Tématem této bakalářské práce je skončení pracovního poměru a povinnosti zaměstnavatele. Práce je rozdělena na dvě části, a to na teoretickou část a praktickou část. V teoretické části této bakalářské práce je věnována pozornost rozboru platné právní úpravy v podobě zákona č. 262/2006 Sb., zákoník práce a má pět kapitol. První kapitola se zabývá základními otázkami pracovního práva, tudíž je zde definováno pracovního právo a jeho prameny, dále pracovněprávní vztahy a závislá práce a rovněž i subjekty pracovního práva. Tato kapitola je užitečná především k tomu, aby se čtenář seznámil se základními, ale velmi důležitými pojmy pro samotné pochopení problematiky této bakalářské práce. Další a zároveň nejrozsáhlejší kapitola již nese samotný název této bakalářské práce a jsou zde podrobně vysvětleny veškeré formy skončení pracovního poměru. Tato kapitola rovněž věnuje pozornost neplatnému rozvázání pracovního poměru. V další kapitole jsou uvedeny povinnosti zaměstnavatele, které jsou spojené se skončením pracovního poměru, jako je výplata odstupného, pracovní posudek apod. Poslední kapitola teoretické části této bakalářské práce věnuje pozornost odborovým orgánům. Druhá navazující část této práce představuje konkrétní společnost. Tato část se soustředí na analýzu skončení pracovního poměru u konkrétního zaměstnavatele a následně na zjištění, zda společnost při skončení pracovního poměru postupuje v souladu se zákoníkem práce. Na základě výsledků této analýzy je učiněno zhodnocení informací a návrhy řešení, které by mohly vést k nápravě zjištěných nedostatků. The topic of my bachelor thesis is termination of employment process and employers duties. Thesis is divided into two parts which are theoretical and practical ones. The theoretical part is focused to an analysis of a valid legal framework in form of the law no. 262/2006 Sb., Labour Code and it has five chapters. First chapter examines essentials of labour law, therefore labour law and its sources are defined here. Labour law relations and dependent labour together with subjects of labour law are also included in this chapter. The chapter is very useful mainly to get reader acquainted with elementary but very important terms in order to understand the thesis itself. The following chapter which is also the largest one and which gave the name the whole thesis explains in detail forms all forms of termination of employment process. This chapter is also focused at invalid termination of employment process. Next chapter consists of employers duties which are related to a termination of employment process such as severance payment, labour report, etc. The last chapter in theoretical part is focused at union bodies. The second part of the thesis presents a particular company. This part is focused at analysis of a termination of employment process at specific employer and subsequent evaluation and finding whether the company complies with all rules in regard of termination of employment process. Based on the results of this analysis the evaluation of the information is made together with solution proposals which could lead to a reparation of identified insufficiencies.
