Mediace jako metoda řešení mezinárodních obchodních sporů Abstrakt Předmětem této disertační práce je téma mediace při řešení mezinárodních obchodních sporů. Úvodem se autorka věnuje obecné teorii sporu a argumentuje, že hlavní psychologické rysy uvažování o konfliktech jsou vlastní prakticky všem typům společenských vztahů, bez ohledu na jejich konkrétní povahu. Na poznatky ohledně psychologie konfliktu je tedy užitečné vzpomenout i v rámci výzkumu týkajícího se řešení mezinárodních obchodních sporů, neboť i zde je tato výchozí linie uvažování přítomna. V první části práce autorka vymezuje pozici mediace v rámci spektra řešení sporů a popisuje její vztah vůči ostatním metodám ADR. Věnuje se zejména změnám patrným v oblasti ADR v poslední době, zejména pokud se jedná o posun rozhodčího řízení k řízení soudnímu a sbližování mediace s rozhodčím řízením v určitých ohledech. Dále se autorka zamýšlí nad významem mediace pro mezinárodní obchod, všímá si především aspektu institucionalizace mediace a podrobněji se dotýká fenoménu regionální změny mezinárodního obchodu. Poukazuje na skutečnost, že do přeshraničních obchodních vztahů se stále výrazněji zapojují subjekty pocházející ze zemí, které kulturně inklinují ke konsensuálním metodám řešení konfliktů. Všímá si, že i přesto se v oblasti obchodních sporů lze s... 1 Mediation as a Mean of International Commercial Dispute Resolution Abstract The subject of this dissertation is the topic of mediation in solving international commercial disputes. At the outset, the author focuses on the general theory of dispute and argues that the main psychological features of thinking about conflicts are inherent in virtually all types of social relations, regardless of their specific nature. It is therefore useful to recall the knowledge about the psychology of conflict in the context of research on the resolution of international commercial disputes, as this initial line of reasoning is also present. In the first part of the dissertation, the author defines the position of mediation within the spectrum of the dispute resolution and identifies its relationship with other ADR methods. She is particularly concerned with the recent change in the ADR area, particularly as regards the shift of arbitration towards judicial proceedings and convergence of mediation with arbitration in certain respects. Furthermore, the author considers the importance of mediation for international commerce, noting in particular the aspect of the institutionalisation of mediation and touches on the phenomenon of regional change in international trade.
