Industrial properties and their share of business development in a chosen company

I have selected the topic for this Thesis in particular because the area of study is very appealing and the range of issues highly varied and issues of this kind have not been approached in this way so far. The choice of topic has also been influenced by the possibility to obtain production, technical, business and economic information directly in the enterprise concerned and by the fact that I would have a chance to obtain much information on industrial property issues during consultations with professionals, well aware of the situation of the enterprise in question. The enterprise investigated in the Thesis should find the specific output to be instructive on the utilization of its personnel?s current creative potential, well-preserved tradition, documentary funds and production capacities in conjunction with a consistent application of the opportunities brought by the valid legislation to protect designations and the results of creative technical activity. Having analyzed the enterprise, its financial situation, competitive environment, SWOT landscape and particularly the current condition of its industrial property, I have concluded that investments in the legal protection of industrial property are meaningful. In this specific case, it is possible to use industrial designs to protect the results of creative activity in the field of product appearance or to protect the names of individual product types. And subject to an examination of foreign markets, it is also possible to provide for an efficient protection of trade marks and the names of individual product types abroad. Last but not least, the protection of designation of origin could be of major importance. The specific proposed measures, which constitute the core of the practical part, could help the selected enterprise maintain or improve its position on the domestic market and to establish itself on its existing as well as potential future foreign markets. The speed and sequence of implementation of the proposed measures will depend on the will and financial possibilities of the enterprise owner.
Trade Related Aspects of Patent Protection in Pharmaceuticals

The purpose of my thesis is to analyse the trade-related aspects of patent protection in pharmaceuticals. The first part focuses on the international regulation of patent protection and its impact on conducting business in the pharmaceutical industry. Chapter Two addresses the issue of relevant trade-related aspects - patent duration, parallel imports and compulsory licence. It describes the impact of patent protection on the generic pharmaceutical industry. Chapter Three concentrates on the attitudes of the pharmaceutical industry and governments, especially those of developing countries. It examines the progress within the World Trade Organization (WTO).
Licence agreement to the objects of industrial property

Licence agreement is one of the most important tools when trading with intangibles. The goal of this thesis is to summarize the theoretical concept related to licence, licence agreement and protection of the industrial property and its practical application on the particular licence agreement. The introductory chapter is focused on division of intangible goods and features of respective forms of industrial property. Main focus is devoted to the part about types of licences and concluding licence agreement.

Possible means of legal protection for computer programs and perspectives of future development

This theses focuses on the possible legal protection of a computer program as well as on the legal nature of computer program as an intangible asset. Both copyright protection (as a standard and worldwide accepted means of protection) and also the other possibilities, i.e. patent protection and protection based on provisions regulating an unfair competition are discussed. Each means of protection is assessed based on its usability in relation with the computer program taking the overall impact on the information technology branch as such into account. Furthermore, this theses involves critical evaluation regarding the capability of traditional model of distribution and protection of computer programs to face the rapid technological development in the digital era. With respect to this fact some alternative models (SaaS, Free Software) are cited and an analysis of their practical applicability and perspectives of the future development is conducted
License agreement in international trade

The purpose of this work is to summarize and explain the context around the licenses, license agreements and protection of intangible goods, with the main focus on industrial property, in particular, inventions, designs, utility models and trademarks. The first part is about clasiffication of intangible goods and characteristics of industrial property. Next part deals with the protection of intangible goods, particularly from the international point of view, i.e. international conventions and organizations. It also includes comparison of protection in the three major economic centers - Europe, USA and Japan. Next part deals with the license agreement. From the explanation of the concept of a license, through the reasons leading to such relations, to the procedure of negotiating about the license agreement and its content, including a model of patent licensing agreements.
Intellectual Property - Case of Information Technology

This theses analyses necessity and legitimacy of existence of intellectual property rights, especially patents and copyrights. There is shown the true essence of these instruments as monopoly privilege. On case of information technology I demonstrate that these privileges are unreasonable and counterproductive in many cases. Analysis of ?free software? alternative model proves that use of patents and copyrights is not a necessary condition of creation of intangible goods. The last part of this work shows, that existence of any special instruments for intangible goods protection is not needed as well as it is not reasonable.
Kompenzace rizika získáním vyššího výnosu z nehmotného aktiva

Diplomová práce na téma ocenění nehmotného majetku pomocí modelu kompenzace rizika získáním vyššího výnosu z nehmotného majetku. Nehmotný majetek je oceňován na základě modelu TRRU, který je odvozen z Black-Scholesova modelu. Práce se soustředí na nehmotný majetek a opce. Úkolem je zjistit, zda existuje spojitost mezi opcemi a nehmotným majetkem, tak, aby se nehmotný majetek dal ocenit pomocí opční logiky.
Stanovení hodnoty licence

Diplomová práce se zabývá stanovením hodnoty licence k využití patentované technologie. V teoretické části jsou popsány otázky právní ochrany vynálezů, definuje se pojem ?licence? a jsou uvedeny základní metody oceňování nehmotných statků, z nichž pro ocenění licence byly vybrány: metoda MRCM, pravidlo 25 %, metoda DCF a metoda reálných opcí. Praktická část je zaměřena na aplikaci vybraných metod oceňování s použitím reálných údajů konkrétního podniku. Z provedeného srovnání výsledků vyplývá, že metoda reálných opcí je pro účely hodnocení tohoto typu nehmotných statků nejvhodnější.

Zabývá se Evropským patentovým systémem, který je kromě národních právních řádů tvořen Evropskou patentovou úmluvou a zamýšleným komunitárním patentem. Dále se věnuje aktuálním problémům se zaváděním patentu Společenství a jeho budoucností, tedy otázkou zda vůbec a v jaké podobě bude zaveden..
