A notary and civil procedure

The aim of the thesis is to analyze the role of the notary in the Czech legal order placing emphasis on the link between his activities and the civil process. The thesis is divided into three chapters. The opening chapter deals with the history of notary office and presents and clarifies the basic notary principles. It is also dedicated to the scope of their professional organisation. Chapter two represents the most extensive part of the thesis, where the relationship between notary and civil procedure is clarified. The first subchapter deals with the role of notary as a court commissioner within inheritance proceedings. While performing acts in the inheritance proceedings, his activities resemble to the field of activities of a judge, because notary carries out the whole proceedings from the moment of the authorisation given by court of first instance, including the decision on the merits. The second subchapter is dedicated to the role of notary while drawing up notarial deeds under which executory proceeding can be directly ordered and carried out. If the notarial deed meets all the requirements by law and contains the clause of execution, it represents a public document, which works in the executory proceedings as a mode for execution thanks to which the civil procedure can be skipped. A notary in the legal order of the CR

The aim of my master's thesis titled "A Notary in the legal order of CR" is to completely describe role and position of notary public on in our republic. This legal profession has a deep roof in history and long tradition and today is very credible in public view. Position of notary is very special primarily because some results of notarial work are considered as public documents. This is consequence of deputation public competence from the stat to notary, nevertheless notary remains liberal profession. The thesis is composed of seven chapters. Chapter One is introductory and describes historical circumstances, next today's valid and relevant legislation, of which is the most important "Notarial Procedures". Chapter Two in the first place deals with statutory requirements for the notary's function. Then defines basic terms and principles as: notarial work, notarial office, impartiality and independence of notary. Chapter Three is subdivided into many parts, each of them dealing with different aspects of notarial activities. Main and crucial activities are: preparation of notarial record on legal acts, certifying of legally significant facts and declarations, court commissariat. Decedent's estate proceedings

The subject of my Master's degree thesis is the issue of proceedings relating to decedent's estate. The main aim of this thesis is to describe the course of this proceedings with respect to current legislation. In general, the inheritace rights arise at the very moment of decedent's death. Nevertheless, the decedent's estate proceedings must still take place. A notary (as a court commissioner) is therefore tasked to locate potential inheritors, assets and debts of the decedent's estate. The goal of the proceedings is to devide relevant assets and debts among located heirs. My thesis is devided into four individual parts. First of them consists of two chapters, which are dedicated to history and sources of law. The second part deals with general aspects of decedent's estate proceedings. It consists of four chapters about characteristics and function of decedent's estate proceedings, jurisdiction, notaries as court commissioners and parties of the proceedings. Translating and interpreting services for judiciary practice in Russia (compared to services provided in the Czech Republic)

The aim of this thesis is to describe the interpretation and translation services for judicial purposes in Russia and systematise the way in which they are used in judicial practice. The investigated topic is handled functionally and descriptivelyaccording to the following criteria: (1) development/historic - a description of the development of translation and interpretation services in the USSR and in modern Russia; (2) legislative - the status of the interpreter and the translator in the judicial process, their rights and responsibilities, formulation of ethical principles of their activities; (3) an objective evaluation - an assessment of the conditions for the exercise of a court interpreter and translator, qualifications and growth, the criteria for the selection of a professional translator/interpreter from agencies, the role of notaries in the translation process and its role in checking translations. Linking these aspects will enable not only a comprehensive view of the situation, but also to compare them with the services offered in the country.

The title: The notary and civil procedure The aim of the thesis is to map the activity of notaries in the legal order of the Czech Republic, which is considered to be very specific by public. The thesis focuses on the relationship of the notary and the civil procedure. It deals with the role of the notary in the civil procedure. The thesis is divided into six chapters. The first one describes the history of a notary public and the assumptions for notarial activity and for its commencement are also clarified. Part of this chapter deals with the basic features of the notarial profession, such as the impartiality and independence of notaries, the principles of which notary public is controlled, and notarial career. The second chapter of the thesis focuses on the relation between a notary and civil procedure, which can be defined as process of the court and the participants in order to provide the protection of subjective rights and obligations. One of the areas, where the role of the notary is reflected is legal assistance. The third chapter concerns with the provision of the legal assistance by the notary. Legal professions involved in the justice system

