Právní a zdravotně sociální aspekty činnosti OSPOD jako ustanovených opatrovníků v zámu nezletilých dětí

The Czech Republic as a signatory of the Convention on the Rights of the Child has vested the practice of state administration in the field of care for minor children to municipalities with extended powers, where the protection of the rights and legitimate interests of minor children is safeguarded by state authorities of social and legal protection of children (ASLPC hereinafter). These authorities are incorporated to the extent laid down by the Act on Social and Legal Protection of Children (Act No 359/1999 Coll., as amended). The position and roles of ASLPC and their competence and jurisdiction are also regulated by the same act. The position of workers of these authorities and its legal embodiment is equally important. Regarding professionality, there are high demands on these workers. In the Czech Republic, significant changes in legislature have been made over the past three years. These amendments have led to the strengthening of the rights of minor children and to the establishing of new tools for their protection. In connection with the adoption of new substantive regulation of family law, which is now exhaustively dealt with by the Act No 89/2012 Coll., the Civil Code, new procedural rules have been established regarding protection of rights of minor children. Such procedural legislation includes (apart from the long-existent Act No. 99/1963, the Code of Civil Procedure) the Act No 292/2013 Coll., on Special Civil Proceedings. The decision-making regarding minor children has been vested mainly by the state into the competence of courts. The courts appoint the locally relevant ASLPC as a guardian who then represents the interests of minor children. The purpose, interwoven with and derived from the first one, was to explore the opinions of selected social workers of ASLPC and of district court judges regarding the defined problems occurring during the work of ASLPCs and courts while protecting the interests of minor children. These particularly include: the use of the tool of precautionary measure; problems of different territorial jurisdiction of courts and ASLPCs; processing of complaints regarding bias in various phases of the proceedings; professional training of workers of ASLPC It is evident from the proposals of both judges and ASLPC workers that it is necessary to unify territorial jurisdiction. The courts are suggesting the priority criterion of the address where the child mainly resides. ASLPC workers suggest the official permanent residence as the prime criterion. Bias causes problems in all phases of proceedings. It is obvious that courts take differing approaches towards the solution of this problem (some courts solve the problem of bias complaints filed by the parties while other courts do not) and for ASLPC workers it is difficult to assess how to act when such complaint is raised against them. The training of ASLPC workers - workers are obliged to educate themselves and their employer is obliged to finance such training. Not all ASLPCs are able to provide training in the required extent - due to financial reasons (the average costs of education of one employee pose from 9,169 to 13,400 CZK annually and they cover approximately 6 days of training). The heavy work-load caused by insufficient numbers of ASLPC employees prevents them from completing such compulsory training. As part of the examination of the "participation of a collision guardian in court proceedings" it has been found out that irregular participation of the worker in the proceedings (absence from participation in appeals proceedings); incomplete reports (directed to courts) from surveys in families. Based on comprehensive examination of the problems of territorial jurisdiction, it was recommended that requests are independently recorded and financial compensation is provided for ASLPCs who are requested to represent minors in front of courts, to draft proposals for precautionary measures.

Augustin Navrátil and his disident activities

Augustin Navrátil This thesis addresses the life and work of Augustin Navrátil (1928-2003), a Roman- -Catholic activist from the Moravian township of Lutopecny near Kroměříž. A. Navrátil has not been subject of a complex publication yet, although he is the author of the largest petition demanding religious - and with that going hand in hand also civic - liberties in socialist Czechoslovakia (1988, 600 000 signatures). Followingly, this is the first attempt to biographically outline the personality and motivations of this farmer, politician (member of the party Lidova strana), man who signed Charta 77 but also a husband and father of nine children. The aim is to cover his life from his birth, over his family background to the beginnings and heights of his social engagement. The text will mainly deal with 22 open letters in which he drew attention to various illegal practices and actions of the Communist power, as well as with the three petitions he authored (1978, 1985 a 1988) and the samizdat (self-published) journal Křesťanské obzory (Christian horizons), which he published with a group of others from June 1988 to July 1990. In contrast to most Czech dissidents, he was never sentenced to a prison term for his activities, but he had to involuntarily undergo repeated psychiatric treatment. He was...

