The scope of liability to damages under the Commercial Code

The following diploma thesis is called "The scope of liability to damages under the Commercial Code". I have chosen this theme because the damages are one of the most important legal instrument and in accordance with the actual practice of the courts and legislative development also a dynamically developing part of the civil law with perspective on the new attitude to this instrument with respect to the draft bill of the new Civil Code. The aim of the thesis is to acquaint the reader with the current legislation, compare current legislation with respective court decision and opinions of the juristic community and offer new look on the issue. The thesis is divided into seven chapters. The first one is a preface and defines the matter of thesis. The last one is a conclusion and contains the final look on the scope of liability to damages under the Commercial Code and the brief review of conclusions contained in the thesis. Chapter Two deals with legal regulation of formation of the liability to damages and is composed of three parts, each of them is dealing with different matter of this formation. Thesis on Management claims handling process in order to optimize the indemnification with respect to client satisfaction deals with determining the reasonable costs of indemnification of damage to motor vehicles. It defines processes liquidation process in relation to the legislation, client satisfaction and the actual state solution claims. The practical part of the thesis deals with expert analysis of the resolution of insurance claims, defining new procedures and methods in the process of liquidation, evaluates and analyzes client satisfaction. The aim of this thesis is the statistical analysis of the impact of new measures liquidation process, ensuring the profitability of individual products while maintaining customer satisfaction.

Změny v likvidaci pojistných událostí vyplývající z nového Občanského zákona

The thesis focuses on the issues of liquidation insured events on vehicles from car instance which is associated with new law of number 89/2012 Sb., the civil code. It describes the changes that arose with the accession of the new civil code as opposed to old civil code no. 40/1964 Sb., which was valid until 29th December 2013. There is described a process of liquidation and specific changes in determing the cost of repairing the vehicle and calculate the real damages. Based on the information suggests a means for assessing the effectiveness of the repair costs.
The influence of compensations for damages occurring during tax administrative procedure on administrative expenses

This diploma thesis deals with compensation for damages occurring during tax administrative procedure due to maladministration or unlawful decisions. The main aim of this thesis was to disclose influence of compensations for damages and administrative expenses of compensation procedure to the state's budget. Thesis concerns legal frame of compensations for damages, the first part of the compensation procedure which is held by the Ministry of Finance of the Czech Republic, specifically analysis of number of submitted applications for compensation, extent of acknowledged compensations and the most frequent reasons for acknowledgement of compensation. Further thesis deals with court proceedings and recourse against civil servants, which are eligible of causing damages. Significant part of thesis focuses to the estimation of administrative expenses spent in connection with compensation procedure and compares these expenses in years 2010 and 2011 considering the change in organization of state administration since 1. 1. 2011.
