Legal regulation of payment transactions

This thesis is formally divided into 5 sections, which are: introduction, definition of basic terms, essay on the most important aspects of regulation of the payment services providers, chapter dedicated to payment systems and conclusion. It should argue on issues conected to payments and it is focused mainly on it's regulatory part. Introduction to the thesis sets the goal of it and defines the extent of the issues researched as well as the areas that are not accented much. The basic terms that are defined in the thesis are payment, payment relations, payment transactions, means of money, payment devices, electronic money, payment orders and payment services. This thesis contains non-regulatory issues as well as it accentuates the sociological importance of payment relations. It also shows historical connotations and describes trends which can be observed in the defined areas of exploration. It's goal is to explore and describe mainly the regulatory part of the issue though. The core structure of all parts is therefore focused mainly on the form of legal regulation of payments in effect. Legal Regulation of Payment Services

The aim of this thesis is to clearly describe all payment services which can be found in current Act on Payments of 2009 and also new payment services under new Act on Payments. New Act on Payments will come into effect on 13 January 2018. The reason for its adoption was the need of transposition of the revised Payment Services Directive known as PSD II. This directive brings significant number of changes into the area of the regulation of payments. Moreover, this thesis devotes to introduction and analysis of all subject authorized to provide payment services in the Czech Republic. The development of the regulation of payments in the Czech Republic is briefly described in the first part of the thesis. Regarding the extensiveness of this topic, it is only outlined which acts have regulated payments in the Czech Republic. The second part of the thesis deals with positive and negative definition of payment services. When describing a single payment service, the difficult situations which can occur due to this payment service are mentioned. The section on negative definition of payment services explains the exceptions which cause that some activities are not consider to payment services pursuant to current and new Act on Payments. This bachelor thesis is written on the topic Payment instruments and their application. In the introduction of the thesis is legal definition of payment services. Then the thesis is aimed at development of payment instruments during last years and describing currently provided payment instruments. The main object is to create comprehensible and integrated summary of payment instruments. The practical part consists of the analysis of the use of payment instruments from selected banks in the Czech Republic.
Core banking systems

This diploma thesis deals with the topic of core banking systems. The main objective is to analyze the implementation of the SEPA payments into the payment module. The theoretical part defines the concept of core banking systems and its history. It also compares conventional approaches to core banking systems with Islamic ones. The theoretical part also includes chapters about implementation approaches, the most common challenges in implementation and architecture of core banking systems. Next part of thesis is about the basic modules of core banking systems. The practical part is about the analysis of requirements on core banking systems. Especially the requirements that are mandatory from legislation perspective. These are SEPA payments, PSD2 and instant payments. Gap analysis is used as the main method. We chose SEPA payment implemetation as the requirement that we will analyse. There are two possible solutions that can be used. The first one is the customization of the current payment module and the second solution is implementation of the payment hub. The conclusion of the thesis focuses on the best solution for each of two types of bank institutions. The main acquisition of the thesis is the recommended solution for two different types of banks. And second of all, the conclusions which was founded in this thesis should be used for another requirements such as PSD2, the introduction of instant payments, and more.

Financial Arbitrator The legislative introduction of the institute of Financial Arbitrator as the relevant authority for settling out-of-court disputes into Czech law is a relatively new phenomenon, and is related to the interests of consumer protection within the European Union. In particular, the interests of the European Union in this area are to reinforce consumer confidence in the financial market. Given the fact that the majority of consumer disputes are so-called petty disputes, and resolving these disputes before the national courts is too lengthy and costly for consumers, the European Union has placed a duty upon its Member States to introduce the option for consumers, in case of any possible disputes, to be able to turn to the out-of-court dispute settlement authority for assistance in selected areas of the financial market. Any proceedings heard before such authority are free-of-charge and less formalized, thus enabling consumers greater accessibility in protecting their rights against institutions operating in the financial market. Firstly, it is necessary to gain theoretical knowledge about field of costs, then it is possible to analyze costs and design suitable solution for a company. The first chapter contains theoretical findings. Second chapter analyses costs and its task is to lay out that fields, which are problematic or hides huge savings potential. The third chapter contains designed procedures which, as a result, should lead to savings in particular fields.

Payments and position of SEPA payments in payment systems

The masters thesis Payments and position of SEPA payments in payment systems deals with the transition of the national payment system to SEPA payment instruments in the Czech Republic, which is coming into force this year. Banks will have to fulfil requirement of interoperability and will have to be able to proceed payments in XML form. The theoretical part defines payments by the payment form and territorial payments in the first chapter. In the 2nd chapter, the legal framework with focus on new legislation affecting the completion and implementation of the SEPA requirements is described. The following two chapters are devoted to payment systems in the Czech Republic, European Union and telecommunication network SWIFT. The 5th chapter discusses about the SEPA project, with the main emphasis on the definition of SEPA instruments. The practical part is dedicated to analysis of foreign payment fees in selected banks with a focus on individuals.
Electronic banking in the Czech market with the focus on direct banking
