Application of Combinatorial Auctions on Public Procurement

The public procurement draws a lot of attention in terms of treatment with public resources. Unfortunately this attention has mostly negative character. The aim of this Diploma Thesis is to bring an untraditional overview on the processing of public procurement and introduce one of the modern ways of using auction mechanisms. Combinatorial auctions can, as it already happened in other areas, open new possibilities for contracting authorities and bidders who participate in procurement conducted in accordance with Czech legislation. Also this Diploma Thesis can be the inspiration for thought if the current rules for public procurement are in accordance with the best interests of contracting authorities and bidders. In order to present the application of combinatorial auctions on public procurement the mathematical model based on partially real data was compiled in software Lingo. The results of such model were used as the source for the effectiveness analysis of discussed topic.

Expenses and risks of participation in public procurement for suppliers This bachelor thesis is interested in the expenses and risks of participation in public procurements for suppliers. I will introduce basic theoretical terms of public procurement law and then focus on specific issues of expenses and risks in public procurement for suppliers. The following section looks at the research undertaken on the most common expenses and expected risks within the field of public procurement. I will be discussing detailed analysis of these areas. In the final sections I will consider various possibilities to minimize the expenses and risks of public procurement and also formulate recommendations to improve the current situation within the field.
Corruption and public contracts in the field of ICT

The bachelor thesis deals with the problem of corruption and public contracts in the field of ICT. The work focuses on the corruption situation in the Czech Republic, generally on corruption and laws relating to public contracts. The goal of this project was to unify the information on public procurement and to demonstrate the corruption situation in the Czech Republic on particular examples. The work presents to the analysis of the individual contracts uncovering of corruption in these cases and making proposals to improve the situation in the form of amendments to the Public Procurement Act. Meeting these goals required the search for information on suspect contracts on the Internet, browse closely the Public Procurement Act and the knowledge of the author's own experience. In the introductory part the author defines the concepts of law in the field of public procurement, laws and regulations dealing with public contracts, the authority supervising the Public Procurement Act, procurement processes in various types of contracts and the work of anti-corruption police departments. In the following section of the theoretical part, the author discusses the general problem of corruption and corrupt practices in the field of ICT .The analysis of Public Procurement Act is the last chapter of the theoretical part of the work. In the following practical part, the author discusses several examples of contracts that have been or have not been proven corrupt or illegal and compares expenses of the ICT projects in the private and public spheres. In the last chapter, after obtaining all available information, the author proposes several ideas for improving The Public Procurement Act The author's contribution of the work lies in a clear summary of information, referring to the errors in the procurement processes and then in the analysis of the situation of the "suspicious" cases and detection of illegal conduct, in these cases. The author came to the knowledge that allow the conclusion to summarize in a few paragraphs incentives for the development of amendments to applicable laws of the relevant authorities.
The Law on Public Procurement and Procurement Experience in the Czech Republic

The subject of this thesis focuses on Public Procurement, precisely on the structure of legal regulations. This thesis broaches certain issues of the law, imperfections in the law and how the law is interpreted in practice. The aim is to understand the deeper issues of these legal regulations. The backbone of this legal regulation is the law 137/2006 Coll. on public procurement. This law is one of the preventive legal standards; among other purposes it prevents wastage of public funds. However, ensuring flawless application of The Act is not as easy a task as it would seem at first sight and the second part of this thesis is therefore devoted to identifying the most common errors in application of this law. Decisions of the Office for Protection of Competition, consultations with experts, and case studies were used for identification of these errors and common types of misconduct are also presented. The conclusion will deal with the amendment to the Public Procurement Act.
Modern Methods in Quantitative Marketing Research

Private business subjects are characterised by their continuous effort for increasing their market position. Therefore they are permanently monitoring their own sthrengths and weaknesses, and they are also monitoring their competitors´ behaviour and customers´ needs and wishes. Such pieces of information can be received by analysis of business surroundings and from custommers´ opinion. Activities like these are called marketing research. The research should include all aspects that influence the way of perception of the company by any other market subject, or even the atmosphere inside the company. Information received is valuable for managers and their decision-making. Marketing research is a dynamicly developing field where new findings of social sciences are permanently applied. A significant developement in this field was reached mainly in last years. It is a result of the rapid progress of information and communication technologies. Modern forms of marketing research often use the Internet for collecting various information on the market.
Contracompetitive decisions of contracting entities

