Building law environmentalisation - status quo and perspectives

The dissertation deals with a phenomenon called building law environmentalisation. The aim of this thesis is to analyse the basic factors leading to the entry of environmental influences into the processes of public building law on the basis of legal regulations, doctrinal opinions and very extensive case law of the administrative courts. The main content of the thesis is the analysis of these factors and the subsequent generalisation of the conclusions of the analysed phenomenon. The thesis answers the question: what is the extent to which is the current public building law influenced by "environmental acts"? Thus what does specifically influence the processes of public building law by environmental law and what is the extent of this influence? The text of the dissertation is divided into seven chapters. The first three of them can be perceived as a gradually concretized general framework of the problem, from the initial facts about the EU legal requirements, through the basic characteristics of the building law to the detailed analysis of the individual administrative tools ("final" administrative acts) of building law. Managerial Evaluation of the Preparation for Construction of the Pond

The thesis disserts the decision making during the construction of a pond as water management source mainly focused on pre-implementation phase and the associated financial costs, from the decision of investor (builder), through appropriate site selection, to project preparation and selection of the contractor. The thesis marginally mentions the realization of the construction in terms of financial costs. In the practical part of the thesis, there is simplified procedure for pre-implementation phase, qualified estimate of the financial costs and the thesis also focuses on the selection of contractors and conditions that are related to the selection. The main contributions of the thesis is to introduce the issue of water management pre-implementation phase of construction of a pond, the procedure and conditions for decision to build a pond by the investor or hired individuals by the investor. Another practical part presents the percentage appreciation of the construction as a whole, which is divided into the costs associated with the appropriate site selection, project documentation, as well as costs associated with the purchasing of land and the cost of the construction itself. The results of this analysis showed that the avarage financial cost of 1 ha are 1,93 mil CZK. The main finding is that under these financial information is not easy to decide, because even two ponds with the acreage of 3,5 ha could have different budget, depending on the different local conditions. The guiding elements are particularly choice and suitability of the site for the construction. The final finding is, that the financial budget of the whole construction is divided into several parts. The part of pre-implementation, where is included the costs of site selection, land purchasing and project documentation, which is 9,4% of the total cost. The remaining 90,6 % of the cost is spent on the construction, which, based on the financial analysis, is the most costly.
