Protection of personal data in the course of rendering health care SUMMARY Medical treatment is based on trust. Patients coming to the medical facility often share details about their personal lives that could potentially embarrass or dishonour them and eventually discourage them from getting medical treatment at all. That is why patients seeking medical help need to know that those to whom they confide in are willing to keep the information private and discreet. This thesis will address the protection of personal data in the healthcare area and its main purpose is to provide complex analysis of the relevant legal framework, especially in the light of the recently passed legislation. Protection of personal data in the healthcare are is governed by two pieces of legislation - The Data Protection Act and The Healthcare Act. These statutes present main instruments by which the protection of patients' information is provided. The first part of the thesis examines the general principles of the data protection as they are outlined by the Data Protection Act. It also looks at the key terms of data protection, such as personal data, sensitive data, data subjects and processing and examines the role of the Data Protection Office. Current issues of relationship between the personal right of individual and media: abstract in English The theme of this thesis is protection of personal rights of individual in mass media. This theme is, according to our opinion, current topic because there are conflicts between the personal rights of individual and the right to freedom of expression nearly every day. The purpose of the thesis is to analyse, if the attitude of the courts to the protection of these two rights is equal and if the individuals, who have disadvantageous position against the mass media, can adequately defend their rights. The thesis is composed of six chapters. Chapter one is introductory. Chapter two briefly defines the issue of personal rights of individual. The third chapter consists of four parts. Each of these parts deals with one personal right and characterises the rules which mass media have to comply with in order not to contravening the personal rights of individual. Fourth chapter describes the ways how individual can defend himself or herself against the violation of his or her personal rights. Vlastnické právo "je stejně všudypřítomné jako člověk a tvoří jednu ze základních součástí všech společností."1 Je tedy pochopitelné, že se lidé vlastnictvím zabývají již velmi dlouhou dobu. V průběhu dějin se názory na vlastnické právo vyvíjely a měnily. Je tak možné se setkat s velkým množstvím často navzájem protikladných názorů na vlastnictví. Měnilo se také hledisko, ze kterého se lidé vlastnictvím zabývali. Např. se lidé snažili zjistit, zda je vlastnické právo součástí "přirozeného" či "smluvního" řádu světa.2 Jindy se vlastnictvím zabývali např. z hlediska ekonomie. My se otázkou přirozenosti vlastnického práva zabývat nebudeme. V této práci se budeme vlastnictvím zabývat z hlediska jeho funkcí. To znamená, že se pokusíme zjistit, jakým způsobem vlastnické právo prospívá jednotlivým lidem žijícím ve společnosti. Tato problematika je velmi obsáhlá a různorodá. Není tak možné si vystačit pouze s platným právem, ale je nezbytné pojednat i o otázkách ekonomických a právně teoretických či právně filosofických. Ještě než přistoupíme k výkladu o samotných funkcích vlastnického práva, budeme se v první kapitole zabývat otázkami, které souvisí obecně s vlastnickým právem (nikoliv pouze s jeho funkcemi). Comparison of building legislation according to current and new Civil Code In my master's thesis I focus on building legislation according to the Civil Code. The building, either as a separate thing or part of other things, is mainly the subject of ownership, but also of other civil relations. Therefore it is very widely used and discussed concept. The main goal of the thesis is to describe in detail concept of building in the current Civil Code, with focus on shortcomings and the most problematic areas, and confront it with changes in the new Civil Code. The purpose is also to provide summary of building issues and possible advantages or disadvantages its enactment in the new Civil Code. I mainly concentrate on different division of things and problems with definition of the term building, which apply to specific examples. Last but not least, the thesis evaluates new building enactment and tries to point out problems that may arise in connection with the transition to the principle superficies solo cedit.