The thesis deals with typical decisions made by contracting entities which restrict the competition among economic operators. The thesis analyses the typical mistakes which are made by the contract entities in awarding procedures. The causes of mistakes being made by contracting entities can be summarized into three groups. Into the first group belong conscious mistakes. For these mistakes shall be contracting entities` agents held responsible. Into the second group belong mistakes in planning. Mistakes from the third group are made as a consequence of lack of professional skills. None of these mistakes can be prevented just by an amendment to the Act on Public Contracts. Any proposal of an amendment solving the lack of professional skills shall consider also all connected negative effects; mainly additional time demands, financial costs and the risk of underfinanced praxis turning into formalism. Professionally skilled agents are usually more careful when they apply the Act on Public Contracts because they are aware of legal risks. Considering current limited budget resources it should be decided whether to put stress on cooperation with internal or external experts. The author recommends internal experts because external experts do not do their best if they are aware of the fact being not controlled effectively by internal experts. However the current Act on Public Contracts is not perfect, the duties laid by it are enforced successfully. Considering a new amendment also the legal theory shall be taken into account. The author presumes similarity of preventing of breaches against the Act on Public Contracts and of preventing of crimes. The most important factor preventing from criminality is to be aware that the punishment is inescapable, not its rates. The author points out also the opinion of the general theory of law according to which a new act is to be passed only if there is an objective necessary need. It should not to be passed by a fortuity or because of subjective views. There should be also a time space between the amendments. There was an amendment to Act on Public Contracts approved in 2010 and European Union currently prepares amending of awarding directives. The author therefore prefers improving the praxis of awarding in the Czech Republic by granting additional human resources to the Office for the Protection of Competition to passing of another amendment to the Act on Public Contracts. The scope of the Act on Public Contracts is also not convenient for amending a list of contract clauses which are not allowed to be concluded by contracting entities. There are two reasons. Contracting entities are constituted by various groups of subjects and contracts selling their property are outside the scope of the Act on Public Contracts. Contracting entities should use standard awarding procedure to promote competition among economic operators. They should concentrate on exactness of tender conditions. A good prevention to mistakes in awarding procedure is also good planning and skilled human recourses of contracting entities.
The Community planning of the social services for seniors in the region Milevsko

The thesis looks in detail into the process of social services community planning in the Milevsko region. It shows that there are very good conditions for further development of community planning, however - as the thesis points out - social services are qualitatively not sufficient, and they are not distributed equally in the whole region. The thesis suggests several steps towards the improvement of social services community planning in the Milevsko region.
Audit system and contracting of public procurements

The aim of the thesis is to analyze the audit system of public procurements and to evaluate whether the audit system is sufficient. The first part focuses on contracting authority and regulations which must be complied with to act upon the public procurement law. The second part characterizes the segments of audit system which proceed in the connection with the public procurements contracting. The last part deals with the real state of execution of the public procurements audit in the state administration and its evaluation.

První část je zaměřena na definování základních pojmů a vztahů souvisejících s problematikou partnerství veřejného a soukromého sektoru. Druhá část se zabývá procesem projektu (typy a formy realizace). Třetí část je věnována výhodám, nevýhodám a analýze možných rizik. Čtvrtá část obsahuje analýzu současného stavu realizace a využití PPP projektů, kde jsou zároveň uvedeny i příklady. Pátá část se prakticky zabývá příkladem návrhu pilotního projektu ? dálnice D3 (Tábor ? Bošilec).
Analýza zadávania a hodnotenia verejných zákaziek na príklade municipality v Slovenskej republike

Cílem první části práce je stručná pojmová a obsahová analýza zákona č. 25/2006 Z.z. o verejnom obstarávaní. V práci je obsažena i analýza základních hodnotících metod používaných při ohodnocování veřejných projektů a zakázek. Praktickou demonstrací poznatků, metod a postupů popsaných v teoretické části práce je zpracování a rozbor veřejné zakázky realizované konkrétní municipalitou. Následně je provedeno i vlastní ohodnocení této zakázky s využitím komplexního kritéria hodnocení. Závěrečná kapitola je věnována zkoumání problému vyhledávání renty (rent-seeking) v souvislosti se zadáváním veřejných zakázek.
