A comparison of Czech and German regulations of contractual representation with regard to the proposed regulation in the new Civil Code draft

LEGAL COMPARISON OF REPRESENTATION GRANTED BY THE PRINCIPAL UNDER THE CZECH AND GERMAN CIVIL CODE WITH REGARD TO THE PROPOSAL OF A NEW CZECH CIVIL CODE Legal representation (agency) belongs to the most important legal institutes within the private autonomy of each person. Acting on behalf of the principal, the representative (agent) has the authority to affect directly the legal position of the principal. The valid Czech Civil Code of 1964 regulates this legal institute in only a few provisions, the commentaries on this Act and civil law books deal only with the basic information and there is not a single Czech monograph on this topic. It may invoke that this institute is not the complicated one but this would be fully wrong. There are many questions regarding the relationship between the principal and the representative or between the representative and the third party. A lot of problems are traditionally caused by the legal authority, its scope and ending. In order to create a modern private law in the Czech Republic, which should put an end to the legal development of the past decades influenced by socialism, a new Civil Code should be created. This gives a chance also to a better regulation of agency adequate to the right of people to determine their private sphere and to the protection of third parties...
New trends in the Science education at primary schools

The present diploma thesis concentrates on the usage of inquiry based education in the primary stage of education in the course of teaching science. Attention is firstly given to the students' skills which this type of education utilizes and without which it would be impossible to apply it in practice. These skills are analyzed on a theoretical level and consequently, by means of a didactic test, are practically tested with pupils at primary school level. Another part of the thesis are materials for selected science topics which evolve from the inquiry based education principle. The topics are chosen in accord with the official educational programme of the Czech education systém and contribute towards a more effective educational process and the heightening of the interest of students in science. This bachelor thesis is based on the results of TIMSS and PISA tests and their outcomes related to science education in the Czech Republic. It compares traditional education with inquiry based education, which is considered a perspective teaching method in connection with developing pupils command of science. The condition for applying this method is among other aspects the development of skills required for enquiry based education in all stages of education. This thesis focuses on investigating if primary school pupils have attained these skills. For this matter, primary school science textbooks vere investigated and a survey investigating attainment of these skills was carried out at primary schools.
