61 Costs of proceedings with respekt to contested civil cases Summary This Master thesis deals with costs of proceedings with respect to contested civil cases. The legal proceedings area is always connected with some expenses. Those are of different nature depending on to whom they occur. They occur, on one hand, to the state in the connection with the securing of its basic functions, which, without any question, includes the running of justice. On the other hand, it occurs to the parties to these proceedings. In the introduction of my thesis the notion of the costs of proceedings is defined, followed by specifications of different kinds of these costs, including its specifics and legal regulations. In the third chapter the duty to pay the expenses of proceedings is shaped. This duty comes into being in the moment of the origination of the costs of proceeding itself. Furthermore the compensation of costs is laid out. This part answers the question who, as the final result, carries the burden of these compensation payments. This text also examines the way the courts make the decisions about the costs of proceedings, including the possibilities and conditions of its adequate reduction. This graduation thesis deals with the distraint by selling a real estate in the Czech legal system. The matter of execution (distraint) is regulated in the Czech Republic by two key Acts: Act No. 99/ 1963 Coll. and Act No. 120/2001 Coll.. This graduation thesis discusses the distraint regulated by the Act No. 120/2001 Coll. - the distraint carried out by the executors. The sale of a real estate in the distraint is one of the most difficult manners of execution. It is mainly because of its time-demanding nature and a plenty of various process conditions that have to be fulfilled. Also the number of legal remedies that can be interposed during the distraint proceedings is the reason, why this manner of distraint is one of the most effective and one of the most challenging at the same time. The distraint by selling a real estate is very usefull especially when a bigger sum of money is being executed. It is because of the real estate value. Other manners of distraint wouldn't be so effective while executing a large debt. Autor diplomové práce má za to, že i když úprava v ob anském soudním ádu není na první pohled tak obsáhlá, jako úprava obdobného institutu v procesním p edpisu Spolkové republiky N mecko, tak p esto, aby mohl být vydán rozsudek pro zmeškání v eské republice, vyžaduje spln ní pom rn velkého po tu zákonných p edpoklad . Diskutabilní se skute n zdá zejména být, zda je 10 dn dostate nou lh tou, když vezmeme v potaz, že za prvé platí u rozsudku pro zmeškání fikce doru ení a za druhé je t eba vzít na mysl skute nost, že v dnešní dob je b žné odjížd t nap íklad na m síc nebo ješt delší dobu mimo své bydlišt , i dokonce mimo eskou republiku. A pak se skute n m že stát to, že se žalovaný nedostaví k jednání, a koliv by se ho jinak cht l zú astnit. Toto jist není smysl kontuma ního rozsudku, ten si práv klade za ú el, aby svým vydáním jakoby potrestal stranu, že se k jednání nedostavila. 157 SHRNUTÍ (RESUMÉ) This diploma work takes an interest in the problem of judicial administration. Its main theme is the question whether and what way it can be encroached on the independence of courts via the execution of judicial administration. The existence of independent judiciary is the essential part of a democratic legal state.For that reason the principal of the independence of courts and judges is laid down in the constitutional regulations such as the principal of division of power which is connected with it. Judiciary must be separated from the other two branches of the state power in order to prevent from encroaching on ruling by the other powers and this way to reaching the main assigment that should be kept by judiciary, which means to guarantee independent, impartial and well-deserved decision of legal conflicts. It is the obligation of the state to create such a quality system of quarantees to reach this goal.At the same time the state must quarantee the work of courts from the material, financial,personal side and the way of work at the court and also provide surveilance of decent executing the judiciary. 55 XII. Summary Civil proceedings costs My thesis concerns civil proceedings costs. The aim of this study was to explain a concept of costs, to describe particular types of costs that may arise and explain principles that control the payment and reimbursement of this costs. I tried to reflect current judicature, which clarifies the sense of some unclear provisions of laws. I mentioned the new regulation, which is now in the legislative process. My aim was also to assess the current legislation and, where appropriate, recommend changes to be made. A decision to pay the costs must be included in any verdict on the merits. The thesis is composed of eleven chapters. Chapter One is introductory and explains concept of civil proceedings costs and its meaning. Following part of the thesis outlines sources of law governing this institution of civil legal proceedings. Chapter Two enumerates kinds of civil proceedings costs.
