Fostering Polar Cooperation: A Comparative Analysis of the Arctic and Antarctic Models
McGuire, Sarah ; Karlas, Jan (advisor) ; Lipovský, Milan (referee)
As sea ice melts and Arctic waterways become increasingly navigable, the importance of effective polar governance has never been higher, especially with heightened geopolitical tensions across the globe. Unlike its southern counterpart, the Arctic region is not governed by a single treaty, but rather a network of agreements and an international forum - the Arctic Council - designed to make recommendations and facilitate cooperation among the eight Arctic states. The objective of this study was to confirm if the Arctic Council and its governing instruments exhibit hard law or soft law characteristics and to consider the advantages and disadvantages of each. The subsequent objective was then to determine if there are lessons the Arctic can learn from the Antarctic, which is largely considered to be a successful example of hard law, and what barriers may be preventing the implementation of such improvements. Abbott and Snidal's Concept of Legalization was applied to determine the degree of legalization of treaties and agreements negotiated under the auspices of the Arctic Council and the products of its working groups by assessing their levels of obligation, precision, and delegation. This research found that the Arctic Council's contribution to Arctic governance does predominately exhibit soft law...
Moral obligation as sociological fact and theoretical problem: a debate between Bergson and Kant
Palmea, King Reinier ; Ottmann, François (advisor) ; Serban, Claudia (referee)
This work aims to explicate the difference between Bergson and Kant's concept of obligation in light of Bergson's critique of Kant in his book Les Deux Sources de la Morale et Religion (The Two Sources of Morality and Religion). From what perspective does this critique and reading of Kant originate? I argue that it lies in their different approaches to morality. On one hand, Bergson views moral obligation as a sociological and anthropological fact. He applies an existential approach in his moral theory because the anthropological fact he engages with, namely the phenomenon of barbarism during the First World War, provides the framework for his typology of closed and open morality, and his critique of deontology. On the other hand, Kant considers morality as a theoretical problem; morality is a conceptual engagement-an investigation of the concepts that morality presupposes. Their divergent approaches underpin (1) the difference in their conception of freedom in relation to morality and (2) their conception of mysticism as a possible ground for morality. Keywords: obligation, reason, pressure, aspiration, morality, freedom, autonomy, moral creativity, mysticism
Claim and dispositions with it
Kment, Václav ; Zvára, Michael (referee)
Claim and dispositions with it Abstract This thesis aims to provide readers with a comprehensive insight into the law of obligations with regard to the theoretical concept of a claim and analyze its place in the legal system as a concept of relative property law and at the same time thing from the perception of the current civil law. The first chapter presents the characteristics of an obligation and its cause and further elaborates on its origin, changes and termination. The second chapter analyses the nature of a claim, as the right of a creditor to demand performance from a debtor from both theoretical and practical poin of view, taking into account the genesis of understanding of this institute from Roman law to the current apprehension in the law of the Czech Republic. For the sake of completeness, a chapter on debt has also been included in the thesis, in order to analyse debt as an institute standing on the other side of the spectrum of an obligation with emphasis on possible dispositions therewith from the point of view of the debtor and the creditor. The fourth chapter deals with the pivotal theme of the thesis, namely dispositions with receivables and their limitations, which arises from the fact that a receivable, although being a property value owned by its creditor, stems from the relationship...
