal rules that give direction to accountig and it deals with process of make-up statement of balances.

Cooperation of Primary Schools and the Offices for Social-Legal Protection of Children

The bachelor thesis deals with cooperation between primary schools and authorities of social and legal protection of children. Social and legal protection of children is provided to children whose parents fail to fulfil the obligations defined in parental responsibility or fail to pursue or abuse the rights defined in parental responsibility. Social and legal protection is also provided to children leading immoral or shiftless way of life or regularly escaping from their parents. The general notification obligation assigns schools to notify local authorities of communities with wide competences of fact that indicate that a child requires social and legal protection. The goal of the thesis is to find out how a primary school cooperates with a children social-law care department in relation to social pathologic behaviour in primary school children. Two research questions were set to reach the goal. I tried to find out in what way cooperation between primary schools and authorities of social and legal protection of children is conducted and whether primary school teachers and social workers consider the cooperation efficient, by means of semi -structured interviews with primary school teachers and with social workers. The data obtained this way were analysed by the open data coding method. The cooperation is based on mutual transfer of information on pupils with problems, reports and written assessment of pupil's behaviour and school result. Social workers and primary school teachers meet at consultation meetings and also at disciplinary boards and case conferences. School teachers and social workers consider their cooperation effective. Certain problems however occur in their cooperation. To make the cooperation more effective two teachers propose more frequent updating of laws and applicable regulations with regard to current needs of children and legislation modification. Social workers propose establishment of a multidisciplinary team, an increase of the number of social workers and presence of a lawyer at the children social-law protection department, education in social and legal protection of children for primary school teachers, and an Internet forum. The results of the thesis may be used for making the cooperation more efficient and for prevention of risky behaviour among primary school children.

The impact of regulation on the protection of financial intermediary clients

Financial intermediation due to misselling harms consumers. The work concerns to regulation of financial intermediaries and relation between financial intermediary and his or her client. The main objective is to analyze how the regulatory of commissions impact financial intermediation. The paper analyzes the current form of legal status of financial intermediation in the European Union and the Czech Republic and results in analyzing the impacts of regulatory proposals that was discussed in Chamber of Deputies Parliament of the Czech Republic. It concludes that if the proposals were accepted, it will not improve the quality of consumer protection, but even can cause damage to the client. The current legislative base moreover provides sufficient resources to prosecuting financial intermediation, which does not respect the client's interest. For analyzing the relation between financial intermediary and his or her client is developed theoretical model based on theory of games.

The process of public tenders for the police

The aim of the thesis is evaluation of the public procurement issue in the Police of Czech Republic (Policie České republiky) namely from beginning of the public procurement until its realization. Aim of the thesis is evaluation of the process of public procurement in the Police of the Czech Republic from the theoretical point of view, thus description legislative environment and from practical activities involved subjects the point of view as well. Procedure itself of the public procurement is regulated by the generally regulated legislation, but regarding to the subject of the contract owner like Police of the Czech Republic, is this procedure determinate by the Ministry of the interior regulation. One of the basic presumptions for effective and economical spending of the public funds, not only in the police, but also in the whole public administration, are correct public procurement when buying services, supplies or building operations. In this thesis is described procedure in the realization of the public procurement from its planning until contract concluding. In the thesis are also mentioned subject, which are involved in this process including their rights and responsibilities.
