Historical development of legislation dealing with creation and extinguishment of residential lease and protection of residential tenants in the territory of the Czech Republic

This thesis is devoted to the description of modifications and termination of tenancy in the Czech Republic so that this presents for each time period, the development of civil rights in this country. The thesis begins with the adjustment after the Czechoslovak Republic, the Austrian Civil Code No. 964/1811 Coll., as described here by special treatment of the tenancy if enacted laws to protect tenants. Then goes on to describe the thesis of Act No. 141/1950 Coll. Civil Code and special laws on the treatment management of flats No. 138/1948 Coll. and 67/1956 Coll., which deals with treatment of extensive state intervention in the form of decisions of local governments of the creation and termination of lease to occupy the flat. Followed by a period in the original wording of the Act No. 40/1964 Coll. Civil Code and Tenancy be replaced right to use the apartment became the role of local governments of the origin and termination of the relationship. Residential Lease

The dissertation is focused on the analysis of the institute of residential lease. At the beginning a brief historical progress of the legal regulations of the lease of the apartment is described with the reference to social circumstances which influenced it. Subsequently, attention is paid to the lease agreement as the legal reason for using an apartment. The dissertation deals also with the object of the lease agreement, i.e. with the apartment and its definition in the legal regulations, and also with the subjects of the lease agreement, i.e. with the landlord and the tenant. In the next part the dissertation describes rights and obligations of the contracting parties. A special chapter is dedicated to the rent, as one of the essential requirements of the lease agreement. Also the institutes of the subtenancy, passage of the lease of flat and exchange of the apartments are mentioned. Furthermore, the issue of the termination of the lease is elaborated in detail. The whole dissertation contains also important rulings of the courts and presents changes that will come into effect with new civil code.

This thesis deals with termination of flat lease. The main aim of this thesis was to focus on particular ways by which lease of flat terminates. Significant part of the thesis is devoted to termination of flat lease by notice, which is relatively in detail defined on Act. No. 40/1964 Col., the Civil Code. The Supreme court's decisions are published in the thesis very often, because these decisions take irretrievable place in the field of termination of flat lease. The thesis contains also short discourse about several questions concerning termination of flat lease.
Termination of the lease of a flat

The aim of the thesis is to analyse different kinds of apartment lease termination. The reason for choosing this subject was common occurrence of this institute in a real life. In my opinion this thesis could be interesting not only for lawyers, but for the common people as well. The thesis is composed of five chapters. Chapter One is introductory and defines basic terminology used in the thesis: apartment, accessories of the apartment, apartment lease and lease contract. Chapter Two focuses on the apartment lease termination. It divides the termination in two different types - absolute and relative apartment lease termination. Chapter Three concentrates on absolute apartment lease termination. The most important kinds of absolute apartment lease termination are described there. The notice made by the lessor dominates among these kinds. The chapter Four analyzes different types of relative apartment lease termination. It deals with various changes either on the side of the leasee or the side of the lessor. The exchange of the apartment is mentioned in this chapter as well. The chapter Five looks at special kinds of apartment and consists of two parts according to these kinds - cooperative apartments and apartments for handicapped people.
