Brokering employment according to Act of Employment Abstract This thesis is aimed at the problematics of brokering employment as an important tool of fullfilling one of the basic goals of employment policy which is reducing unemployment. Except historical definition and development of labour office and employment agency this thesis also focuses on those entities which are active in this field in the Czech Republic and which try to respond to the current demand in labour market. The aim of the thesis was to identify brokering employment as an important tool within the employment policy, all on the basis of the current legal regulation, and to analyze forms of brokering employment emphasizing each individual essence of each form of brokering employment.The thesis defines the position of each of the stakeholders providing basic relevant data showing the most important indicators in the field of brokering employment both at the labour office and at the employment agency. Ways of Termination of Employment in Czech Republic and in Peru

118 Abstract The aim of this rigorosum thesis was to systematically describe the ways of termination of employment from the point of view of Czech law, Peruvian law and selected institutes and to compare each other. The presented work can be divided into three parts - the first part describing the Czech legislation on termination of employment, the second part examining Peruvian law and the last part containing their mutual comparison, highlighting areas of possible inspiration. The first chapter is devoted to general labour law in the Czech Republic, it describes its concept, principles and functions, the specifics of labour law and its placement in the system of Czech legal order. The second chapter describes the employment relationship, its elements and its origin. The third chapter describes all forms of termination of employment, both by legal action and by legal event. The emphasis is put on termination of employment by the employer, as this is the most problematic way of terminating the employment with the most comprehensive legal regulation. Vocational Development of Employees Abstract The purpose of my rigorous thesis is to analyse not only general issues of legal regulation of vocational development of employees, but also the issues relating to special regulation concerning some specific categories of employees or tax impacts, due to reach a complexity of this analysis. This thesis consists of ten chapters, each of them dealing with different aspects of vocational development of employees, especially questions relating to improvement of qualification, upgrading of qualification and qualification agreement. Opening part serves as an introductory part defining the reason for my research, the goals of this paper and representing its structure. Chapter One characterises the care of human resources in the view of constitutional-law and labour-law regulation. The chapter is subdivided into three parts based on approach to extent of the term "the care of employees" - narrower concept, broader concept and historical concept. - Working hours, their duration and work schedule This thesis introduces an overview of the current regulation of working hours and related institutes. It is focused on the particular options how to regulate working hours duration and working hours schedule, as well as on legal limits and restrictions. Working hours are crucial not merely for employers, but also for employees. For employees working hours also determine their leisure time. Therefore, this thesis is focused also on work-life balance with suitable work hours schedule. The thesis is divided into four parts. The first part outlines the most important historical development of working hours regulation from medieval rules to the current regulation and its position in the current legal order, which is essential to correct grasp of subsequent parts. In the second, principal part of the thesis, are analysed particular concepts of working hours regulation, there is also an overview of related judicature which defines working hours, working hours duration and possibilities of scheduling. Illegal work and its persecution

The topic of this diploma thesis is the illegal work and its persecution, whereas the main goal is to point out and analyze the most important institutes relating to the illegal work, to identify the relevant legislation and to point out problematic issues of the regulation and its application. The text is systematically divided into three main chapters, in particular the field of dependent work, illegal work and finally the sanctioning of illegal work. The introductory chapter of this thesis deals with dependent work, the definition of which is a necessary condition for further interpretation of illegal work and its persecution. After a brief introduction to the legislative history and the legal definition of this term, the particular characteristics of the legal definition and, subsequently, the conditions of performance of dependent work are discussed. Further, the case law of the Supreme Administrative Court and the related additional characteristics of the dependent work which the court has defined beyond the legal definition are mentioned. Pension security of miners in the Czech Republic

