Liability for damage in case of occupational injuries and occupational diseases

The intention of my thesis is to analyse legal provisions concerning occupational injuries and occupational diseases, comment amendments in this area of labour law and indicate meaning and content of above mentioned legal provisions in connection with court decisions and practical facts. The entire text is structured into chapters relating to particular topics connected with occupational injuries and diseases. At first the thesis introduces concept of liability with specifics that influence area of occupational injuries and diseases. Subsequent chapter contemplates recent events and system of legal insurance of employer's liability. Fourth chapter describes provisions implementing prevention of occupational injury and disease. Fifth chapter defines conception of occupational injury and occupational disease in detail, elaborates characteristic features, prerequisites, process of solving and possibility of employer's exemption. Sixth chapter reflects findings relevant to compensations provided to affected employee. Result of processing the topic is composed of comprehensive characterization of main terms and issues, with effort to indicate explanation of respective judgements and consider selected legal provisions.
The prevention of pathological occurence of burnout syndrome (an example of employer)

This bachelor thesis deals with the issue of burnout syndrome which is currently a very discuss frequent problem. The rate of working stress will be investigated in selected groups of staff in company COOP družstvo HB. The purpose of my thesis is to compare which group of staff is threatened by burnout syndrome the most. The work is focused on the economical aspects which are reflected particularly in human capital. There will be applied the quantitative research, concretely questionaire research. Based on the results of questionaire research will be applied analytical method of the job evaluation, which is one of the main issues of human resources management. This application will be also recommendation for prevention for the company.
Occupational health and safety

Work deals with the occupational health and safety from the perspective of employees. It is about general perspective in the issue. There is no selective choice of age, sex or employment. The work is separated in two parts, the theoretic part and the practical part, while the theoretic part is the base for the practical one. In the theoretic part, there is the introduction of legislation related to the occupational health and safety, history, rights and obligations of employers and employees, occupational diseases and occupational injuries and precautions which are used for the regulation of these negative situations. The practical part is based on questionnaire filled out by many respondents. The questionnaire is focused on many subareas of the occupational health and safety in the Czech Republic. The aim of this work is to uncover the main causes of occupational diseases and occupational injuries, to find out as much as possible about knowledge of employees in this area and compliance of obligations by employers and employees. At the end of this work are some suggested precautions which could minimalize the presence of occupational diseases, occupational injuries and more negative effects of this area.
Odškodňování pracovních úrazů a nemocí z povolání

This bachelor thesis considers system of compensating of occupational injuries and occupational illnesses which belongs to the area of labor law. It describes responsibility of the employer for damage arising from occupational injuries and occupational illnesses and compares reimbursements for health damages according to labor code and law on professional soldiers. The work contains a model example of a occupational injury on which a calculation of health damage reimbursement was implemented according to the law on professional soldiers. The ending is dedicated to a discussion where are described differences between both laws in the area of reimbursement of occupational injuries and occupa-tional illnesses.
Epidemiological situation of scabies incidence in the Czech Republic within period 2003 - 2012

Theoretical part of dissertation was written on the basis of studying professional literature. It provides overview of Scabies disease, its epidemiological incidence, transmission, clinical course, diagnostics and also of its treatment. Practical part was formed retrospectively by qualitative research and secondary data analysis. These data were collected from different publications from the State Health Institute in Prague and the Health Information and Statistics Institute in the Czech Republic. The main aim of this dissertation was analyzing the trend of scabies incidence in the Czech Republic within ten years period (2003 2012). Moreover the practical part of this dissertation contains information related to trends of scabies incidence in individual districts of the Czech Republic depending on age, sex, team, seasonal index, or epidemiological scabies incidence as occupational disease. Linear regression was used to assess the incidence trend. Subsequently correlations were ascertained by using method of correlation coefficient calculation. In the research it was found that registered scabies incidence seems to more likely be decreasing from the beginning of followed period (i.e. from the beginning of 2003). According to the seasonal index the most common incidence of this disease within followed period was in October. On the other hand the lowest scabies incidence was in June. The highest sickness rate was recorded in the district Ústí nad Labem with almost 50 cases per 100 000 inhabitants. Scabies as occupational disease belongs to the most common recorded transmissible and parasitic disease in the Czech Republic, mainly at nurses in the hospitals, attendants in retirement homes, in internal wards and in social care institutes. The highest incidence rate was notified in age categories from 5 to 9 years. There exists strong positive linear correlation between scabies incidence and age. Epidemiological scabies incidence in the Czech Republic had two main peaks during period 1965 2012, in 1970 and 1993.
Liability for work injuries and occupational diseases

