European Economic Interest Grouping

The theme of this bachelor thesis concerns European Economic Interest Grouping (EEIG). The theoretical part deals with main aspects of grouping which are legal regulations, termination and dissolution of a grouping. The practical part of this bachelor thesis demonstrates the confrontation of European Economic Interest Grouping with G.I.E. (Groupement d'intéret économique), which is comparable with Economic Interest Grouping in French business law. This grouping was a model for EEIG. Furthermore the thesis deals with statistics of EEIG in member states of European Union. The biggest attention is paid to EEIG in Czech Republic. In the conclusion the thesis is briefly summarized. Then the position of EEIG regarding other international forms of business in European Union is evaluated.
judicial cooperation in civil and commercial matters

The Bachelor thesis deals with judicial cooperation in civil and commercial matters. The thesis is composed of 5 chapters. In the first chapter is the judicial cooperation described as the component of European private international law. The second chapter gives to the judicial cooperation the legislative basis in the primary law. The third and fourth chapter contains the legislation of judicial cooperation - Brussels convetion and so called Regulation Brussels I. The fifth chapter analyzes the dispute between ČEZ, a.s. and Horní Rakousy (Upper Austria).
Licensed Trades in the Czech Republic

This work deals with the definition of licenced trades in the Czech Republic. It defines what activities are licenced trades and what they are not. The publication describes the conditions that must be fulfilled in order to become a sole trader. It describes the rights and obligations of the inspection stuff and controlled persons, shows the process of licenced trade control. In conclusion, the work focuses on the issue of prostitution as an activity requiring legislative modification, explains the pros and cons of regulating prostitution and raises examples of how is the problem of prostitution solved by other countries.
EU External Trade Policy

This thesis provides economic and legal view of the external trade of the European Union. The first part shows the position of EU in world trade in goods and services, territorial and commodity structure and differences between Member States. The second section provides the basis for European trade policy, its principles and links to the multilateral rules of GATT and WTO. The final part of the paper deals with autonomous and the conventional instruments of commercial policy.
European Company

The main aim of European economic integration is to reach the common market of goods, services, persons and capital. To make this aim easier to realize in terms of free movement of capital, European Commission has created the statute of the European company (Societas Europaea, SE) as a new institute and corporate vehicle on the supranational level. The paper offers information about creation of the European company according to Comunitary and Czech national law and its corporate structure and mentions several concrete cases of company creation or transformation. The end of the study is dedicated to an analysis of the current usage of European company and advantages and disadvantages of this legal form of trading company together with a summary of current experience with the existence of European company and with the possible future of transnational companies within European Union.
Prohibition of Abuse of Law in the European Law

The thesis represents an introduction into the concept of abuse of law principle as it is applied within the European Law. As an introduction it features a short history of the abuse of law as of private law principle and its theoretical aspects. Further it provides the reader with exposures of the doctrine in the Czech law and draws attention to the problems which the Czech courts face applying the doctrine, especially with its distinction from other similar legal institutions. The core of the work is constituted by an analysis of relevant decisions of the Court of Justice of the European Union, which follows the development of the doctrine from the early 70's until present. The thesis analyses the doctrine of abuse of law as it was developed in the European judicature. Finally the author introduces practical consequences of the doctrine on the tax law and deals with the question how the courts of highest instance of the Czech Republic cope with the doctrine and criticizes their approach.
Les obstacles de la libre circulation des travailleurs dans la juridiction de la Cour européenne

Diplomová práce pojednává o překážkách voného pohybu pracovníků v judikatuře ESD. Nejprve se teoreticky věnuje právní úpravě této problematiky a přináší určitou typologii překážek volného pohybu pracovníků. Zvláštní pozornost je věnována překážkám vyplývajícím ze vzájemného uznávání diplomů a kvalifikací. Ve druhé části jsou uvedeny a okomentovány vybrané rozsudky Evropského soudního dvora dotýkající se dané tematiky.
Legislation and the institutions of the European Union in the Treaty of Lisbon

Reform of the institutional structure of the European Union contained in the Treaty of Lisbon is in the context of the ongoing ratification of the contract in a very current topic. Bachelor thesis focuses on the comparison of the legislation of the EU institutions contained in the EC Treaty and EU Treaty, on the one hand and the new institutional structures contained in the Treaty of Lisbon, on the other. There is also compared the original text of the Treaty establishing a Constitution for Europe with the final wording of the Treaty of Lisbon. Further deals question whether the reform of the EU institutional structure contained in the Treaty of Lisbon as ambitious as the previous changes to the legislation of the EU institutions.
Institutional Reforms of the European Union

This thesis focuses on the Institutional Reforms of the European Union. At first the creation and progression and also the competences and functions of the institutions are described. The described institutions are the following: The European Commision, The Council of the European Union, The European Council, The European Court of Justice and the European Parliment. Further follows the enumeration of the most important reforms, which are brought by the Treaty of Lisbon. The main accent is set on the changes, which concern the enumerated instituions and their competences.
Restrictions of the free movement of workers on the basis of judgments of the Court of Justice

Freedom of movement of workers constitutes right of citizens of the Union to move and reside freely within the territory of Member States for the purpose of employment. But this right is not an absolute one. Bachelor thesis focuses on restrictions which arise out of EC Treaty, such as limitations justified on grounds of public policy, public security and public health or employment in the public service. Other limitations arise out of the disunity of national provisions. In order to reduce such limitations the Council shall adopt provisions for the harmonisation of legislation. It is typical in the process of recognition of diplomas and qualifications. Main legal sources of the bachelor thesis are judgments of the Court of Justice.
