Civil Law Aspects of Medical Research

Civil Law Aspects of Medical Research Abstract Under Czech law, medical research on humans is divided into three branches: clinical evaluation of medicinal products, evaluation of medical devices, and evaluation of new procedures not yet introduced in clinical practice. While the first two mentioned types of research are regulated in great detail, the legal regulation of the evaluation of new procedures in the Act on Specific Health Services is significantly less extensive. In addition, new methods are still routinely introduced into clinical practice outside of the formalised evaluation regime according to the aforementioned law. As a result, both health care providers and individual physicians face legal uncertainty regarding potential liability for harm arising from the implementation of new methods. This work is focused on civil liability in the subject context. In the first part of the thesis, as a normative basis for the evaluation of the legal regulation and its interpretation possibilities, we define the aim of law as preservation and strengthening of social cohesion. Jakub Deml and François Mauriac: Between God and Literature

Pro svou diplomovou práci jsem zvolila osobnosti dvou spisovatelů z období katolické literatury, Jakuba Demla a Francois Mauriaca. Nejprve představím spisovatele Jakuba Demla a podmínky, ze kterých jeho tvorba vychází. Zmíním především působení Katolické moderny a osobnost Josefa Floriana. V druhé části se věnuji Francois Mauriacovi a prostředí francouzského renouveau catholique. V těchto prvních dvou částech pracuji s tradiční metodou literární historie, která mi pomáhá dotvořit obraz doby, ve které oba autoři žili a tvořili. Tato metoda byla v padesátých letech strukturalisty považována za překonanou, ale v zásadě neztratila nic na své užitečnosti. Je jednou z mnoha a já doufám, že výběr právě této metody se ukáže jako dobrý pomocník v mé práci, přitom jsem si vědoma možnosti výběru z metod a vybírám podle kritérií, která se mi zdají podstatná. Snažím se zde o rekonstrukci fenoménu, nazývaného literární katolicismus. Tento literární fenomén má jisté přesahy do filozofie a teologie. Za stěžejní považuji třetí část své práce, ve které se dostává ke slovu metoda srovnávací. Téma, vztah Jakuba Demla a Francois Mauriaca k jejich dílu, se snažím vysvětlit pomocí konkrétních literárních témat. Mým cílem je vysvětlit čtenáři, jak specifické je téma katolické literatury, jak důležitá je jednota morálních hodnot...
Patient's rights in cross-border health care in the European Union

The subject-matter of this master thesis is cross-border healthcare in the European Union. It describes the history and development, but focuses mainly on the current legal framework represented by Regulation No 883/2004, and mainly Directive 2011/24 on the application of patients' rights in cross-border health care. The aim of the master thesis is to thoroughly analyse the current legal framework with a focus on patients' rights, to examine the impact of the Directive, to explain an issue of overlap between the Directive and Regulation, and to evaluate the transposition of the Directive in the Czech Republic. To achieve this aim, it is necessary to examine the topic with respect to the historical and political development of the European Union and to the case law of the European Court of Justice. The thesis is divided into four chapters. First of which concerns European Union competences in health law, explaining the history of incorporating health law provisions into the Treaty on the Functioning of the European Union, as it is called today. Use of living wills in intensive medicine and palliative care

Living will is a multidisciplinary, ethical-law problem. When applied a legally competent patient as a lay person orders the medical staff as professionals how to treat him or her in case of him/her not being able, temporarily or permanently, to give an informed permission with a treatment or alternatively refuse such treatment. A patient has a right to express his/her wishes concerning a future health care for him/her-self in a time when he/she is no longer capable to decide on his/her own. The living will is a particular kind of an informed consent or decline targeted towards a future event which is to an extent uncertain. The presented thesis consists of two parts which are additionally divided into three chapters. The major aim of the first part is to give a comprehensive explanation of the Living will's position in the legal system of the Czech Republic. This part also analyses the relation of the modification embedded in the the Act on Health Services and Conditions of Their Provision and the Civil Code. Wrongful birth and wrongful life actions in Czech law and international comparison

Wrongful birth and wrongful life actions are one of the current issues of civil law associated with the area of health care. Generally speaking they are actions for damages for a birth of an unwanted child brought by parents or a child itself. At the moment, there is a small number of wrongful birth cases in the Czech Republic, but more of them are to be expected in front of the Czech courts because of patient's autonomy and new methods in the human reproduction field. The topic of this thesis is very controversial due to collision legal, moral and ethical issues. Crucial question of the whole problem is whether the birth of an unwanted child (or an unwanted life) can be considered as damage. Since the explicit regulation does not usually exist, the courts' decisions play irreplaceable role nowadays. The aim of this thesis is to try to answer the question whether these actions can be brought and heard before the courts in the Czech Republic and whether damages should be awarded on this ground. The first chapter focuses on the explanation of the essence of wrongful birth and wrongful life cases and their division into the specific categories.