Relationship between petrographic parameters and technological properties of clastic sedimentary rocks used for crushed stone

This diploma thesis is focused on the finding and describing of the relationships between petrological parameters and technological properties of rocks used for the production of aggregates (crushed stone). Rock specimens were selected from a geological area of Culm (Lower Carboniferous age) in the area of Nízký Jeseník Mts. and Drahanská vrchovina uplands in the Czech Republic. Studied localities were selected on the basis of the current quarrying operations and also to represent the different strata. The six studied localities encompass Kobylí, Chabičov, and Bělkovice where Horní Benešov formation of Nízký Jeseník is exposed. Locality Valšov represents Andělské Hory formation and locality Nová Ves and Loštice represent Protivanov formation of Drahanská vrchovina uplands. Two specimens were taken from the locality Loštice (one from the second cut because there are produced low-grade aggregates and the third cut where high quality crushed stone is produced). A detailed mineralogical-petrographic examination of the samples was the first step, in an attempt to obtain their mineralogical composition and to identify the major rock-forming clasts. The contributions of the sections (NACE-CZ) to the creation of gross value added

The aim of this thesis was to evaluate the contributions of the sections (NACE-CZ) to the creation of gross value added. The first part of this thesis described the theoretical concepts relating to national economic gross value added. Analytical processes were used for the calculations, which may be used only if we are dealing with an additive link between individual factors. The sections' contributions to the creation of national eco-nomic gross value added were evaluated in the practical part, on the basis of the proc-esses set forth in the methodology. In the given time horizon, contributions by institu-tional sectors and groups of sections classified according to the level of technology showed a certain dependency on the actual economic cycle. Although the strongest in-stitutional sector is non-financial enterprises, they were the ones most affected during the crisis period, together with government institutions. On the contrary, the financial institution sector showed a strong position during the crisis period. In terms of the grouping of the sections according to the level of technology, the greatest contribution to national economic gross value added is by groups B1 and B2. The influence of the economic cycle was noted in all the groups but, according to the results, group C did not react quite as sensitively as the other groups.

Proceedings regarding regressive compensations in health insurance

This bachelor thesis concerns proceedings dealing with regressive compensations in health insurance, that is guided by law No. 187/2006 Coll. about health insurance. The regressive compensation as such takes place when a certain person causes, by his or hers unlawful action, as found by court or other authority, a reason for amount of compensation to another person and is obliged to reimburse the health insurance institution by a prescribed amount. Most often this is a result of traffic accidents, less frequently as a result of physical attacks or fights. The amount that is prescribed as a reimbursement is determined by the actual compensation paid. Together with proceedings about being ordered to pay this regressive compensation, there are other preceedings also concerning regressive compensations, such as pardoning of this regressive payment in which it has been decide for the benefit of concerned person only for reasons defined by law, such as immediate danger of his malnourishment. Also, the proceedings may start about the person being allowed to pay by instalments. This may permit the person to pay a certain amounts at certain conditions as prescribed by the decision. The law also permits cancellation of this insatllment payments option, when the agreed upon conditions are not met. This is a relatively new system that is relatively welcomed by the organs of health insurance, mainly because of the recovery of a certain amount that had been previously wrongly paid. This work is divided into five chapters, dealing with individual components concerning regressive compensation and their relevant proceedings. The first chapter of this work is focused on general information cocerning health insurance. It is divided at several subchapters, dealing with law status, basic principles, subjects of health insurance, group of insured persons, institutional security and a very important subchapter, which is important just for determination of regressive compensations, such as the amount of health insurance and tied to it, the health status determined by an involved physician or medical adjudicating comission. The second chapter deals with proceedings about regressive compensations in health insurance, description of its various stages, such as the commencement, pausing and stopping of the procedure, including the issuance of the decisision and eventual appelation. Included is also a basic information about the pinciples and subjects of these proceedings. Tied to this are the relevant rules and processes that are part of lawful relationships in health insurance, being governed by law No. 500/2005 Coll. about administrative rule, unless set by later rules No. 187/2006 Coll. about health insurance, otherwise. The result of these proceedings is the issuance of the decision, including the entitlement and the amount. The third chapter analyses various types of regressive compensations, such as the pardoning of the regressive compensation, allowing to pay by installments and cancellation of this option. The fourth chapter gives the statistical survey about the development of regressive compensations since their establishment on Jannuary 1, 2009, when the determination § 126 was created. Statistical tables show numerical data about the number of issued decisions and the amounts of compensations in each individual year. The fifth and final chapter contains the closing comments on the topic and suggests possible improvements of practical usage. The aim of this thesis is the analysis and the clearest possible description and definition of the valid law modification, focused on regressive compensations in health insurance, so that it, together with the literature cited, could serve as a source of information, or improve the orientation of eventual direct or indirect participants of these proceedings.

