Comparation of Legislations of the Electronic Signature in the Czech Republic and in a Selected EU Country

The objective of this bachelor thesis is to compare legislations of the electronic signature in the Czech Republic and in Germany. Electronic services provided by public administration to the public in both countries and basic technical principles of the electronic signature are explained at first. The actual comparison of both legislations follows. European directive 1999/93/EC and laws in both countries are analyzed. Although both legislations are based on the directive, there are some differences between them that are important for practice. The last chapter describes the procedure of obtaining the electronic signature for ordinary individuals in both countries. Safety requirements are somewhat higher in Germany as qualified electronic signatures can only be created with the use of smart cards. In the Czech Republic, it is possible to create them just with software tools and at lower costs. Some new projects in the eGovernment should boost the usage of the electronic signature by the public in Germany. In the Czech Republic, a controversial system of electronic data boxes is being started. This system forces public authorities and legal persons to use electronic communication.
