Interrogation tactics

The subject-matter of my thesis is interrogation tactics, i.e. a process when an interrogator choses a specific method which should help him to reach the goal of the interrogation - true and full testimony. The whole thesis is divided into five chapters that are again divided into sections. The introduction chapter describes the basic terms which are crucial for understanding and appreciation of the thesis. Second chapter gives reader an overview on Czech current effective regulation in Criminal Code compared with German current effective regulation and with regulation which was effective on Czech territory in 1873. In the third chapter I dealt with preparing of an interrogation, i.e. analytical a synthesis part, their mutual cohesion and also with different opinions of authors' regarding the problematic whether to divide the preparing of interrogation into phases or not. There are described particular phases of interrogation, in the fourth part that is an introduction, a monologue and a dialog. Each part is described in particular section. In section called dialog I have tried to describe each interrogation tactic, e.g. psychological influence on somebody who is lying. Psychological profiling of an offender

The psychological profiling is regarded as one of the promising method of criminalistics employed for solving crimes. The object of my dissertation is to clarify the role of the criminalistic method of psychological profiling within the process of investigating crime, its significance and possibilities for the application. The dissertation consists of three main parts which are subsequently divided into chapters and subchapters. Particular chapters and subchapters of the dissertation deal with various points of view on the methods of psychological profiling of the offender. The introduction is followed by a part of my dissertation which deals with particular elementary aspects of the method of psychological profiling. This part is divided into seven chapters. The first chapter familiarizes the reader with the notion of psychological profiling and its substance. The second chapter describes within its two subchapters the historical development of the method abroad and in the Czech Republic. The third chapter specifies the types of crimes which are eligible for the profiling. The fourth chapter is focused on the possibilities of employing the services of psychologists for investigating crimes. Methods of investigation of murders (selected issues)

This diploma thesis addresses the issues of the murder investigation methodology. It is divided systematically into four chapters. First three chapters may be perceived by the reader as the fundamentals of the thesis aiming at contextualizing and highlighting the final chapter which bears the core ideas and findings. Chapter One deals with crime against life from the perspective of the criminal law in the Czech Republic. An account of legal definitions of murder, manslaughter and murder of a new-born infant by its mother, as defined in the Criminal Code, is offered in the chapter. Certain features of the constituent elements of those crimes are compared and commented on in greater detail. Chapter Two presents murder in view of criminology and includes the statistical data regarding the intentional homicide rate within the Czech Republic. As for the statistical data, it is predominantly recent and up-to-date. However, there may also be included statistical data gathered over an extended period of time which better demonstrate the dynamics of crime development. Expert witness - psychologist in criminal trial

anglicky The aim of this diploma is to describe the role of an expert psychologist witness in criminal trial and to define purpose of forensic psychological assessments. It also tries to answer current questions related to the field of psychological expert opinions. The psychological forensic expert witness is appointed in the same way as other legal expert witnesses. That means he has the same rights and obligations as them. The first chapter is therefore devoted to connoisseurship in general. It deals with the historical development of expert witnesses, current applicable legislation and upcoming legislative changes in this area. The second chapter approaches other expert witnesses in court too. It includes number of forensic experts in various fields and compares expert psychologists to psychiatrists, who often provide their opinions alongside psychologists'. The main part of the chapter is left to expert opinions. It clarifies terms such as personality, intellect, memory, motivation and dangerousness of the offender, that are the most commonly evaluated aspects. Identification of cadavers and skeletal findings Abstract "Identification" is an act of declaration of identity. The identity (particularly in today's globalized society) deservedly draws attention not only in a normal social interaction, but is also enshrined legally. Its purpose is also important in the sad events of last identification of a person - the identification of the dead. Thesis sets as a goal in a clear and comprehensible form to offer a presentment to an extremely interesting and inspiring topic of identification of the dead human body, using multidisciplinary approach with focus to criminological practice. It provides a comprehensive overview of all the components of identifying corpses, demonstrates the process of identifying, from the finding of the dead body, through autopsy, up to some practice expertise to determine its identity. To achieve this, the method of literature review using books and journals, both domestic and foreign, with subsequent synthesis of acquired knowledge and information with their critical evaluations is used. Tactics to avoid false testimony

Resumé The tactical procedures if overcoming the false testimony The subject of my diploma work is the tactical procedures of overcoming the false testimony. I also dealt with methods, which can be used for revelation and overcoming the untrue testimony. The central concepts which are connected with tactical procedures and methods are the testimony and the interrogation. The interrogation and testimony can be characterized from the psychological, criminalistic and legal view. Concerning my diploma work the criminalistic view is the most important. Criminalistics defines the interrogation as the criminalistic method, which is used (under the law) to obtain criminalisticly- and law-important information from the memory of the interrogated person. This is done by the testimony and the rights of the both of the interrogater and the interrogated person have to be strictly observed. In this method are used the tactical procedures, which can help examiner to overcome the false testimony. I evaluated all tactical procedures and methods according to their reliability and effect in the fight against the untrue testimony. Methodology for investigating organized crime

This thesis focuses on organized crime that has recently become one of the most serious global problems threatening the stability, security and development of civil society. At the beginning of the thesis, its author defines a basic term ,,organized crime" and its relation to the organized criminality. Then the author deals with the history of organized crime groups, describes the most important of the groups, and concentrates on new forms of organized crime. Furthermore, the author lists Czech and international substantive and procedural legal regulations with regard to the organized crime. Finally, the author discusses other non-legal means of the fight against the organized crime. The main part of the thesis is devoted to the methodology of investigation with a focus on specific initiatives and the subject of investigation, initial and subsequent acts, and the specific versions of investigation, planning, organization of investigation, and prevention. In greater detail, the thesis deals with methods of witnesses hearing, and especially with the legal concept of a secret witness, and protection provided to witnesses by special law, and the concept of a cooperating accused person. The thesis also analyzes operative and investigative means and other means of investigation.
Forensic ballistics

The aim of this thesis is to introduce the basic information about the forensic ballistics and about the procedure of ballistic experts. The first chapter is dedicated to clarification the fundamental terms of the subject matter of this thesis. Beside the term of forensic ballistics I also introduce the meaning of some other related terms used in the following text. Next chapter deals with the history and development of the ballistics. The key feature of every ballistic researches are the ballistics marks described in the third chapter. I focus on the ballistic marks division, the origin and occurrence and receiving of these. The gunshot residues are mentioned in their own subchapter. The objects of the ballistic researches, listed in the chapter four, are firearms, ammunition and animate or inanimate target. Next chapter deals with the range of ballistic researches which can be divided into two groups. Within the frame of the identification examination of firearms and ammunition, the individual and group identification of the gun used in a criminal offence is performed. That means the ballistic marks from the seized firearm are compared with the ones detected in a crime scene.
