1 Latent criminality Abstract This submitted diploma thesis deals with the phenomenon of latent criminality. Latent criminality is the part of criminality that is for some reason not registered by the law enforcement authorities. The thesis itself consists of four consecutive chapters. The first chapter deals with the concept of crime. It discusses the different approaches to concept of crime in criminology and the indicators that are used to describe it. Furthermore, this chapter is dedicated to the division of crime into latent and registered crime and the sources of information about registered crime. In particular, it focuses on official crime statistics. In the second chapter, the issue of latent crime is discussed in more detail. It defines the concept of latency, in which cases it is considered being latent criminality and what its types are. Furthermore, the ratio of latent and registered crime, the rate and extent of latency are described. At the end the possible causes of its existence are presented, one of the main reasons being the failure to report the crime by its victims. Violation of Authors' Rights Using Cyberspace Abstract This diploma thesis describes violation of authors' rights in cyberspace, especially the most common ways of committing this crime. The thesis is divided into five parts. The first chapter contains a general introduction to the topic, it defines the basic concepts (such as computer and related terms of hardware and software, internet, cyberspace and cybercrime), which serve as a basis for other parts of the work. The second chapter deals with copyright as such. It explains the concept of copyright work and describes the individual rights of the author. Given the nature of this criminal activity, it is not possible to limit the interpretation to the criminal law regulation. The second chapter thus indicates what rights of the author are affected, which works are subject to copyright infringement, which works are excluded from copyright protection and, finally, what are the limitations and exceptions to copyright. The third part is followed by a brief overview of the legislation that can be applied to the area of copyright (or generally to cybercrime). Thesis title, keywords and resume Thesis title: Criminal aspects of cyberbullying Key words: cybercrime, cyberbullying, criminal law This master thesis deals with the definition of key criminal aspects of criminal offenses referred to as cyberbullying. The master thesis is divided into five separate chapters. The first chapter deals with the general definition of cyberbullying as a new phenomenon and its comparison with the traditional form of bullying, defines other key terms and defines the victim and perpetrators of this behavior, including these types and typology. The second chapter introduces cyberstalking, which is compared to stalking, following the example of the first chapter, again defines and defines the basic concepts that are characteristic of this issue, as well as the perpetrator and victim, considering their patterns of behavior, typology, and motives, which lead the aggressor to commit an infringement. The main aim of this thesis is to find out which attacks on information systems pose a threat to the state and whether new technological trends represent a challenge for the current Czech legislation in the field of criminal law. The methodology varies across this thesis. The analytical method together with the synthesis is used to fulfil the aim. In some parts, an empirical approach is used. The introductory part of the thesis explains the key institutes in the field of cybercrime and international instruments for combating cybercrime. The most important document is the Council of Europe Convention on Cybercrime. The main part of the thesis is devoted to the difficulties of current Czech legislation in connection with cyberattacks. Criminal law aspects of data electronization in healthcare Abstract Continuous spread of information and communication technologies into all aspects of everyday life goes hand in hand with importance of data and information. This trend can be also observed in the healthcare sector which has recently experienced massive electronization. However, along with electronization, respective criminal law aspects are developing as well. Relevancy of this issue can be clearly demonstrated on the recent cyber-attacks on healthcare providers, which seriously jeopardize valuable data in healthcare. Legal Aspects of Fighting Cybercrime

The thesis deals with the topic of computer crime. Foremost, it demonstrates on an example of the operation of a medical image information processing system some selected aspects of this issue. It shows that it is always necessary to monitor the current state of the technical knowledge at the time, but also the need of addressing the issue within the corresponding legal limits. The thesis presents criminal law reality as a complex system. The links between different parts of the system are examined, and possible shortcomings are considered. The legal instruments and legal limits of the procedures that can be used against cybercrime are evaluated. The thesis focuses especially on the issue of obtaining evidence under the Czech Criminal Procedure Code. It presents a proposal on how to understand individual procedural legal institutes and for what purposes and how to use them. Consequently it suggests legal procedures for specific selected practical situations.

It is based mostly on the study of documents and scientific literature and analyzing of statistical data. The predominantly criminological perspective sets out the specifics of cyberspace and mentions some of its technological, sociological, psychological and at last but not least legal aspects. Furthermore, the thesis demonstrates the use of cyberspace by young people and the risks that users face. Criminological and criminal law aspects of the ransomware spread Abstract This diploma thesis examines different aspects of criminology and criminal law with the issue of the malware spread in the form of ransomware. This text is divided into two main parts. First, the theoretical part consists of the chapters about cybercrime, malware and criminological and criminal law aspects of ransomware spread. It uses the substantive law and also procedural law perspective. All chapters are divided into subchapters dealing with the questions of offenders and victims, criminal law qualification of the ransomware phenomena and with related concepts used for the broader understanding of this kind of cybercrime. Second, the analytical part follows. This thesis combines different criminological research methods and tries to verify the main hypothesis regarding the increase in the number of ransomware attacks in the Czech Republic. The hypothesis is as follows: "The number of ransomware attacks registered by the Police of the Czech Republic has been increasing since 2016". This thesis is focused on cybercrime, acquisition of evidence and development of a platform for retrieval, analysis and archiving web site data. The goal is to satisfy the investigators and security experts of the Czech police. The aim is to provide an open source platform that will be freely disseminable and in compliance with the requirements of legal institutions. The output of the thesis is two platform versions - full-fledged, fulfilling all the requirements set out in the diploma thesis and a light version for the police investigators of the Czech Republic.