This thesis deals with the analysis of the pension security of miners in the Czech Republic from its historical beginnings to the present day, with the main focus on the legislation de lege lata. The selected range of employees in mining industry is in Czech law of pension insurance in comparison with other insured persons favoured in determination of retirement age and the determination of amount of the old-age pension. These benefits are limited for the time being; however, currently the preferences are enforced to be listed in the public pension system permanently. The main focus of work is therefore an analysis of the legislation relating to the entitlement of miners to an old-age pension, taking into account the specific retirement age and the determination of the amount of this pension. The work also touches other pension benefits paid out of the Czech pension system, i.e. disabled pension and survivors' pensions. Mentioned are also some of the claims arising from compensation legislation and the selected topics of international legal issues that may have an effect on the performance of paid to the miners from the Czech pension system (particularly the top-up allowance).
Employee care in the Czech Republic and Slovakia

The theme of this thesis is employee care in the Czech Republic and Slovakia. Working conditions of employees are essential for their efficiency. Because of that, a proper setting of employee care is a crucial task for employers, moreover considering the current difficult situation in the labor market. The aim of the thesis is to inform readers about the concept of employee care, and to introduce them to the basic legislation in the Czech Republic and Slovakia. The content is divided into six chapters. The first chapter is focused on analyses of the term employee care. It can be rather difficult to define this term, thus I offer wider variety of possible views on the issue. I also include a part about a classification of the employee care into categories. The second chapter of the thesis offers a historical excursion into the issue of employee care. This covers the period starting in the 14th century and leading up to the present days. In the first part of the chapter, I consider employee care in its broader sense. As the time went and the concept of employee care developed, I focus on narrower sense of the term, as is being used in these days. Protection of Employees in the Event of the Insolvency of their Employer from the Perspective of the EU Law

The objective of this thesis, entitled "Protection of Employees in the Event of the Insolvency of their Employer from the Perspective of the EU Law" is to analyse European legislation in the field of protection of workers with regard to selected aspects and specifics of Czech national regulations. One of the main reasons for the adoption of national Act No. 118/2000 Coll. was the transposition of the Directive 2008/94/EC, which represents European legislation in this area. While protection of employees in the event of the insolvency of their employer was adopted at the community level in the early eighties, in the Czech Republic, the Act No. 118/2000 Coll. entered into force on the 1st July 2000. The thesis also deals with the broader context of the EU law, case law of the Court of Justice of the European Union, and selected legislation on the field of protection of employees in the event of the insolvency of their employer in certain Member States of the EU. The aim of this thesis also lies in description of not only the European legal framework, but also in an analysis of the area of protection of employees in the of employer's insolvency, which may have not been adequately transposed at all or has been transposed too widely. Redundancy payment and other forms of compensation in labour-law relations

In this Master's thesis there is discussed the subject of redundancy payment and other forms of compensation in labour-law relations. In individual chapters there are described different types of compensation, which the current labour law knows and at the same time there are mentioned even compensations for which employees shall have the right according to the previous legislation. Only marginally there are mentioned compensation provided within the civil service. The Master's thesis is divide into seven chapters. In the first chapter there is performed the systematic classification of compensations, which corresponds with the content of this thesis. Second chapter is focused on the general matters connected with severance payment such as the origin of claim for redundancy payment, difference between contractual and statutory redundancy payment, paying of redundancy payment or return of redundancy payment. The diploma thesis "Employment of foreigners" deals with the topic of legislation and proceedings concerning employment of foreigners in the Czech Republic. In the first place it is aimed at employment of foreigners that do not have nationality of European Union member states, member states of European Economic Area and Switzerland, but it also deals with employment of nationals of European Union member states. Different rules for access to labour market are set up for these two distinct groups of foreigners while for nationals of European Union member states the access is significantly easier. This diploma thesis is structured into six chapters. Chapter One deals with sources of law that are relevant for given topic - both on domestic and on international level. Chapter Two contains definitions of basic concepts that are essential for this thesis. These are concepts of foreigner, employment, subjects of employment relationship, family member of national of EU member state and illegal work. Chapter Three is aimed at particular types of residence of foreigners in the Czech Republic. Foreigners can use several different types of residence permits that allow them to stay in the country.
