Legal regulation of air quality protection

This thesis deals with the issues associated with the legal regulation of air quality protection. The main objective is to describe, analyse and evaluate the condition of the current legal regulation which is mainly represented by the Act no. 201/2012 Coll., on the protection of air. The introductory part of the thesis focuses on the historical development of the legal regulation, its primary milestones, as well as legal regulation according to International and European Law and its impact on the internal national legislation. Furthermore, the thesis also focuses on the currently valid legal regulation and its components and clarifies its basic terminology. The largest portion of the thesis focuses on the legal regulation of the individual instruments regulated primarily by the Act no. 201/2012 Coll., on the protection of air, with the primary focus being the stationary sources of pollution. These instruments are sorted into traditional groups, each respectively representing conceptual, administrative-legal and economic instruments. The chapter on conceptual instruments primarily focuses on the two fundamental instrumental programs, that is a) - The National Emission Reduction Program of the Czech Republic, and b) - programs aimed at improving air quality and their importance in legal regulation....

The landscape planning and the protection of natural components of environment in the Czech law Abstract This rigorous thesis deals with the legal regulation of the landscape planning and the protection of natural components of environment in the Czech legal system. The rigorous thesis further extends the author's diploma thesis called "The creation of landscape in the law". These terms - creation of landscape and landscape planning - are closely linked to each other. The author decided to deepen the topic of the landscape planning as this topic was unable to cover completely in the scope of the diploma thesis. This rigorous thesis supplements the diploma thesis, extends the topic further and describes it in more detail. Yet, the topic as a whole is still not completely covered by this rigorous thesis. The aim of this rigorous thesis is to analyse the legal regulation of the landscape planning and the protection of natural components of environment in the Czech legal system. THE TITLE OF THE DIPLOMA THESIS AND ABSTRACT TITLE: The Legislation Governing Energy Efficiency in the European Union ABSTRACT: The European Union's energy policy has undergone a major transformation over the last few years. The interest in ensuring sustainability, self-sufficiency, competitiveness and secure energy supplies leads to deeper energy integration among Member States. High energy efficiency is an ideal tool for achieving these particular objectives because its basic principle is to provide more services while using the same or even less energy. As a result, a variety of conceptual instruments and relevant legislation have been revised over the last few years, which was accompanied by a conflict of interest between various stakeholders and the adoption of less than ideal compromise solutions. This diploma thesis aims to evaluate the current legislation on energy efficiency in the European Union, including its development. 1 The Czech Environmental Inspectorate Abstract This Master's thesis describes and analyses the Czech Environmental Inspectorate, a specialized supervisory authority that oversees compliance with legal regulations and administrative decisions rendered by the public administrative authorities in the area of the protection of the environment. The partial aim of this thesis is to introduce the Czech Environmental Inspectorate and to highlight its irreplaceable role at environmental protection in the Czech Republic. The main aim of this thesis is to describe and analyze the supervision activity of this authority and its follow-up measures, which are assigned to this authority by the legal regulation, and to highlight the changes brought by two fundamental legislative changes, namely the adoption of Act No. 255/2012 Coll., on administrative control (Control Code) and Act No. 250/2016 Coll., on administrative offenses, that influenced this authority. Legal regulation of air protection against air pollution from unlisted sources

The diploma thesis deals with the issue of legal regulation of air protection against air pollution from unlisted sources. Unlisted sources are a group of stationary sources, that are not listed in Annex 2 of Act No. 201/2012 Coll., On air protection. It is a diverse group of minor sources of air pollution, which are generally subject to softer regulation than the sources listed. On one hand, unlisted sources are less polluting than listed sources, but on the other hand, their number is much higher. In total, they are even the largest polluters in terms of emissions of some substances. Unlisted sources can be divided into combustion and non-combustion sources. With regards to their frequency, the subject of the paper is mainly unlisted combustion sources. A typical example of such unlisted source is a solid fuel boiler designed to heat a building. The first part of the thesis focuses on air protection in general and its subject is also an explanation of how the sources of air pollution are divided. In the second part, the system of instruments of regulation of unlisted sources is described. Construction entitlement and construction permit

