Crime Reporting and its Criminological Significance Abstract The subject of this thesis is the interdisciplinary issue of crime reporting and related latent criminality, especially from the criminological, victimological and criminal-positive perspective. The diploma thesis is divided into four parts that as a whole are intended to answer the question whether the Czech legislation is sufficiently effective in contributing to the achievement of low figures of latent criminality. The first part is devoted to the definition of the key concepts of this thesis and the question of what are the most common factors determining the decision of certain persons to report a crime to law enforcement authorities. The answers to this question are then provided mainly by the examination of the fields of criminology and victimology. In the second part I examine in detail the criminal law regulation of the institution of crime reporting. This part contains chapters on the procedure prior to the initiation of a criminal prosecution, the filing of a criminal complaint itself and its significance, and the actions of law enforcement authorities related to the filing of a criminal complaint. Criminal Complaints and its Significance in Criminology Abstract Criminal reporting is the most important source of initial information on criminal offences for law enforcement authorities. The number of filed criminal complaints and the willingness of the public to report crimes affect the number of initiated criminal proceedings, prosecutions and convicted offenders, i.e., the fight of the state (or society) against crime, directly. The institute of criminal complaints is examined in terms of law, criminology, sociology, and psychology. Finally, the real role of criminal complaints in the fight against crime is identified through statistics. The topic of the thesis is the criminological significance of reporting crimes. Within the thesis, the concept of criminal complaints is introduced and legally classified as a way in which the law enforcement authorities learn about the facts indicating that a crime has been committed. The requirements of the criminal complaint and the consequences of any formal and content deficiencies are mentioned, too. There are also discussed the obligations to make and receive a criminal complaint, the procedure, and ways of settlement, but also to the unlawful acts which the reporters may commit when making criminal complaints. Aneta Kubínová: Reporting of Crimes and Significance of Reporting in Criminology, 2016 Abstract: A criminal complaint is an instrument of criminal law, which allows the public to participate on suppression of crime. Furthermore, a criminal complaint is the most common mean how the criminal justice learns about committed crimes. This master thesis aims to cover the topic of reporting of crimes via a criminal complaint in the legal system in Czech Republic. The thesis is divided into six chapters. The first chapter covers the basic principles regarding the reporting of crimes in the Czech Republic. The subchapters revolve around criminal law principles relevant to the submission of the complaint, registered and latent criminality and perspective of the victim of reported crime. The second chapter studies the legislative requirements of the reporting of crimes in the Czech Republic, which is mostly regulated in the Criminal Procedure Code. The subchapters focus on a criminal complaint viewed as an incentive for criminal prosecution and on the formal and content requirements. The third chapter examines the preparatory proceedings of prosecution. This thesis deals with the reporting of criminal offenses both in terms of individual and procedural criminal law, and from the point of view of the importance of this issue in criminology. The thesis is divided into ten chapters. The first chapter describes the role of reporting criminal offenses in criminal proceedings. In particular, it deals with the status of the procedure for initiating criminal prosecution in criminal proceedings. It then deals with the very aspects of the procedure for filing a crime report, in particular with crime reporting, its formalities, options in filing a criminal complaint, and procedures following the filing of a criminal complaint, while it points out the issue of imposing the act of closed file. Chapter two highlights the rights of the complainant, the injured and the victim in connection with the reported crime. This chapter addresses issues with informing the injured person or victim at the point of crime reporting. Furthermore, this chapter deals with the right of the complainant to an effective investigation. The bachelor thesis deals with the child support, and in particular the child support parents to children. The theoretical part describes some of the basic concepts, discusses the social function of maintenance, describes the impact of divorce on children, lists the types of maintenance on the creation, modification, termination and child support of parents to children and further defines the scope of child support. Subsequently, the paper deals with the recovery of maintenance and performance penalty. The practical part is finding reasons non-maintenance, non maintenance impact to the beneficiaries, how they differ or agree the views of professionals and how they may be specialist beneficial in preventing the offense of neglecting child support.
