Representation upon a Power of Attorney

The aim of this thesis is to clarify the legal regulations of the institute of the representation with an emphasis on the representation upon power of attorney (contract representation). Thanks to the extent of this work it is impossible to encompass the whole matter of the representation in a way that would be worthy of an analysis. In this thesis it is written about the historical roots of the legal regulations of the representation which are already enshrined in Roman law. The main part of the adjustment is de lege lata. The general adjustment of the representation has to be searched in the valid and effective Civil Code (The Law No. 40/1964). We can meet the partial legal regulations in other branches of the legal code too, for that reason other legal statutes related to the topic of this work are discussed. The thesis deals with the application problems in practice and numerous law cases of the law particularly of higher courts. The attention is also focused on two initiatives within the European Contract Law - the Principles of European Contract Law (PECL) and the Draft Common Frame of Reference (DCFR). Representation The thesis on the representation is aimed generally on the institute of representation, basic concepts and resolution methods of representation. Given the scope of the thesis is not possible to cover discourse about all forms of representation and therefore is focused on substantive representation, whether contractual, statutory representation and other specific forms, especially human guardianship and guardianship of legal entities or representation of legal entities. In the thesis are included as information on the historical development of the Institute's the representation, especially since the general Civil Code and therefore early 19th century and comparison of current legislation contained in the Civil Code of 1964 and the new Civil Code, effective from 1 January 2014. Raised the major changes that will occur in the near future in the regulation of the representation, as well as outline the basic problems that this adjustment could bring in the practice of law. Is also pointed out to adjust representation in European law, konrkétně the Principles of European Contract Law and the Draft Common Frame of Reference.

Diploma thesis - Department of commercial law Procuration as a type of representation in business relations abstract The opening of diploma thesis on the given theme deals with the ways of action of an entrepreneur including it's forms and especially concentrates on the entrepreneur's acts according to § 20 of the Civil Code. Chapter two deals with the institute of representation and briefly try to outline the legal representation of entrepreneurs-legal entities according to the Commercial Code. The major part concentrates on contractual representation and proxy which are subsidiary applicable to the procuration according to § 1 paragraph 2 of the Commercial Code. The first and second chapter forms a necessary basis for the next part of the thesis. A third chapter of the thesis deals with the history of procuration. Chapter focuses on the progression of legislation in the Czech lands since 1863 when the Austrian Commercial Code was adopted until 1st January 1991 when the Czech Commercial Code was adopted. REPRESENTATION This theses focused on representation in term sof civil law, family law and business law. This issues is processed komplex and contains all the basic attributes of representation. Theses is based on current treatment of private law and it highlights the changes in new civil Code effective since january 2012. It evaluates legislation in comparison with future changes. It refers to mootness, uncertainties and inaccuracies contained in the current Civil Code. The work focuses on the representation in general and its different types based on the Civil Code. It also contains a modification in the representation of the Commercial Code, which focuses on representing corporate and procuration. The presentation draws on family law representation and guardianship of minors, guardianship.

The Master's degrese thesis analyse the institute representation in the civil materiál law. It characterises representation globally and tries to digestedly make general scheme which is made on the basis of the legal regulations and second bibliography. The representation in the civil material law could be resolve into the different subsets according to the various conditions. On of the possible ways of the dividing is direct and indirect representation. Indirect representation could be defined as acting of the representant in his own name on behalf of the represented person. Direct representation is acting of the representant in the name of the reperesented person and on its behalf. The rights and the duties come up directly for the represented person. 1 Abstract Representation This thesis concerns the institute of the representation in effective legislation of civil law particularly in the Act no. 89/2012 Coll., Civil Code. This institute is very important for each person, no matter it's age or profession, because everybody in his live needs to use the representation. Not only have I focused in my thesis on the part of the Civil Code which is called representation, but also on the other parts that contain representation as well. My thesis is divided into nine chapters, in which I am dealing with representation based on the decision of the court as well as the contract or the law. At the beginning my thesis describes historical basis of representation and also short glimpse to the previous legislation. The next chapter deals with chosen types of the representation that are not regulated in the chapter III of the Civil Code, but I also consider them as really important and very useful in practice. The most of the thesis is focused on the part of the Civil Code that is named the representation. Firstly general provisions are described where I specially focus on the power of attorney, its form and necessary provisions. The diploma thesis aim was analysis of established plantation Silver fir, European beech and natural regeneration of other tree species to Training Forest District Hůrky, Secondary Forestry School Písek. It was after bark beetle disaster. This diploma thesis goes from bachelor thesis: Evaluation of the artificial regeneration of Silver fir and European beech at Training Forest District Hůrky, Secondary Forestry School Písek. Density, share, height, root colar diameter, last increment of height and losses each tree species was find out within stand. 3120 trees was measured in 2013. It is about 467 trees less than 2011. Natural regeneration Scots pine had the biggest losses (29,4 %). Probably it influence on competition. Total losses to artificial regeneration silver fir was 56 %, of which 1,6 % to last two years. The most prefer tree was Scots pine -- 33,4 % and Douglas fir 32,3 %. Silver fir had only 15,3 % from total share. Density trees (Scots pine, Douglas fir, silver fir, European beech, Norway spruce, European larch, sessile oak, cherry, white pine) was 16 830 pcs/ha. The higher height increment had sessile oak (70,1 cm), on the other hand lower height increment had Norway spruce (19,6 cm). Result of this measured is, that silver fir and European beech had not regenerated. Because natural regeneration was domination than artificial regeneration. In current time, it can states, that culture meet all parameters of established plantation.
Development of gender´s policy in the area of Evropean Union and its prediction

Gender equality is a very important social value, which has a long-lasting tradition in European Union and it is a necessary condition for the achievement of its goals. This thesis deals with the topic of women representation in politics, particularly in European Parliament and national parliaments in European Union. The fact that women have found their way into European Parliament is evident. In 1979 only 17% of all parliament members were women and nowadays they represent more than one third of all members of the Parliament ? 35%. The representation of women in national parliaments is lower than in European Parliament and it differs in particular countries. In 2000 the representation of women in national politics reached 18,3 %. Throughout various periods no decline has been registered and in 2010 the representation of women in national politics reached 23,6 %. The comparison of the development of the representation of women in politics according to the state systems is interesting. Concerning national parliaments, the best results have been achieved in European kingdoms. The optional partial quotas are employed to increase the representation of women in politics within the frame of European Union. The long-term goals have been set to indicate further development and criteria that should have been achieved. The present idea is to reach at least 25% representation of women in national parliaments in all member states.
