Hindrances to Free Movement of Workers in European Court of Justice Cases

The aim of my thesis is to acquaint the reader with the problematic of free movement of workers, both from the theoretical point of view and from practical point of view based on the European Court of Justice cases. In the theoretical part of the thesis, I focus on the characteristics of internal market and definition of free movement of persons and workers. I mention individual law regulations that significantly influence the problematic of free movement of persons. Further, I describe different exceptions from free movement of workers, mutual recognition of academic qualifications and social security regarding the movement of workers. And at last in my practical part, I analyze individual cases of ECJ which have had the most significant impact on the development of free movement of workers.

Special Women Working Conditions in Chosen Region Only

In the first chapter of the diploma thesis I am concerned with the women employment and I define the term of special women working conditions. The second chapter describes the evolution of special women working conditions as well as the evolution of working hours and child labour. The next part of the diploma thesis summarizes international, european as well as czech sources of law that are connected with special women working conditions. The last chapter is devoted to the current legal regulations of special women working conditions that is compared to the previous legal regulations and there are the results of the checklist research in Chrudim region.

This thesis deals with the common property of spouses in case of business activities of one of the spouses. First chapter defines marriage and other related issues. Second chapter is the analysis of legal regulations of property relations between spouses since the days of Rome up to the present day, which influenced up-to-date legal regulations. Third chapter deals with the forms of ownership in marriage. Last chapter is about the most important issue of the thesis - common property of spouses and business activities. This chapter deals especially with the object of common property of spouses and with the possibilities of its modification.

Labour unions and collective bargaining

Collective bargaining is one of the methods of reciprocal communication between employers and relevant trade union, which solve wage or salary and other rights in labour-law relations. Collective agreement is the purpose of collective bargaining. Its content and observance is significant part of relationship between employers and employees. Process of collective bargaining, closing collective contracts, solving collective disputes, process during strikes and lock-outs is described in the Act No. 2/1991 Coll. The aim of my master thesis is to analyze legal regulations of social dialogue, content of collective agreements and show some real examples. I also describe all feasible solutions of collective disputes, which are results of disagreements between contracting parties by closing or default of collective agreement.

Inheritance as a Change of Ownership Rights

This bachelor dissertation is committed to inheritance, inheritance law and inheritance as a change of the rights of ownership. The goal of this work is to give enough information so that even the unknowing reader will know what is connected with inheritance, what are the basic terms from this area of law and also the questions of inheritance's inter-family relations because inheritance will be a subject everyone deals with eventually. The subject of this dissertation is inheritance from history until current legal regulation. At the same time there is also mentioned inheritance as a change of ownership law and concepts that are related with this part of civil law. In the introduction is explained the terms of inheritance and inheritance law with the view to the history of Roman law and to the Middle Ages. Next is an explanation of the basic law terms through to our current law regulation. There is also a focus on inheritance procedure including the change of the ownership rights and then will be the process of the registration of the ownership right to the real estate cadastre. With this topic is also connected a possibility of an unmerchantable inheritance. With this topic is connected one of the cases that are mentioned. At the end this work is included practices of the courts.

The necessity of establishing pension reform in the Czech republic

The topic of this work is the necessity of establishing pension reform in Czech republic as a consequence of unfavourable development of not only demographic factors. The introductory part is devoted to general characteristic of social policy and deals with its principles, types, aims and functions. In the second chapter the pension system along with its history, development and actual state is described. Further some proofs that support the thesis of untenability of the current system and essentials of its transformation are mentioned. In the end are described few reform strategies together with various proposals of its accomplishment.

Employment of people with disabilities

The thesis is aimed not only to clarify the concept of disabled in the international and Czech law, but mainly on the analysis of the rights granted to such persons. It deals in detail with international legislation in the employment of people with disabilities, different ways of their protection and their application. The development of the Czechoslovak legislation, social policy and the rights of disabled people is described in the second part, as well as a review of existing legislation and possible suggestions for improvement. The practical part of the thesis is focused on the unemployment of people with disabilities in the district Most.

Odpovědnost v pracovněprávních vztazích

Diplomová práce pojednává o problematice odpovědnosti v pracovněprávních vztazích. V obecném úvodu jsou vysvětleny základní pojmy jako je odpovědnost a pracovněprávní vztah. Další části rozebírají jednotlivé druhy odpovědnosti ve vztahu k zaměstnanci a zaměstnavateli. Samostatná kapitola je věnován bezdůvodnému obohacení s aplikací na pracovní právo. Pro objasnění některých pojmů jsou použita rozhodnutí ze soudní praxe. Součástí práce je případová studie, která ukazuje, jak jsou některé druhy odpovědnosti zajišťovány a prosazovány v podnikatelské sféře.

Employer´s liability in legal labour relationships - work accident and professional disease

Z pracovnoprávnych vzťahov vyplývajú pre obe strany špecifické práva a povinnosti. Jednou z neobyčajných povinností na strane zamestnávateľa je zodpovednosť za pracovné úrazy a choroby z povolania, v súvislosti s ktorými vzniká zamestnancovi škoda. Táto diplomová práca si kladie za cieľ čo najlepšie objasniť problematiku zodpovednosti zamestnávateľa s dôrazom na zodpovednosť za škody vzniknuté pri pracovných úrazoch a chorobách z povolania; a bližšie sa zamerať na vysvetlenie pojmov súvisiacich so zákonným poistením, na prebiehajúce zmeny v zákonnom, úrazovom poistení, porovnať súčasnú a novoprijatú úpravu úrazového poistenia, výhody a nevýhody oboch systémov a v neposlednom rade objasniť čitateľovi zmeny, ktoré nový zákon o úrazovom poistení zamestnancov prinesie.
