Expulsion of Aliens on National Security Grounds in the Context of International and European law

This study deals with the expulsion of aliens in modern international and European law. I have focused on the particular ground for the expulsion, i. e. national security, in the context of the States' obligations under some selected international human rights instruments and the relevant European law. National security is one of the generally accepted grounds for the expulsion of aliens, but the content of this term is not strictly defined. As a consequence of this lack of clarity national security may be abused by States. I focused on such abuse in the process of expulsion when States use the exception of national security as a reason for not allowing aliens to benefit from the procedural guarantees provided by international law. There have been two kinds of abuse of the national security term with respect to the procedural rights of the expelled persons found in this study. First, States expel aliens forthwith without giving them the opportunity to submit reasons against their expulsion or have their case reviewed by a competent authority also in cases when the exception of national security is indefensible. Administrative expulsion of factual Nationals Abstract The aim of the processed topic is to point out the specific situation of people who were born in the Czech Republic or who lived here for a substantial part of their childhood so that they are fully integrated. The issue stems mainly from the regulation of citizenship as a formalized legal institute creating the relationship between the individual and the state. Although citizenship and social integration correspond in most cases, in the case of persons who are referred to as de facto nationals in this thesis, there is a split between the actual social life of the individual and his / her citizenship. The aim of this thesis is to focus mainly on the situation of those de facto residents who are subject to administrative expulsion as an absolutely essential legal institute aiming to end their stay in the Czech Republic, even with the means of state coercion. This topic is currently being updated and to my knowledge it has not been elaborated in the doctrine so far. Until 1989, the Czech Republic was a strongly homogeneous state that had no experience of larger migratory increments like other, mostly Western European, states. This diploma thesis attempts to capture the importance of the literature of fiction as a phenomenon necessary for the understanding of today's world. It points to the contribution of Kateřina Tučková's and Olga Tokarczuk's writings, which can help readers to relate historical events to today's reality. Whether it is the book "Vyhnání Gerty Schnirch", which deals with the expulsion of German inhabitants from the Czechoslovakia after the Second World War, or the story of the goddess of Kopanice in the times of the communist regime in the book "Žítkovské bohyně". The book "Knihy Jakubovy" by Olga Tokarzcuk tells us the fate of the self-proclaimed Jewish messiah Jakub Frank and his followers in 18th century Poland. Further, this diploma thesis deals with the world of literature and readers of our time and the possibilities that the world of books can bring to us and our children in today's over-technological time.
