The Theory of "Loss of Chance" in the Field of Medical Law

The Theory of "Loss of Chance" in the Field of Medical Law Abstract This master's thesis explores an alternative approach to establishing civil liability in medical-legal relationships. Due to the disparities described in the thesis, the positions of the parties in medical-legal disputes are not equal. Therefore, the theory of "loss of chance" was developed to address this issue by introducing a new approach to proving causal connection in court. The point of the theory is to transfer the procedural deficiencies of the aforementioned disputes into the substantive realm by creating a new legally protected asset, namely, the "chance." The thesis is divided into three parts. The first part addresses the issues of medical-legal relationships and the resulting legal disputes. It explains the fundamental principles underlying the theory of "loss of chance" and highlights the differences between the conventional approach to proving causal nexus and the theory itself. The second part is devoted to the historical and foreign development of the theory. With the help of key decisions of foreign case law, the concept of theory in these foreign jurisdictions is explained, which then influences the decision-making of Czech courts in cases related to theory. French university as a zone of equal chances

This work freely follows the bachelor thesis Social predeterminations for studying in France. The content studies evolution of french educational system and experts opinions on problematics of equal chances in acces to the education. Pierre Bourdieu and Raymond Boudon reflect in their theories changes in society after 1968, student protests and crisis of universities, and ask how to solve them. Interviews with University of Avignon's students and teachers and questionnaire research brought many important ideas which helped to explore the difference of entering to two academic insitutions: university and grand école. The Price of Labour, Property Income and Social Stratification

In all societies people differ from each other on the basis of their age, sex, wealth or personal characteristics. This Bachelor thesis focuses on social stratification by income level in the Czech Republic. The aim of the thesis is to analyze the social structure of society in relation to differentiation in remuneration, respectively in labour and property income. The basis for the literature search are social and economic books and scholarly articles Czech and foreign authors. The data are collected through secondary sources in the practical part of this thesis. The result of this work is an overview of the income inequality and of the social stratification of Czech society, characteristics of different socio-economic differences and future development of these differences. These results may be useful for the government, but also for companies.
Contingency table analysis from questionnaire survey data of drivers

The bachelor thesis deals with the contingency table analysis from questionnaire survey data of drivers. The data were obtained from the agency Data Collect s.r.o., which conducted the survey in 2014. The aim of the thesis is to analyse the behaviour of drivers and their habits, which could increase the risk of accidents. The thesis is divided into two main parts; in the first one, methods of contingency table analysis are described; in the second one, the presented analyses are applied to the survey data. Firstly, the behaviour of single and young drivers is analysed, then the differences between men and women drivers. Calculations were made using the software SPSS and MS Excel, in which all the graphs and tables were made.
