- English The topic of my thesis is limitations and exceptions to copyright. It describes the ways of use of copyright without author's consent. Specifically, I talk about the free work, free use and statutory licences. The provisions must always be interpreted in accordance with the three-step test described in a separate chapter. I focus especially on issue of orphan works. Of course, I also deal with an issue of copyright in general and its sources.
Licence agreement in the legal systems of the Czech Republic and England and Wales

The objective of this diploma thesis is to render a comprehensive analysis of licence contracts in two countries - the Czech Republic and England and Wales. The effort to highlight differences between the two scrutinized jurisdictions and related criticism are the most important methods applied in this work and, hopefully, the most recognizable benefits of it. The thesis consists of a short introduction, followed by four descriptive chapters and author's subjective conclusions. The introductory part presents methods of research used throughout the work and implicitly hints what can the reader except when studying this diploma thesis. The first chapter splits into two mutually linked subchapters. The first one defines the very term licence, its etymology and classification. The following subchapter describes general characteristics of intellectual property, a crucial topic to licence contracts and thus indirectly to this thesis. This thesis promises a comparison of two legal systems and the second chapter fulfils this aim. Consisting of two additionally divided subchapters, the author engages in an analysis of the copyright and patent law respectively. (EN) Primary focus of this thesis is the copyright protection of databases. This thesis introduce the copyright protection of databases as an essential element of two pillar system of European Union database protection law that is based on the directive no. 69/9/ES on the legal protection of databases. First five chapters of this thesis are concerned with general questions related to the copyright protection of databases. Purpose of these chapters is to introduce roots of legal and other nature from which the copyright protection of databases arises. This part of the thesis thus defines the phenomenon of databases in relation to information society, available means of protection, the purpose of legal protection of databases, the legal framework and relevant legal traditions. Subject of sixth chapter is the definition of database as a specific category of work and compares it with other kinds of works with the emphasis on common and distinctive characteristics. Seventh chapter focuses on elementary features of the copyright protection of databases, ie. structural protection, concept of originality and rights related to the creation and the use of databases. The Development of Copyright Law In Photography Since 1948

This work is concerned with the historical development of copyright issues in the field of photography since 1948. Its goal is to search for concrete connections in the development of photographic copyrights worldwide, and in the local Czech context. Currently, photography touches all aspects of human activity, and because of the this, a historical analysis of this development of protection is necessary to completely understand photography?s current, contemporary position and direction. For this reason, several historical court cases have been included, which have been key in the fight to legitimize photography as an art, and crucial in giving legal recognition to the photographer as an author of a work, protected by law.
