Mediation with an International Element

The purpose of this thesis is to present the main features of mediation with cross-border element, especially the most important aspects of relevant regulation in light of EU Mediation Directive 2008/52/EC ("Directive") and No. 202/2012 Coll. Act on Mediation and Change of Some Laws ("Mediation Act"). The thesis is composed of four chapters. The first chapter's purpose is to define the main principle of mediation and its position within ADR system. The second chapter deals with principal questions of the relation between mediation and international private law. The third chapter discusses cardinal aspects of mediation according Directive, its reflection within national regulation, i.e. within Mediation Act and subsequent comparison with regulation of selected member states. For the purpose of the comparison mentioned above, I use quotations from corresponding laws of particular member states in English translation. The fourth chapter deals with the position and role of mediation within the area of international dispute resolution as well as a look at newly adopted ICC Mediation Rules.

4 Anotace Ce mémoire traite de six composantes de l'événement de parole, telles que définies par Roman Jakobson. Celles-ci sont introduites comme éléments de base du processus pédagogique en même temps, et elles sont redéfinies dans le cadre de l'enseignement communicatif, en se rapportant surtout à l'enseignement du français langue étrangère. A part de donner les caractéristiques idéales de ces composantes-là, on prête attention particulièrement à la position des gestes dans l'évenement de parole : leur rôle dans l'enseignement communicatif et les possibilités d'enseigner le langage des gestes d'une manière efficace. This thesis deals with the six components of the speech event as defined by Roman Jakobson. These are introduced as the basic elements of the pedagogical process at the same time and they are re-defined within the frame of the communicative language teaching classroom, referring mainly to teaching French as a foreign language. Apart from outlining the ideal caracteristics of these components, the attention is paid particularly to the position of gestures in the speech event : their role in the communicative language teaching and possibilities to teach them effectively. Sally Rooney's Conversations with Friends and Normal People from the Perspective of Marxist Literary Criticism

This diploma thesis examines Sally Rooney's novels Conversations with Friends and Normal People from the viewpoint of Marxist literary criticism. Based on the author's own claim to incorporate "a Marxist framework" into her writing as a way of describing the surrounding world, the thesis, there- fore, aims to explore the aforementioned novels with regard to Marx's theory. The first part focuses on the theoretical background and principal thoughts of Marxism and Marxist literary criticism. Next, there is outlined the conception of social classes in Ireland and a brief introduction of Sally Rooney's views in order to provide context to the novels. The second part of the thesis then applies the theoret- ical background to an analysis of the novels themselves. This includes their stories, settings, charac- ters and conveyed ideas in relation to the issues of base and superstructure, power dynamics, class identity, social status and influences of economic as well as cultural and educational hegemony.

1 Mediation as a Mean of International Commercial Dispute Resolution Abstract The subject of this dissertation is the topic of mediation in solving international commercial disputes. At the outset, the author focuses on the general theory of dispute and argues that the main psychological features of thinking about conflicts are inherent in virtually all types of social relations, regardless of their specific nature. It is therefore useful to recall the knowledge about the psychology of conflict in the context of research on the resolution of international commercial disputes, as this initial line of reasoning is also present. In the first part of the dissertation, the author defines the position of mediation within the spectrum of the dispute resolution and identifies its relationship with other ADR methods. She is particularly concerned with the recent change in the ADR area, particularly as regards the shift of arbitration towards judicial proceedings and convergence of mediation with arbitration in certain respects. Furthermore, the author considers the importance of mediation for international commerce, noting in particular the aspect of the institutionalisation of mediation and touches on the phenomenon of regional change in international trade. 1 ABSTRACT MEDIATION AS A MEAN OF INTERNATIONAL COMMERCIAL DISPUTE RESOLUTION This dissertation deals with the phenomenon of discrepancies between commonly shared perceptions about international mediation and its real and practical situation. The aim of this disertation is not to analyze the legal provisions on mediation in individual national jurisdictions or to analyze individual provisions of the private international law, which potentially apply to issues of cross-border mediation. The intention is to point to current trends and current issues in the field of international mediation. We especially want to conduct generally accepted theoretical concepts of mediation in an international context critical view by comparing it to empirical dates proving the actual state of mediation as a method of resolving international business disputes. The first part of this disertation summarizes the basic theoretical background related to mediation, which serves as a basis for the construction of generally recognized premises in this field. These premises relate to the context of international commerce.
