The legal regime of practicing tourism and sports in specially protected areas

The diploma thesis deals with legal regime of practicing tourism and sports in specially protected areas of the Czech Republic. Specially protected areas are areas with stricter protection regime of nature on specific accurately assessed flat territory. The thesis is composed of five chapters dealing with mutual relationship between sports and environmental protection, general definition of law of specially protected areas of the Czech Republic with a focus on protection tools and sports and tourism activities. Last two chapters are devoted to the pursuit of climbing in the Protected Landscape Area Jizerské hory and the National Park České Švýcarsko. Remediation of rock mass by zero-valent nanoiron

This bachelor's thesis is focused on remediation of chlorinated hydrocarbons. The main aim of the thesis was to elaborate a method of remediation of groundwater by using in situ chemical reduction by nanoscale zero-valent iron by direct push method at the Spolchemie site in Ústí nad Labem. From the monitoring of physicochemical parameters and analysis of groundwater it was discovered that the injection of nanoscale zero-valent iron caused reductive dehalogenation in the soil body. This was reflected in the increase of degradation products of chlorinated hydrocarbons. Nanoscale zero-valent iron reached borehole AW5-50 that was situated 4 metres away from the place of injection. A long-term (3.5 month) reduction of the contaminants (89 %) was monitored in this borehole. In the theoretical part of the thesis there is a description of contamination by chlorinated hydrocarbons, properties of nanoscale zero-valent iron, in situ chemical reduction by nanoiron, and natural conditions at the Spolchemie site.

Legal Regulation of Biodiversity Conservation The thesis deals with applicable legal regulation of biodiversity conservation in the Czech Republic. First it defines biodiversity (biological diversity) from the point of view of natural science and as the subject matter of legal protection. Then the thesis presents the most significant international sources of soft law and hard law in the field, the European Union's strategic documents and law and the Czech Republic's national strategic documents and law concerning biodiversity conservation. In its conclusion the thesis summarizes some problems associated with biodiversity conservation and its regulation.
Law Dealing with Environmental Crime in the Area of Illegal Trading of Fauna and Flora

This thesis deals with legislation with the task of dealing with environmental crime in the area of illegal trading of flora and fauna in the Czech Republic. Of key importance for this thesis is the examination of domestic criminal legislation, it is supplemented by an excursion into related regulations of international law and European Union law. Introduce also the actual phenomenon of illegal trading of fauna and flora, its characteristic features, historical development, the articles most frequently traded, and other specific features that are typical of this type of illegal human activity. The theoretical bases of the thesis are enhanced by an examination of related practice in the form of practical examples, court rulings, and statistical data. Finally, this thesis also contains a few proposals for improving the existing legislation and raises some objections to practical application.
Legal instruments of territorial protection of nature in the CR and Federal Republic of Germany

The aim of the diploma thesis is the analysis and comparison of the elementary legal instruments of territorial nature protection in the Czech Republic and the Federal Republic of Germany. This diploma thesis is divided into 8 chapters including the introduction and the conclusion. The second and the third chapter deal with the most important sources of legal regulation of the territorial nature protection in both international law and law of the European Union and emphasises their influence on the creation of legal regulations of national law. The fourth chapter is concerned with the historical development of the territorial nature protection in both countries in question and focuses mainly on the development of legal regulations since the 30's. The fifth chapter provides an elementary overview of the legal sources of the territorial nature protection in national law. The sixth and the seventh chapter deal with general and special nature protection respectively and provide comparison of the respective legal institutes. The conclusion is concerned with the comparison and the evaluation of common and different features of Czech and German legal regulations and provides proposals for constituent changes of the provisions in question.
Role of international courts in environmental protection

The status of international courts in the area of environmental protection is gaining importance as well as the entire branch of international enviromental law, which is also demonstrated by the creation of many treaties and increasing number of entities solving the international environmental disputes. The right to a favorable environment in addition begins to be understood as a human right, which can be claimed at the international level. The courts handle disputes through judgements, but they also provide advisory opinions, impose provisional measures or obligations to cooperate with the other party, they often help to define legal principles. They contribute to the legal certainity and because of the persuasiveness of thein arguments, their jurisprudence acts similar to precedent. Although their decisions are usually not enforceable, the courts have such authority, that their decisions are respected without exception. Legal regulation of creation and protection of Natura 2000 network

The aim of this thesis was to analyze the legal regulation of the creation and protection of the Natura 2000 network from the perspective of international environmental law, the EU law and the Czech law. The thesis is divided into five major chapters. The first chapter explains the concept of Natura 2000 and what are the purposes pursued by the system. The second chapter covers the area of legal regulation in the area of nature protection from the perspective of international law and its relationship to Natura 2000. Next chapter deals with the regulation of the Natura 2000 from the perspective of EU law. The fourth chapter focuses on mapping the decision- making of the Court of Justice of the European Union concerning the Natura 2000 network. The fifth part describes legal regulation of Natura 2000 network from the perspective of the Czech legal order.
The comparison of the legal regulations of nature conservation in the Czech Republic and in Germany in the context of the EU law

The doctoral thesis is thematically focused on a particular area of the environmental law, nature conservation. The first chapter presents selected significant international conventions and EU regulations, e.g. the Birds Directive and the Habitats Directive. The other parts deal with a comparison of the constitutional framework of environmental protection and nature conservation including the introduction of the general principles of the nature conservation in Federal Act on the Conservation of Nature and Landscape. Other chapters are focused on a comparison of general and specific nature conservation. The thesis contains selected decisions of the Court of Justice of the European Union against Germany. In the conclusion, the answers to questions are given, the introduced legislation is compared and substantial differences in both legal systems are discussed.
Legal regulation of hunting management

in English The present Master's thesis deals with the hunting legislation in the Czech Republic. The thesis is divided into 4 chapters, some of which are further subdivided into subchapters. The first chapter contemplates the history of hunting. The second chapter provides a detailed overview of the sources of the hunting legislation. The analysis covers the sources of the Czech legislation, the European legislation and international treaties. The third chapter is the key chapter of the thesis. It encompasses a detailed analysis of the applicable Czech hunting law. The fourth and last chapter contains the hunting legislation of the Slovak Republic. A part of this chapter is a comparative analysis of the Czech and Slovak hunting legislation. The main objective of this thesis is to analyse in detail the current hunting legislation, to emphasise the major deficiencies and to propose appropriate solutions.
