Bednářová, Marina ; Tlapák Navrátilová, Jana (advisor) ; Galovcová, Ingrid (referee)
Unconditional imprisonment Abstract This diploma thesis deals with the legal institute of unconditional imprisonment. This type of punishment will always be a current issue due to its specific position, because it is, within criminal law, the only primary type of criminal sanction for violation of legally protected interests and, at the same time, it can be imposed for any criminal offense. The addressees of the law also perceive it as the harshest punishment that can be imposed on perpetrators of crimes. The legal regulation of this institute is very detailed but also somewhat fragmented, so the goal of this thesis is to provide a complex and comprehensive picture of this institute, with many partial parts presented by statistical data to better demonstrate the issue. The first chapter of the diploma thesis is devoted to the theoretical concept and definition of unconditional imprisonment, which includes its historical development on the territory of this country and also presents alternatives to unconditional imprisonment, as well as conditional imprisonment. The next part of the thesis focuses on the sentencing to unconditional imprisonment, which can be divided into two parts, the theoretical part includes the principles of sentencing, mitigating and aggravating circumstances and sentencing of specific...

This diploma thesis deals with the aspects of unconditional imprisonment. Unconditional imprisonment, as a term of criminal law, is the most severe punishment used in the Czech Republic, it is also a universal punishment that can be imposed for any crime. Imprisonment is executed in a prison with security, in a maximum-security prison, or in a special unit of remand prison. The rights and obligations of convicts are governed, in particular, by the Act on Imprisonment and Imprisonment Rules. Various educational programs and leisure activities, as well as the employment of the convicts, are carried out during the execution of the imprisonment. The institute of conditional release is an important instrument for the reduction of the prison population, yet it is underused. The prison problems are especially a high number of prisoners, overcrowded prisons, low financial literacy and high indebtedness of convicts, substance abuse problems, cumulative prison sentences and prisoners' pay-to-stay fees. The number of convicts per 100,000 citizens and recidivism rate are used to assess the effectiveness of unconditional imprisonment. The Czech Republic is one of the countries with a very high number of prisoners in Europe, as well as a high recidivism rate. Decreasing of these two factors can be achieved by...
Current problems of Czech prison service seen from the released prisoners point of view.
KŮS, Jan
The Bachelor Thesis "Topical Problem of the Czech Prison System from the Viewpoint of the Persons Released from Prison" aims to make a contribution to the discussion on the topical problems of the Czech prison system, also with respect to opinions of the released prisoners. This approach is surely extraordinary but I suppose that it is an interesting aspect of this scope of problems, which are very controversy among the experts as well as laymen. The first part of the work presents (following a brief historic background) a description of topical problems of the Czech prison system, which are frequently discussed in both professional and popular press, in other media as well as small talks of ordinary people. The main part however consists in a thorough survey of opinions of the people who experienced the Czech prison as prisoners, and now, after having been released, they endeavour to be re-integrated into our free society. I am sure that the work is significant for development of the Czech theory and practice of the prison service. This is mainly because the work points out the fact that the on-going reformation of the prison system should also consider the opinions of the persons who experienced the prison as prisoners. In the conclusion, some original recommendations are formulated in order to optimize the process of imprisonment in the Czech Republic based on the data ascertained.
