ABSTRAKT Cílem práce byla analýza stávající právní úpravy, která v zájmu budování a provozu veřejné technické infrastruktury omezuje hospodaření v lesích, a dále analýza právních institutů umožňujících kompenzaci takto vzniklých ztrát. Na základě rešerše legislativních úprav vztahujících se na budování a provoz jednotlivých typů sítí veřejné technické infrastruktury byl analyzován jejich dopad na hospodaření v lesích a možnosti ekonomické kompenzace vzniklých hospodářských ztrát z pohledu vlastníka lesa. Bylo zjištěno, že proces umisťování veřejné technické infrastruktury na pozemky určené k plnění funkcí lesa je transparentní a vůči oprávněným zájmům vlastníku lesů dostatečně ohleduplný. Problém představuje toliko nedostatečná výše, respektive neúplný rozsah poskytovaných náhrad za vzniklá omezení na hospodaření v lesích. Zcela bez jakýchkoliv kompenzací ponechává současný právní řád České republiky omezení vznikající na hospodaření v lesích v souvislosti s veřejnou technickou infrastrukturou vybudovanou v minulosti na základě tzv. zákonných věcných břemen. ABSTRACT The main goals of this thesis are to analyse the current laws that support public technical infrastructure development, despite limiting the forest management and legal institutions that provide compensation for such loss. Research based on analysing legal amendments related to developing the infrastructure, shows the impact on forest management and the possibility of economical compensation for such loss from the forest owner's point of view. The process of developing the infrastructure in forest land has been found transparent with adequate consideration to the forest owners. However, the compensation for the forest management limitation is not sufficient. The Rule of law in the Czech Republic keeps the previous restrictions of forest management where the infrastructure has been developed, without any compensation due to so-called law easements.