This diploma thesis is focused on legal aspects of a private and public construction law from builder's perspective with a special emphasis on several current issues of Czech legislation and jurisprudence. As its name suggests this thesis is divided into two parts which corresponds to construction entitlement and construction permit. The first part of the thesis is comparison of terms land and building within different legal regulations. These two terms are highly important because they represent a normative basis for the issue. Subsequently, the most frequent private- law titles, entitling the construction of a building, together with the institutions of usucaption and the problem of unauthorized construction, which are very closely related to these titles, are analyzed. The core of this thesis is the second part, dealing with spatial planning, planning proceeding and construction permitting. These partial problems are analyzed in a timeline as they naturally follow from one viewpoint of the builder. While less emphasis is placed on spatial planning and construction permits, a deeper analysis is devoted to the planning proceeding. Czech Energy Law in the Context of Environmental Protection

The dissertation deals with legal regulation of energy in the Czech Republic in the context of environmental protection. Power is the broadly conceived by the author because it includes not only the stage of obtaining energy resources, production, and the distribution of energy, but also the activities related to energy conservation and dealing with energy waste. For these individual phases, the author introduces the concept of the energy chain which is understood as a set of interrelated developmental stages of energy. Energy law is defined by the author as a law that regulates people's behavior towards usable energy at all stages of the energy chain. Endangerment and damage to the environment may occur (and often does occur) at each stage of the energy chain. This work emphasizes the principles and instruments of environmental protection which can effectively fulfill their function in energy legislation. The aim of the work is to find and understand the context of principles and instruments of environmental protection in the Czech energy law. A new generation of solar instruments provides improved spectral, spatial, and temporal resolution, thus facilitating a better understanding of dynamic processes on the Sun. High-resolution observations often reveal multiple-component spectral line profiles, which provides information about the chromospheric velocity and magnetic fine structure. We observed an emerging flux region, including two small pores and an arch filament system, on 2015 April 17 with the "very fast spectroscopic mode" of the GREGOR Infrared Spectrograph (GRIS) situated at the 1.5-meter GREGOR solar telescope at Observatorio del Teide, Tenerife, Spain. We discuss this method of obtaining fast (one per minute) spectral scans of the solar surface and its potential to follow dynamic processes on the Sun. We demonstrate the performance of the "very fast spectroscopic mode" by tracking chromospheric high-velocity features in the arch filament system.

Source Administrative Acts in Proceedings Relating to the Environment

1 Abstract This diploma thesis deals with source administrative acts, which serve as a means of protection of the relevant area of the environment. The term "source administrative act" as used herein denotes various types of acts issued by administrative bodies which are then used as the ground for the final decision in administrative proceedings. The thesis does not focus only on binding source administrative acts, but also on other source acts of lower legal force. The thesis includes a section on the special legal regulation of source acts used in administrative sanctions proceedings. The main source materials for the thesis are the following: legal regulation of this issue currently in force, literature, methodologies of administrative authorities, decisions of administrative courts and the author's own professional experience. The beginning of the work includes the contents and a list of abbreviations. The third chapter contains an introduction where the author presents the reason for choosing the topic of the work, i.e. the frequent use of source administrative acts in the environmental field of public administration and their influence on administrative proceedings. Legal regulation of territorial protection of water in terms of quantity

The thesis deals with the legal regulation of territorial protection of water in terms of quantity, which is contained in the Water Act. I am only focusing on the Protected Areas of Natural Water Accumulation and Surface Water Accumulation Protected Areas as they have significant potential to reduce the effects of drought. Both areas are viewed through common problem, which is the point of view of the amount of water. The legal regulation of the territorial protection of waters in terms of quantity is discussed in connection with other laws. The aim of this work is to answer the question whether the legal regulation of territorial protection of waters in terms of quantity in the Water Act is sufficient to enable the Czech Republic to adapt adequately to the ongoing climate change, that ultimately causes the loss of water. The first part of the thesis deals with sources of legal regulation of territorial protection of water in terms of quantity, further includes the systematics of the Water Act and the Strategy on Adaptation to Climate Change in the Czech Republic (Adaptation Strategy of the Czech Republic).