Portfolio diversification

The goal of this bachelor thesis is to show how the choice of stocks impacts the portfolio diversification in relation to risk and return. The risk was calculated as standard deviation and historical return rate was considered. The theoretical part explains basic terms related with portfolio diversification, Markowitz model, capital stock and most important factors that lead to the optimal portfolio creation such as return, risk and covariance. The practical part explains in detail, how to create an optimal portfolio. Ten companies from different sectors were randomly chosen for this bachelor thesis. These companies' shares are traded on the New York Stock Exchange. The covariance of these shares is lower than one. The next step was to calculate historical return rate and historical risk of portfolios. The highest value of historical return rate was 2.31 % and the lowest value of historical risk achieved 22.77 %. Subsequently, the efficient frontier was determined. The efficient frontier is the set of optimal portfolios that offers the highest expected return for a defined level of risk or the lowest risk for a given level of expected return. The lowest value of portfolio risk was 2.97 % with a return of 1.38 % and the highest value of portfolio risk was 4.03 % with a return of 2.13 %. The investor chooses the portfolio which maximizes his expected benefit.

Doing business while studying

This thesis tries to find out which factors are important, that student starts his/her own business. This thesis is devided to two parts. the first one is teoretical and second one is practical. Teoretical part is about business and motivation. The aim of second part is to identifie and examine factors of motivation doing business, analysis of current situation in Czech republic and analysis of business support also in Czech republic and abroad.

Differentiation of offers and methods of working physiotherapy of persons with a mental or combined handicap in a practice of social service providers and another subjects.

In the Bachelor's thesis I have dealt with differentiation of tenders and rehabilitation methods. Specifically, individuals with mental or multiple disabilities and for providers of social services and other bodies. In the theoretical part I focused on defining the basic terms relating to that issue. In the introductory chapter I dealt with the definition of the concept of mental disability, causes of its creation and definition of degrees of mental retardation. The next chapter is devoted to the combined disability, specifically the yoke of the definition, causes of and classification. In the third chapter is devoted to the importance of the work, the status of the work in a person's life and the status of work for persons with disabilities, including individuals with mental or multiple disabilities in Bachelor thesis I. In the next chapter, I deal with comprehensive rehabilitation system, specifically the remedies rehabilitation, educational resources, social resources, rehabilitation, rehabilitation and special attention devoted work resources, rehabilitation, which will directly affect the Bachelor thesis. Furthermore, I determine a target group the work of rehabilitation and the preconditions for its implementation. In other chapters is devoted to the specification of tools and resources work rehabilitation, employment policy tools and I define jobs that are offered to persons with intellectual disabilities. In the practical part of the thesis, first determine the main aim and target work. The main goal was to determine what are the menus and methods of rehabilitation for people with mental or multiple disabilities with providers of social services. As the target I had set to determine what are the possibilities of transmission from individual to social services on the open employment market. Specifically, I've focused on the resources provided by the rehabilitation of daily, weekly care centers or day service center, in addition to the socio-therapeutic workshops, in a sheltered employment, and employment on the open employment market. To meet the objectives I used a qualitative approach, specifically the semi-structured interview with six providers of social services of the South Bohemian region The analysis of the information obtained, I discovered that if the device is operated daily, weekly social welfare institution or Centre, day services, the services provided are identical, not different from each other. In the case of socio-therapeutic workshops is the diversity of the wider, each device provides a variety of services, different options, some devices have socio-therapeutic workshops directly on the device, others have socio-therapeutic workshops and externally, outside of your device. Protected jobs are also in the majority of providers of social services offered both within and outside the device, always the odd jobs, such as in the kitchen, cleaning, in teahouses and the like. It always depends on the type and degree of disability, on the basis of a levy for the client to the appropriate activities. Location of the client on the open employment market is not very common in most devices, some devices that offer clients or do not provide. Partial objective was to detect transmission, I found that the only limiting factor is the client's disability that limits its options and device options, of course, that the services it offers and delivers. The aim of all devices is to achieve the greatest possible degree of autonomy of the client and allow it to advance from care centers or day service center in the socio-therapeutic workshops, found a protected job, and a job on the open employment market.

