Criminalistic Study of Crime Victims (Criminalistic Victimology)

The aim of this thesis is to briefly introduce criminalistic victimology and characterise victim of a crime. Text is composed of six chapters, concerning different aspects of the topic. First two deal with the science of criminalistic victimology. Following two examine role of victim during criminal investigation according to criminalistic victimology. Last two chapters reflect position of victim in contemporary czech criminal law. The first chapter defines basic terminology used in criminalistic victimology, different to terms of criminal law. The second chapter documents origins and evolution of criminalistic victimology and its place among related disciplines. The third chapter is focused on the object of criminalistic victimology, i.e. victim's role in criminal investigation. It is further divided in nine parts examining relation of victim and offender, victim's role in genesis of criminal situation, victim as originator and carrier of forensic evidence, significance of victim for criminal investigation, victim as crime reporter and witness with focus on question of credibility, participation of victim during other investigative measures and finally expert examination of victim. Methods of Investigation of Robbery

1 Summary The presented thesis deals with methods of investigation of robberies. It comprises all essential parts of such methodology and therefore aims to provide a complex view on the subject. Moreover, the work offers a deeper insight into some particular methods of investigation and emphasizes psychological aspects of investigation as well as of crime prevention. Comparison with foreign author's view on the subject is also included. The work consists of ten chapters dedicated to separate components of investigation. Chapter one presents the subject of investigation - robbery, its place in Czech law and legal definition set out by the Criminal Code. Chapter two provides criminalistic description of a robbery from different points of view and includes a relatively large part concentrating on foreign literature and robbery categories presented therein. Chapter three lists typical evidence which can be found on the crime scene and points out psychological aspects of formation of witness's memories of the crime. The diploma thesis deals with methodology for investigating the crime of robbery, which has been one of the most serious crimes. With regard to that this topic is very extensive, thesis includes only selected areas and facts that are related to the topic. Investigation of the crime of robbery has against other crimes its specifics. Describe precisely this specificity is the aim of this work. The work is divided into eight interpenetrating chapters. The introductory chapter deals with criminal characteristics of robbery, while out of definition of legal legislation the crime of robbery, is also briefly described the development, which the legislation of this crime in our country has gone through. The second chapter is devoted to criminological characteristics of robbery. Cizojazyčné resumé The theme of this diploma thesis is the methodology of the investigation of sexual crimes and its selected issues. Given the large of this topic, I decided to focus only on methods of rape investigation, as a typical represenstative of this group of sexual crimes. The main objective is to identify the problems in the procedure of understanding and investigation. It focuses on the selected specifics which I attent to analyze and evaluate the current legal regulations. To clarify such a large topic, the thesis is divided into seven chapters. The introductory chapter deals with the current legislation of the rape and its historical evolution since the feudal period. This charter compares the Czech legal systém with foreign legal systems. The second chapter provides the statistical data and the typical criminalistics ways of committing this crime which is divided according to committting by adults and committing against children and adolescents. The behavioral analysis and serial, mass and sexual murders

My diploma thesis deals with the behavioural analysis and perpetrators of serial, mass and sexually motivated murders issue. The behavioural analysis is built upon bases of different methods of criminal profiles formation - psychological profiling. Following the historical outset of the criminal profile, the method of the behavioural analysis and its particular components are introduced and discussed. The components are described through optic of the most commonly used typologies, e.g. perpetrators typologies, scenes of delict, victims and murders. Hereafter I pursue issue of criminal profiling utilization in practise, particularly perpetrator profile creation, crime linking and threat assessment. The last part dedicated to the behavioural analysis consists of behavioural analysis historical development in the Czech Republic and reflection of potential future development of this issue. Resumé This thesis titled The Scope of the Prosecutor in the Preliminary Criminal Proceedings presents a compact view on the prosecutor's role and activities in the preliminary proceedings. At this stage, the prosecutor has a vital role and is regarded as the master of the preliminary proceedings (dominus litis), for he carries the ultimate responsibility for its results. In the court proceedings, where he is accorded the party status, the prosecutor represents the public prosecution. In relation to the police authorities, the prosecutor has a number of privileges that enable him to supervise the adherence of legality in the preliminary proceedings. The work is divided into four main chapters. The first chapter discusses the legal base of prosecution as a body of public prosecution in the criminal proceedings. This chapter also characterizes the institute of external and internal supervision within the system of prosecution. The second chapter defines the preliminary proceedings as an obligatory, pre-trial part of every criminal proceeding. Specificity of interrogation of children

The aim of the thesis was to describe the main differencies between an interrogation of adults and children. The thesis is composed of six chapters, an introduction and a conclusion. The first chapter is focused on concept "a child" in the Czech legal order and International agreements. The next chapter describes specifics and problems of individual evolutionary periods of children. The third chapter explains the interrogation in a general meaning. The interrogation is included and modified in more statutes. I focused on provisions of a statute relating the interrogation in Czech law, especially in criminal law. Next part of this chapter deals with the interrogation and a criminalistics. How to prepare for the interrogation, the stages of the interrogation and tactics of its implementation. I also mentioned the forensic psychology which helps and supplements the criminalistics with its own methods and findings. Because the topic is too broad I've decided to focus only on selected issues of methods of investigation of child sexual abuse. Investigation of child sexual abuse is very specific in comparison to other sexual crimes. During the investigation the child victim must be handled very sensitively in order to avoid secondary victimization. The purpose of this thesis is to describe the specifics of investigation of child sexual abuse and other problems connected with it. The thesis is divided into six chapters. The first chapter is dedicated to historical and current legal regulations of child sexual abuse. At the same time it describes occurrence of this crime in the area of the Czech Republic. The second chapter provides criminalistics characteristic of child sexual abuse. The chapter consists of three parts. The first one is dedicated to the typical ways of committing this crime with focus on cybergrooming. Forensic Handwriting Examination The aim of this thesis is to introduce the Forensic handwriting examination as one of the disciplines of Forensic identification, to describe its methods and procedures, and to demonstrate them on specific examples. The aim of the practical part of the thesis is to apply the findings described in the theoretical part of the thesis to the handwriting examination carried out by the author of the thesis, to experimentally verify some of hypotheses presented in the thesis, such as the influence of various factors on the handwriting of an individual, and to examine the most frequent methods of deliberate alteration of one's handwriting. The first chapter of the thesis is focused on the definition of the term "Handwriting Examination", on a brief examination of the history of this branch of forensic science, and on the analysis of its relations to other fields of forensic science, especially to the graphology. - Crime of murder and killing under Section 140, Section 141 of the Czech Criminal Code The target of my thesis is primarily a closer analysis of the legal characteristics of subject matters of crimes of murder and killing under § 140 and 141 of the Criminal Code, based on the grounds of the available literature and case law. The first chapter outlines the history and conception of intentional killing on the Czech territory, including their punishment, since the primitive culture society until the adoption of the Law no. 40/2009 Coll. (Criminal Code). The second chapter is devoted to a brief definition of a new system of the problematics of crimes against life and health in the new Criminal Code, including various forms of intentional killing, and is designed as a general introduction for further explanation. In the next chapter, we discuss human life as an object of crime, with a focus on clarifying the issue of its beginning and end, because it is necessary to define the period in which human life is protected by the criminal law.