The objective of the thesis is to analyze the concept of the liability of employer for work injuries and occupational diseases in the Czech Republic. At first, the nature of the basic terms (work injury, ossupational disease, liability for damage) is described. Afterwards, these terms are discussed further in other contexts, for example prevention and compensations of the occupational diseases and work injuries and liability insurance of the employer. In the part of the legal insurance, the thesis offers evaluation of the current legislation and describes the possible new one. The theory and practical examples are compared in the thesis. It is possible to find the real cases of the work injuries, vocational diseases and employers'methods in the text.
Occurrence of occupational disease in the South Bohemian region

When evaluating effects of work on human health it should be remembered that health is a result of mutual effects of several factors. The factors include the general environment and the working environment, genetic factors and lifestyle. Further, the evaluation of a worker´s health condition should take into account his/her exposure outside work. I have selected the topic of the thesis: ``Occurrence of occupational disease in the South Bohemian region `` because I find occupational hygiene the most interesting sphere in the hygienic sector. The objective of my work was to map occupational diseases in the South Bohemian region and to determine the situation in occupational diseases in a selected period. The selected period was 2004 {--} 2008. At the beginning of the thesis I set two hypotheses. The first hypothesis stated that the number of occupational diseases in the South Bohemian region in 2004-2008 was not statistically significantly different from the national average. To test the hypothesis I used a statistical survey using the Student t-test. The second hypothesis stated that occupational diseases occurred most frequently in persons working in the sector of health and social care and veterinary activities. In the case of the first hypothesis the results have confirmed that the number of occupational diseases in the South Bohemian region does not exceed the national average, except in 2007, when the number of occupational diseases was different from the national average. Also the second hypothesis was confirmed (except in 2008, when the number of occupational diseases in the sector of metal structure manufacturing and metal-working products was slightly higher than in the sector of health and social care and veterinary activities). This thesis seeks to evaluate the trends of occurrence of occupational diseases, which may be used for development of preventive measures in this field, particularly by employers and occupational medicine professionals.
Problems of Occupational Dermatoses

For my bachelor thesis, I have decided to deal with the theme {\clqq}Problems of Occupational Dermatoses``. I find the issue interesting but a little bit demanding on the processing and including all the necessary details. The aim of my work is to map occu-rence of occupational dermatosis in {\clqq}the centre of occupational deseases`` of Occupatio-nal Therapy Ward in České Budějovice Hospital and to accept and practically realize precautionary measures to decrease or avoid occurance of new occupational dermatosis cases. The hypotheses were concerned with comparing statistics of occupational derma-tosis cases reported in {\clqq}the centre of occupational deseases`` in České Budějovice and its congruity with developments of nation-wide statistics, and also precaution of occupati-onal dermatosis in a chosen copany. To research the first file, I have used a secondary data analysis and National health registry of occupational deseases statistics; for the second file, the method of quantitative reasearch was used and finally I used questio-naire for the data acquisition technique. The research was divided into two parts: the first file was comprised of occupational dermatosis data acquired in National health registry of occupational deseases, the second file was formed by employees of a com-pany producing spare parts for automobile industry. The results of the research were processed into charts and diagrams. The chosen aims were fulfilled, the process of acquiring datas was also not problematic, but there were some problems with gathering information from addressed respondents. The hypotheses were not confirmed {--} occu-pational dermatosis statistics of {\clqq}the centre of occupational deseases`` in České Budějo-vice differ from nation-wide statistics and so the precaution of occupational dermatosis is insufficient.
A study to research symptoms, development, health and social incidence of work related disease resulting from longterm single-sided overuse of the upper limbs

