Main Legal Issues in the Real Estate Practice

When after 1989 in our country have discovered the first real estate brokers and agents, were more or less a new professions, at times of socialism not existing. Since then have more than 2 decades passed, it will be interesting to compare the current state of the neighboring countries. First I will focus on the close one, Slovakia and then Austria, which belongs to the developed property market. I will look at various options of real estate agents and their functioning in all 3 states. The issue of legal liability of real estate activities will be submitted to the critical analysis and all the lessons learned will bring into mutual comparisons. I will also address the association of Realtors and appraise their position and function in different countries. An interesting part of this work will be determination of public opinion on public awareness of the importance of real estate services, I have made this research through polls.

1 Insurance Agent Abstract The topic of this thesis is the insurance agent, as one of the types of insurance intermediaries pursuant to Act No. 38/2004 Coll., On Insurance Intermediaries and Independent Claims Loss Adjusters. Insurance mediation is a relatively current issue, which is presently under discussion, especially regarding to the Insurance Distribution Directive (IDD) and its implementation into Czech law. In this work the existing legislation is not only described, but also my professional experience with the examined issues is applied and provided commentary where relevant. The thesis is divided into nine chapters, including the introduction and the conclusion. The introduction is followed by historical development of legal regulations, both in Czech Republic and within the European Union. Then the thesis is focused on the insurance agent itself, first by defining him and the conditions for being registered as an insurance intermediary. Subsequently specific conditions of the insurance agent's activity are dealt with, having a special focus on the obligation of the insurance agent to act with professional care. Public law aspects of providing credits for consumers

This paper deals with legal regulation of providing and mediation of credits for consumers with respect to public law. The most important goal of this regulation is to protect consumers. This thesis analyses an act, which came into effect about 1 year ago transposing a directive regulating credit agreements for consumers relating to residential immovable property and a directive regulating other credit agreements for consumers, evaluates its suitability, considers its imperfection and proposes appropriate changes. The paper is divided into 4 chapters according to the structure of the Act No. 257/2016 Coll. on consumer`s credit. The first chapter analyses what exactly shall be considered as the consumer`s credit and defines four essential features of a credit for consumers as it is construed in this Act. The second chapter deals with requirements for obtaining permission for those entities who apply for permission for providing or mediation consumer`s credits, describes possible structures of representation of these entities and potential offence liability, which can be imputed to the represented entity.
