Protection of three dimensional trade marks and designs

Resumé Protection of Three-Dimensional Trade Marks and Designs The aim of this work was to examine the registration requirements of three- dimensional trade marks and designs, to compare the rights and protection conferred by each of these forms of intellectual property and to observe the interaction of trade mark and design when their subject matter is identical or similar. First part of this work focuses on the questions regarding the registration requirements of the three-dimensional trade marks. The work looks closely on what constitutes a sign and which absolute grounds for refusal of registration are mostly employed when dealing with the three-dimensional trade marks. Furthermore this work looks at exclusion of registration of certain types of shapes, on the requirement of good faith when applying for trade mark registration and briefly at the average consumer. The landmark cases cited in this part of the work are Dyson v Registrar of Trade Marks, Philips v Remington, Henkel v OHIM, Lego v OHIM and Lindt v Franz Hauswirth. Second part of this work looks at the definition of design and its relationship to product itself. in English Fashion Law This rigorosum thesis carries the name of the recently established field of law. The fashion law has to uphold its status through fulfilment of the field-specific criteria; therefore, the fashion law is introduced on the background of a three part conceptual classification - fashion business law, fashion public law and fashion intellectual property law. The first chapters are dedicated to the establishment of the fashion law with respect to its wide academic acceptance. The second chapter outlines fashion business law with a special view to intellectual property licensing, due to its influence on the reputation of the fashion companies, which is crucial in such a competitive field. The topic of fashion public law is included as well in the second chapter as a necessary part of the legal field which might provide an alternative look at the issue of protection of the fashion companies' intellectual property. The entire third chapter addresses the fashion companies' intellectual property: patents, copyright, fashion designs and trade marks as suitable forms of protection of fashion designs and fashion brands. The modification of the product and its impact on financial indicators

The main purpose of diploma thesis named The modification of the product and its impact on financial indicators is to design products respectively. services worthy modifications to recalculate the costs and returns of this modification, and consequently its total return for recreational and gastronomic company operating in tourism. The theoretical part of this thesis contains definition of fundamental termsand market research through questionnaire survey, which aims to characterize the structure of the company and obtains from its customers their designs products. Afterwards the results of survey will be interpreted. At the end of the thesis, in cooperation with the management of the company, the effects of modifications on financial indicators will be analyzed to define if the modification is the desired effect .Analyze the effects of modifications is the main objectives of this thesis.