Occupational diseases from excessive and one-sided overloading of upper limbs are classified as diseases caused by physical factors. In the ``list of occupational diseases{\crqq} they are covered in chapter two. This group of diseases falls mainly under items 9 and 10 with the biggest proportion of occupational diseases caused by physical factors and it accounts for ca. 45% of the newly reported occupational diseases . Moreover, a slowly increasing trend in occurrence of those diseases has been reported in recent years.
Professional Contagions in Health Service

The topic of my bachelor thesis is Professional Infections in Health Care. The definition of professional infection marks the diseases which affect certain profession groups at higher rate than other population. At assessing it is necessary to prove that an affected person got into touch with infection during service, and that the risk of infectious disease during work was demonstrably higher than in common life (Göpfertová, 2005). The most significant risk in health service is the transmission of infections and thus higher possibility of professional infection occurrence in a health worker. That is why it is important for health workers to have maximum information on these problems. Professional infections can be announced and acknowledged as contagious and parasitic occupational diseases. They belong to V. chapter in the list of occupational diseases and have legislatively social and economical consequences for an affected person. According to the statistics of the last few years the most frequently repeating diagnoses are as following: scabies, viral hepatises and tuberculosis. To prevent the infections it is important to adhere to hygienic and against-epidemic mode, barrier nursing care. Thus it is necessary for the health workers to have knowledge in following: which diseases belong to professional infections, how they are transmitted, what possibilities of prevention exist, and also that the affection by these infections can have serious health consequences. It is also necessary that complex occupational health care was administered within the whole range. Simultaneously, the health workers should be aware that according to valid legislation they are entitled to protection and safety of their health during service. The investigative part was carried out on the basis of quantitative research. The method of data collection was questioning, using the technique of a questionnaire. The questionnaire comprised 25 questions, 24 were closed, and 1 was half-open. The research group was non-medical workers in inpatient departments in Regional Hospital Náchod, Inc. The questionnaires were distributed to health workers apt to do health jobs without professional supervision, after gaining professional qualification (nurse, midwife) and health workers apt to do health jobs under professional supervision or direct management (health assistant, auxiliary nurse, emergency medical technician). The workers were of various age groups and practice in health care. In total, 150 questionnaires were distributed; rate of return was 115 of which 110 (100%) could be used for the final evaluation. The rest of them were discarded because they were filled in insufficiently. The first aim of my bachelor thesis was to find out about informedness on professional infections (contagious and parasitic occupational diseases) in non-medical workers in inpatient departments in Regional Hospital Náchod, Inc. The second aim was to find out about informedness on professional infections transmission and prevention in non-medical workers in inpatient departments in Regional Hospital Náchod, Inc. The third aim was to find out how the primary occupational health care is performed in non-medical workers in inpatient departments in Regional Hospital Náchod, Inc. On the basis of the results the hypothesis no. 1 was disproved. In this hypothesis I presumed that non-medical workers in inpatient departments in Regional Hospital Náchod, Inc. are informed on professional diseases (contagious and parasitic occupational diseases). Concerning the hypothesis no. 2 it can be stated that non-medical workers in inpatient departments in Regional Hospital Náchod, Inc. are informed on transmission and prevention of professional infections. This hypothesis was proved. Also no. 3 hypothesis was proved. The primary occupational health care is performed fully in non-medical workers in inpatient departments in Regional Hospital Náchod, Inc. This thesis could serve as a study material.
