Discharge of individuals - method of solving bankruptcy

This thesis deals with the discharge of individuals in the Czech legal environment that is regulated by Act No. 182/2006 Coll. Insolvency Act. The aim is to show the course of insolvency proceedings with a focus on discharge of individuals and then make comparisons with the law of bankruptcy proceedings in the United States and Spain. Finally the real example of a specific individual discharge is shown.
Insolvency proceedings from the view of insolvency administrator's duties

This diploma thesis deals with the insolvency administrator. The objects of this work are mainly are the duties that insolvency administrator has to execute during the insolvency proceeding and the necessary requirements for the performance of the insolvency administrator's function. The objective of this work is to clarify the role of insolvency administrator in the particular phases of insolvency proceedings in general terms and the definition of his position and responsibilities in different types of insolvency proceedings. The aim of this work is also to analyze the assumptions that insolvency administrator must meet in order to obtain permission to perform the function of the insolvency administrator.
Recovery of Debts according to the Legal Order of the Czech Republic

The thesis is focused on questions of natural persons' recovery of debts according to the legal order of the Czech Republic. The purpose of the thesis was to provide creditors with comprehensive information and insight into the questions of recovery of natural persons' debts according to the legal order of the Czech Republic and to draw creditor's attention to legal possibilities when recovering debts. The outcome of the thesis is creation of diagram that can help creditors to better orientation. Diagram shows separate steps creditors can undergo when recovering debts. Particular possibilities when recovering debts are outlined, practical instruction and remarks are added, economic contexts are analysed, available statistics and development trends are analysed and proposals de lege ferenda are presented.

Restructuring and rescuing Odevni podnik Prostejov, a.s.

The topic of the bachelor's thesis is application of the new Insolvency Act No. 182/2006 Coll, as subsequently amended, which is a crucial contribution to the Czech insolvency law offering new ways of settling debtor's bankruptcy. I point out the differences between the currently effective Insolvency Act and the preceding Act No. 328/1991 Coll, about bankrupcy and liquidation, as subsequently amended. In the theoretical part I describe the most important features of a insolvency proceeding and also the process and the possible ways of setlling bankruptcy. The aim of the empirical part is then to describe and evaluate the solving of the situation during the insolvency proceeding of the Odevni podnik Prostejov, a.s. in 2010 up to the present day, with the use of the new Insolvency Act.

The introduction is followed by the part where you can find information about laws which rule insolvency. The whole document deals with the comparison with Czech legislation. Reader can gain information about all proceedings in insolvency from the petition to order of discharge from debts. This document is divided into two big parts depending on the person of debtor. The document is focused on methods of resolution of insolvency.The document ends with practical part. The end deals with a project, which has helped to shorten the time of insolvency process in Malaysia. This part is completed with transparent schedules and graphs.
Comparison of corporate bankruptcy solutions

The aim of this bachelor thesis is to compare solutions of corporate bankruptcy in the Czech republic and Poland. The content of this thesis are described insolvency proceedings in both countries and their following comparison based on international statistics. A benefit of this thesis is a different view on insolvency environment by help of comparison with Poland. The comparison criterions are the main indicators for evaluation of effectiveness of insolvency proceedings in both countries. The reasons for values of the criterions of time, cost and recovery rate of insolvency proceedings are stated with most imported causes for those values.
Analysis of the financial situation of a company and insolvency resolution in accounting

The thesis is focused on two main fields: first one is financial analysis as a possibility of predicting a stringency of a company, second one being insolvency resolution from legal and accounting points of view. The theoretical part of the thesis describes the importance and the content of financial analysis, the crisis of a company and further on it deals comprehensively with insolvency proceedings. The practical part is mainly focused on performance analysis of the financial situation of a selected company, it sets problems in the field of financial management. It also gives an opinion on the possibility of the company's bankruptcy and demonstrates an insolvency proceedings in accounting.