My master's thesis titled "Legal Professions involved in the justice system" is focused on a notary public. This chosen legal profession originates from the ancient Rome. In this historical period was constituted a tradition of the profession existing in the continental legal system. Notary public has a specific position among legal professions on grounds of its functions. Notarial activities are patterned on a general legal principle including constitutional conventions (principles). The purpose of my thesis is to analyse and describe a performance of this profession by notaries in their practice. The text of the thesis is composed of seven chapters. The first of them deals with some elementary information about the notary public as a type of legal profession, the difference between legal aid and legal services and eventually the form of regulation of particular professions which are regulated by special Acts such as the Code of Notarial Practice (the Notarial Act). Proceedings relating to decedent's estate

The title of my Master's degree thesis is "Proceedings relating to decedent's estate". I have chosen this topic because of many reasons. Although it is a traditional institute of civil procedure law, the topic is still very actual with regard to the new legislation in the Act No. 89/2012 Coll., The Civil Code, which was a significant extension of inheritance law, and the related procedural legislation in the Act No. 292/2013 Coll., on special judicial proceedings. Another reason is that I find this topic interesting, mainly because of its complexity and significant blending of procedural and substantive legislation. Since participation in inheritance proceeding is an inevitable issue in person's life, I wanted to extend my knowledge of the new legislation. Moreover I find this topic wrongfully overlooked in advocacy, to which I would like to head after graduation. The aim of the thesis is to describe the course of proceedings relating to decedent's estate and to show the different stages of the procedure and also include important substantive aspects and institutes which affect this procedure in the extent necessary. I have chosen the subject of Inheritance procedure in order to get more familiar with this area of law. With the help of effective legal regulations this thesis was aimed to make a thorough analysis of the inheritance procedure and to find a better solution to some of the problematic aspects of the current legislation. In the introduction I briefly deal with some of the historic events. At the same time, I mention changes which will be introduced by the new civil code. Then, the inheritance procedure is generally charecterised and I deal with the authority and competence of the courts, with the subjects of the inheritance procedure and with its delivery. The next part looks into the process specifically. It includes the following chapters: Initiation, Further progress, Inheritance administrator and the preliminary measures, Preparation of materials for the proceedings, Proceedings, Settlement of the common property of spouses, Inventory of assets and liabilities, Final resolution on the heritage, Overindebted heritage and Corrective tools. This thesis titled "The notary and civil procedure" deals with the role of notaries in the legal order of the Czech Republic. Notaries public have a long historical tradition in our country, even though the organization of their profession has changed over the years. General awareness of their profession, which is considered to be very conservative, is not too widespread. It was also one of the reasons, why I chose thesis topic from this field. The aim of this work is to analyze the activities of notary, which are related to the civil procedural law and civil process, characterize the principles, which are typical for him and to clarify the position in which is the notary public while conducting each task. This thesis is divided into five chapters. First of them, except a brief history, explains basic concepts such as notary and notary office. This is followed by a description of the fundamental notary principles, assumptions for the appointment and organization of their profession. In the first half of the second chapter are summarized all activities of notaries in the Czech Republic under the current Law on Notaries. The activity of a notary in relation to the common assets of spouses

This rigorous thesis deals with the activities of notaries in relation to the common assets of spouses. The theme was chosen because of the profession of the author, who works as a permanent representative of the notary. The purpose of this thesis is not a detailed interpretation of all legal provisions in the common assets of spouses, or to answer any questions that this legal institute initiates. Its aim is to preview the common assets of spouses from the perspective of a notary, who acts in the position of the impartial and independent person, equipped with professional knowledge. The rigorous thesis is divided into six chapters. The first chapter describes the legal regulation of the common assets of spouses. The second explains the basic concepts related to the notary and notary activities, and it also deals with the notarial records of agreements modifying the common assets of spouses. The third chapter deals with probate proceedings in connection with the common assets of spouses. The fourth focuses on the acquisition of real estate property by spouses. In the fifth chapter I describe some of the European legislation of the marital property law. The sixth chapter deals with the amendment of the Civil Code in relation to the common assets of spouses.
