Evalution of Risk Loans in insolvency

During the last few years the Czech Republic has witnessed a great boom in the area of a problematic and irrecoverable credit settlement. Late and substandard payments have become rather a tradition in the Czech way of doing business. Consequently the solution by selling receivables to the third party is often resorted to. The thesis examines the system of the internal debt evaluation in banking sector for the purpose of sale. In the conclusion it presents a draft methodology with three different modifications: The first modification is the value of the credit based on the debtor's ability to pay using the risk parameters such as the probability of default, the loss given default and the recovery rate of the credit (calculating according to BASEL II rules). The second modification is the value of the credit determinated by a simulation of the bankruptcy/insolvency proceeding. The third modification is the value of the credit derived from the worth of the collateral while using the methodology for evaluation of the real estate and the current assets, or other types of collateral
The global financial crisis and its impact on the company Kordárna, a.s.

This thesis describes the actual global financial crisis and its impact on the company Kordárna, a.s, which is a producer of cords for tyres. The first part explains reasons and impacts of the global financial crisis. The second part is focused on a financial analysis of the company. The third part is connecting both previous parts, analyses consequences of the crisis on the company and its further problems, and shows how to solve its difficulties through the reorganization.
Asset valuation of the debtor in insolvency proceedings

This diploma thesis is focused on the insolvency proceedings in accordance with the Czech law and accounting legislation. The first part is devoted to the insolvency procedure. It defines the insolvency and its possible solutions - bankruptcy and reorganization. The second part of the thesis is devoted to solving these two forms of insolvency of the debtor, especially in terms of valuation. The valuation methods are described not only in accordance with the valuation standards, but also on the basis of accounting. Accounting is considered to be the starting source for valuation of assets.
Method of resolving insolvency with emphasis on reorganization

This thesis describes the problematic of the individual ways of dealing with bankruptcy. The first part is concretely dealing with all method of resolving insolvency with emphasis on reorganization. The concept of reorganization was introduced by the new Insolvency Act. I focus also on comparison of the reorganization and the bankruptcy. The second part of my work includes analysis of reorganization in practice. I chose the company Kordárna, a.s. for describing reorganization process. I found the reorganization more advantageous to the creditors. Nevertheless the reorganization is less used than the bankruptcy. The reasons are the high costs, the shortcomings of insolvency law, necessity of consensus and some non-confidences to reorganization.
Restructuring and rescuing Odevni podnik Prostejov, a.s.

The topic of the bachelor's thesis is application of the new Insolvency Act No. 182/2006 Coll, as subsequently amended, which is a crucial contribution to the Czech insolvency law offering new ways of settling debtor's bankruptcy. I point out the differences between the currently effective Insolvency Act and the preceding Act No. 328/1991 Coll, about bankrupcy and liquidation, as subsequently amended. In the theoretical part I describe the most important features of a insolvency proceeding and also the process and the possible ways of setlling bankruptcy. The aim of the empirical part is then to describe and evaluate the solving of the situation during the insolvency proceeding of the Odevni podnik Prostejov, a.s. in 2010 up to the present day, with the use of the new Insolvency Act.

Insolvency law is a progressive and dynamic legal discipline closely interrelated with economics and business. A quality legal framework of insolvency is indispensable for modern market economies: it helps to identify companies or individuals in financial distress and to restructure their debts, or liquidate their assets in an efficient and transparent way. The main purpose of the insolvency law is to provide creditors and debtors with a ground for negotiations and to help them reach qualified decisions based on the available information. In the Czech Republic, the insolvency law had long been criticized for its insufficient protection of creditors and for the loopholes that made extensive property frauds possible without having the wrongdoers punished. The current Czech Insolvency Act which took effect in 2008 was broadly inspired by the U.S. Bankruptcy Code Chapter 11 and eliminated most of the weaknesses of the earlier law. This thesis shows that valuable inspiration can be found not only in texts of statutes but also in the real life. On the example of reorganizations of Kordárna and GM described here, main principles of insolvency law are being discussed.
Bankruptcy solution of ČBPS s.r.o.

The main goal of this Bachelor's thesis is describing possibilities of bankruptcy solutions in Czech Republic on the example of a czech company ČBPS s.r.o. Theoretical part deals with the insolvent management process accordning to the up to date version of the law about bankruptcy and its solution methods #182/2006. Practical part is engaged in description and evaluation of the ČBPS s.r.o. reorganization process.
Analysis of the impact of the crisis on the the sample of firms

The thesis focuses on the impacts of the crisis on the firms. In relation with the crisis there is also described Insolvency legislation and new possibility of dealing with bankruptcy which is reorganization. The thesis also contains financial analysis of selected sample of firms. It contains fundamental description of financial indicators that we should use. Further there are described some models for the valuation of efficiency of the firms. The financial analysis is applied to three companies: Kordárna, Baťa and Třinecké Železárny. Company Kordárna came to insolvency in 2009 and the thesis also includes description of the process of reorganization in this company.

Disertační práce se zabývá vývojem insolvencí českých podniků a to zejména z pohledu historického a ekonomického vývoje a z pohledu právní úpravy insolvenčních (dříve konkursních) řízení. V teoreticko-metodologické části práce je uveden přehled tuzemských a zahraničních modelů predikce finanční tísně, které jsou nejčastěji využívány za účelem rozpoznání hrozícího bankrotu. Aplikační část je věnována rozboru vybraných modelů a praktickému zhodnocení jejich vypovídací schopnosti na vzorku podniků z různých odvětví. Cílem práce bylo zhodnocení zda je možné pro tuzemské podniky využít modely vytvořené v zahraničí a dále zda jsou modely universálně využitelné bez ohledu na odvětví.
