Úkolem této práce je seznámit se s provedením exekuce zabavením movitých věcí a jejich případným zpeněžením. Nejprve je zde zběžně nastíněno exekuční řízení jako celek a představeny zákony, které je nutno znát a dodržovat při exekučním řízení. Dále jsou zde vyjmenovány a popsány veškeré možné způsoby vedení exekuce, které je exekutor při své činnosti oprávněn využít. Po tomto tématu již následuje hlavní část této práce, tj. podrobný postup a činnost zaměstnance exekutorského úřadu, při mobiliární exekuci. Zde je kladen důraz na popis a vysvětlení činnosti vykonavatele exekutorského úřadu při jeho úkonech spojených s prací v terénu, tj. místní šetření, komunikace, pořizování multimediálního záznamu, úhrada dlužné částky na místě, soupis movitých věcí, odvoz movitých věcí nebo dražba na místě. Jak již bylo řečeno je zde probrána problematika exekučního řízení, zejména samotný výkon zaměstnanců exekutora na místě, zákonné možnostmi exekutora při mobiliární exekuci, ale také práva a povinnosti postižených osob a zejména jejich možnost procesní obrany. The aim of this essay is to become acquainted with the process of the seizure by confiscating movable property and the possibility of converting the property into money. Firstly there is going to be outlined the process of seizure and laws and statutes that have to be followed in such a trial are going to be cited. Secondly all kinds of seizure procedures that a distrainor can legally use are going to be mentioned. This theme is going to be followed by the main part of this essay, which is going to include a detailed process of a job of a distrainor in case of .parts of the furniture execution Here is going to be highlighted a description and explanation of the job of an executor of the distrain office while doing the ,,fieldwork", which includes local research, communication, providing a multimedia record, reimbursement of financial expenses, inventory of the movable assets, transport of the movable assets or an auction on the spot. As being said before a process of a seizure trial is going to be described, above all the activity of the employees at the spot, legal procedures of the distrainors while executing a parts of the furniture execution, but also the rights and duties of the individuals involved in the process and the ways of their civil defense.
