[cze][eng] Postavení hlavy státu je jednou z klíčových otázek fungování ústavního systému ve všech státech bez ohledu na to, zda se jedná o monarchie, či republiky. Ve státech s republikánským zřízením pak s touto otázkou souvisí i další – vymezení způsobu volby hlavy státu, tedy prezidenta. Odpověď na zmíněné otázky pak patří k těm, na jejichž základě je možné provést klasifikaci dnes existujících forem vlády vycházejících z demokratického modelu fungování vlády v širším slova smyslu. Klasické schematické členění na systém parlamentní a prezidentský není dostatečné, neboť pomíjí řadu relevantních faktorů výkonu moci. Většina autorů se dnes spíše přiklání ke klasifikaci obsahující pět základních modelů: parlamentní; poloprezidentský, premiérsko-prezidentský; prezidentský; prezidentsko-parlamentní. Práce zkoumá fungování Francie, Irska, Finska, Polska, Portugalska, Rakouska a Slovenska z hlediska postavení prezidenta v systému nejvyšších státních orgánů, a to v poválečném období. Komparace vývoje funkce prezidenta v těchto zemích prokazuje skutečnost, že samotná existence přímé volby prezidenta není dostatečným důvodem pro konstatování výrazné odlišnosti takovéhoto ústavního systému od systému s nepřímou volbou hlavy státu. Dokonce je možné konstatovat, že země, v nichž je přímá volba prezidenta zavedena, netvoří specifickou kategorii zemí, jejichž ústavní a politické systémy by vykazovaly výrazné shody. Závěry této práce lze shrnout do následujících bodů: a) neexistuje přímá souvislost mezi existencí přímé volby prezidenta a významem jeho postavení v ústavním systému daného státu; b) je zapotřebí rozlišovat mezi hodnocením významu funkce prezidenta v ústavním systému, jak to vyplývá z formální ústavní úpravy, a tím, jak je funkce skutečně vykonávána, především s ohledem na postavení prezidenta ve stranicko-politickém systému. Zatímco z formálně-ústavního hlediska bychom mohli za státy s nejsilnějším prezidentem považovat Finsko a Portugalsko, z hlediska reálného uplatnění prezidentského vlivu bychom za zemi s nejsilnějším prezidentem označili jednoznačně Francii. Nejslabší prezident, a to z obou hledisek, je pak v Irsku. c) velmi významnou skutečností, která ovlivňuje výkon prezidentské funkce v těchto zemích, je výrazná osobnost prvního prezidenta, který byl v přímých volbách zvolen. Typickým příkladem takové osobnosti, která vtiskla podobu výkonu prezidentské funkce i na další období, byl Antonio Salazar v Portugalsku nebo Lech Walesa v Polsku. d) Další skutečností, která ovlivňuje postavení prezidenta v rámci ústavního a politického systému, je míra jeho účasti v reálném stranicko-politickém životě. V některých zemích je prezident vnímán spíše jako nestranický a na politických stranách nezávislý arbitr (Irsko), v jiných zemích je naopak lídrem některé z hlavních politických stran bez ohledu na to, zda se jedná o stranu vládní nebo opoziční (Francie). Specifická je situace v Rakousku, kdy je přímo volený prezident aktivním členem politické strany, jejímž předsedou je ovšem spolkový kancléř. e) Svůj význam při vymezení ústavního postavení prezidenta má také definice jeho právní a politické odpovědnosti. Skutečnost přímé volby staví hlavu státu do pozice ústavního orgánu odvozujícího svoji legitimitu z jiného zdroje než z parlamentu, a tím samozřejmě vytváří podmínky pro konstatování politické neodpovědnosti prezidenta vůči zákonodárnému sboru. Většina ústav evropských států, a to bez ohledu na to, zda je zde zakotvena přímá volba prezidenta, vymezuje určitý stupeň trestní imunity při výkonu prezidentské funkce, a to zejména formou klasického institutu impeachmentu, kdy žalobu konstruuje parlament nebo některá z jeho komor a rozhoduje některá z nejvyšších soudních instancí nebo zvláštní soudní orgán. Vedle toho se v některých státech (Polsko, Portugalsko, Rakousko) setkáme také s koncepcí trestněprávní odpovědnosti prezidenta za činy spáchané v období výkonu funkce. Specifická je situace v Rakousku a na Slovensku, kde ústavy konstruují politickou odpovědnost prezidenta.The position and competence of the head of state plays decisive role in the constitutional system. In the republics, the position of the head of state is closely connected with the presidential electoral system Traditional classification of the forms of government is not sufficient enough, especially because of leaving out several important variables. Most of authors nowadays tend to classify forms of government into following models: parliamentary system, half-presidential, prime minister-presidential, presidential, presidential-parliamentary system. The paper surveys the position of president in France, Ireland, Finland, Poland, Portugal, Austria and Slovakia. The conclusions of this study may be summarized: a) there is no direct implication between direct presidential election and importance of president in the constitutional system of the country, b) it is necessary to distinguish between importance of the presidency in the constitutional system, as it results from the formal constitutional regulation on one side and the manner how the president is functioning in practice, mainly considering the presidential position in the party-political system on the other side. Whereas in the light of the formal constitution we could consider Finland and Portugal as the states with the strongest president, in reality we could unambiguously identify France as country with the strongest president. The weakest president is then, in both lights, in Ireland. c) The fact of outstanding personality of the first president elected in the direct elections may be the very important factor affecting the importance of presidential position. The example of such a personality which engraved the style of the presidential function for following periods was Antonio Salazar in Portugal or Lech Walesa in Poland. d) Another element affecting the presidential position within the constitutional and political system is the extent of his participation in political life. In some countries the president is taken as non-party man and independent arbiter (Ireland), in other countries, president is a leader of main political party regardless if it is a governing or opposition party (France). In Austria the directly elected president may be an active member of the political party while the federal chancellor is its chairman. e) Presidential legal and political responsibility determines the constitutional status. The direct election causes that constitutional authority of the president arises from other source than the Parliament and which creates conditions for political unaccountability of the president. Majority of constitutions of European countries define a certain grade of criminal immunity during presidential electoral term, appended by some form of impeachment. President may be charged by one of parliamentary chambers, the judgement is completed by one of the top judicial instances or by a special judicial body. Besides, in some countries (Poland, Portugal, Austria), there exists limited criminal responsibility of the president. In Austria and Slovakia the constitution contains political responsibility of the president. In Austria the president is accountable to the Federal Assembly, in Slovakia the constitution even enables the possibility to remove the president by the plebiscite.