Dance as a means of integration adults with intellectual disability

The goal of the bachelor thesis called Dance as a means of integration adults with intellectual disability was to create, implement and evaluate a dance course focused on the development of social competences in adults with intellectual disability. The thesis deals with adults with intellectual disability and with a leisure activity focused on dancing. There is some space for the development of social competences in adults´ leisure time. In response to the current situation of leisure activities proposition for adults with intellectual disability. I found it beneficial to found a dance group of adults with intellectual disability, and at the same time a group of individuals intact in places unfamiliar to them. Based on an activity which may be implemented amusingly it is possible to develop an individual´s personality as well as his or her social competences, which become a presumption of a successful integration, universally. The bachelor thesis consists of four chapters.The first chapter defines the term ´intellectual disability´. Further on the attention is paid to the characteristics of the target group, i.e. adults suffering from a slight and medium mental retardation. Further on, the disability´s impact onto the human psyche as well as social area is described. In the second chapter the term ´dance´is defined and then the description of its usefulness within the leisure, artistic and therapeutic areas is given. In the third chapter the presumptions for a successful integration are described. In the conclusion of the theoretical part there is an interconnection made between the target group and the activity for developing social competences. The theoretical part of the bachelor thesis is continued with a practical part, the fourth chapter. It is a programme of a six-month course which I have set together based on the analysis of expert literature and my experience gained during the leadership of dance lessons and working with adults with intellectual disability. The programme will include work methods and an evaluation of partial activities. The six-month course was held in the school year of 2015/2016 and 6 intellectually disabled adults took part in it. Students of the University of South Bohemia joined the course. Partial goals were set for individual dance lessons and the activities were set so that they would develop social competences in participants non-violently and in the greatest extent possible. The course was implemented in the IN Civic Association facilities. To evaluate the activity and find out the progress within the area of the participants´ social competences, several development fields have been set. Several chosen social competences were divided into evaluation scales. The participants were evaluated at the beginning of the course and then again, six months later. The evaluation method chosen was my own observation. I focused on the evaluation of my own working, on group evaluation and the evaluation of each individual. Evaluation was also done on the part of each course participant, too. Dance lessons and activities connected have proven to be a suitable means for developing social competences in intellectually disabled adults. In five participants the values have risen in 5 10 out of 17 competences observed. A recourse occured in a participant who was going through a difficult life situation during the last two months of the course. Values have risen dramatically and in all participants in the area of group cooperation. Five participants made a progress in establishing and keeping eye contact and in starting a conversation. One participant has made a progress in the area of group performance, another one has made a progress in the area of independence and another one started to call the other participants by their names, as opposed to the beginning of the course. In general, the members of the group became more self-confident.

A nursing issue: peripheral venous catheter

Peripheral venous catheter is used to access the venous system. It is one of the most commonly used invasive procedures in health care facilities. This procedure falls within the competence and daily tasks of nurses. Therefore this type of nursing care is susceptible to risk of proceeding routinely which might result in conscious or unconscious errors. Peripheral venous catheter needs to be introduced into the patient's vein in the following cases: planned parenteral nutrition, infusion or transfusion therapy, application of intravascular medication or contrast media, rehydration, blood sampling (which can be performed immediately after introducing the peripheral venous catheter and before administrating medication) and also during an emergency care for critically ill (such as cardiopulmonary resuscitation). Nurses should be as knowledgeable as possible about this issue so that the peripheral venous catheter can be introduced well and fulfil its purpose. It is important to ensure that nurses obtain all the necessary information about their patients before inserting the catheter and that they are able to properly inform the patients about the procedure and to communicate with them. Next, nurses should be familiar with the correct procedure for inserting catheters, they should be informed about possible contraindications and know how to choose the correct type of catheter as well as where to place it. Furthermore, nurses should care for this vascular access correctly and provide the patient with enough information about taking care of the catheter after the procedure. Finally, nurses should be aware of their own potential errors and also of possible complications. Therefore they should employ aseptic technique so that they can eliminate nosocomial infections. The thesis is divided into a theoretical and an empirical part. The theoretical part focuses on the history of peripheral venous catheters and their types, indications and contraindications, necessary equipment, nursing care, complications, etc. The empirical part consists of a research. The aim of the thesis was to map the use of peripheral venous catheters in hospitals as well as to identify factors that may lead to problems among the patients with peripheral venous catheters. Four research questions were assigned to these aims. 1. What is the procedure prior to inserting a peripheral venous catheter? 2. What are the standards of caring for patients with an inserted peripheral venous catheter? 3. In which steps of caring for peripheral venous catheters do the nurses lack knowledge? What equipment do the nurses prepare in order to insert a peripheral venous catheter? The Bachelor's thesis was conducted using a qualitative research survey. The methods of collecting data included semi-structured interviews and participant observations. The research was carried out only in one hospital ward and it was anonymous. First, the data were collected by means of a semi-structured interview. The nurses were asked 14 questions (see Appendix 8). During this interview, several more subquestions were added. The results of the interviews were then grouped into several categories for the sake of clarity. The second method of collecting data was participant observation. The observed facts were recorded into an observation sheet (see Appendix 9). The same nurses who were interviewed were also observed. This Bachelor's thesis has been written in order to provide a basic overview of the peripheral venous catheters. It could be used as an information source for more experienced as well as novice nurses. The practical output of this Bachelor's thesis is a nursing care standard concerning peripheral venous catheters. This standard was missing in the hospital ward and could help the nurses to take care of these vascular accesses, to proceed correctly and eliminate possible errors (see Appendix10).
