Race and Equality from the Perspective of Law
Šipkovská, Silvie ; Kühn, Zdeněk (advisor) ; Wintr, Jan (referee)
Race and Equality from the Perspective of Law In this thesis, the author deals with the phenomenon of racial discrimination from the perspective of law. In order to understand the issue, it is necessary to set discrimination in a broader socio-scientific context. Therefore, the author draws not only from legal sources, but also from other social sciences. Other important sources of information were the reports and recommendations of non-governmental organisations, which play an important and irreplaceable role in the area of anti-discrimination policy and its implementation. The main focus of this thesis, therefore, is comprehensive treatment of the issue, taking into account its interdisciplinary context. The content of the thesis is divided into four parts. The purpose of the first part is to introduce the reader to the issue of discrimination and explain the basic concepts of the theory of race, equality and discrimination. The second part details the international mechanisms of protection against racial discrimination - in the framework of the United Nations organization, International Labour Organization, Council of Europe and the European Union. The third part describes the national system of protection against racial discrimination according to the hierarchy of national sources of law, i.e....
An analysis of the decision making of the Office for the protection of competition
Šipkovská, Silvie ; Ochrana, František (advisor) ; Stehlík, Petr (referee)
The thesis deals with the nature of the decision-making of the Office for the Protection of Competition (hereinafter "the OPP") in the area of public procurement. The theoretical part describes the various methods used, the legislative framework for the decision-making processes of the OPP (from the point of view of the currently effective legislation and the new Act on public procurement), and summarizes theoretical assumptions. In the analytical part, selected decisions of the OPP from the years 2005-2015 are analysed, using descriptive and interferential statistical methods. In terms of the subject matter, the OPP most often conducts proceedings in relation to complaints against alleged violation of the prohibition of discriminatory practices. Decisions of the OPP are challenged before administrative courts in only 4% of cases, in spite of the fact that contracting authorities are found guilty of committing an administrative offense in almost 80% of the cases. Commonly imposed penalties are fines. The trend of decisions on guilt, as well as the imposition of fines, is growing, however, the level of fines remains unchanged. A contracting authority which awards a public works contract is more likely to be found guilty than a contracting authority awarding other public contracts. It is also more...

Education and crime - the economic view
Šipkovská, Silvie ; Vyhnánek, Tomáš (advisor) ; Adam, Tomáš (referee)
In her thesis, the author addresses the relationship between education and selected types of crime (economic, property and violent crime) in the context of the national economy. The aim of the thesis is to show that the relationship between crime and education is much more complex than it may appear on the basis of current findings and observations and that, besides education, the criminal career of an offender is also significantly influenced by his/her family background and, therefore, it is appropriate to include this factor into the analysis. The analytical section of the thesis is divided into two separate parts. The first part, which deals with the phenomenon of crime in general, describes the dependency of individual crime types, education and family background by means of tables and diagrams showing percentages of individual variables and using contingency tables and correlation tables. The analysis confirms that there is a significant relationship between crime and the combination of education and family background. This hypothesis, however, manifests itself only in respect of certain types of family background, namely the backgrounds described as "working class" and "intelligentsia". The second part is devoted to recidivism as a particularly negative phenomenon -58% of offenders in the analysed...
