Economic Aspects of Public Orders Submitting

The issue solved in this thesis is the procedure for the award of public contract, which is explored from the perspective of the Act No. 137/3006 Coll., on Public Contracts, as Amended. With the help of latest Amendment No. 55/2012 Coll., number of changes was allocated into the tables. These changes fundamentally modify the view on the Act of Public Contract. Process of the award of public contract is then analyzed and evaluated by the tender dossier, from which the data about qualification requirements and evaluation criteria was drawn. Evaluation is performed using graphs and tables. The result of this thesis is to demonstrate a significant effect of the Amendment on the entire procedure and the decrease of assigned public works contracts with regard to public supply contracts and public service contracts. Future recommendation is to re-amend the Act on Public Contract and try to allow the re-growth of awarded public contracts, and to reclaim significant negative impact of the Amendment.
Institutes related to the tender price in the award procedures of public contracts

The main aim of this diploma thesis is to provide a comprehensive analysis of selected institutes related to the tender price in the award procedures of public contracts in the light of the new Act No. 134/2016 Coll., on public procurement, with its main focus on evaluation of impacts of the new legislation and identification of its potential risks, while its partial focus lies in comparison with previous legislation, i.e. Act No. 137/2006 Coll., on public procurement, as amended, and assessment of usage of up to now decision practice of the Office for the Protection of Competition and case law of administrative courts. The first chapter deals with a brief overview of the public procurement legislation, its aims and purposes and identification of elementary characteristics of the award procedures of public contracts. The subject of the second chapter is to analyze preliminary market consultation from the general point of view and simultaneously to provide an analysis with a focus on its application, practical execution, benefits and drawbacks related thereto and its influence on the procurement procedures. Evaluation of tenders in public procurement according to its economical advantage

Abtract The main aim of this diploma thesis is to analyze the evaluation of tenders in public procurement according to their economic advantageousness and at the same time to compare the current stage of the ability of contracting authorities to evaluate this economic advantageousness compared to the stage of effect of the previous legal regulation. The background information for the topic of this diploma thesis were obtained from the legal regulation of the Czech Republic and the European Union, professional literature (legal commentaries), professional articles of periodical publications dealing with public procurement, internet sources and the case law of the Office for the Protection of Competition, administrative courts of the Czech Republic and the Court of Justice of the European Union. The analytical approach, linguistic, teleological and comparative method of legal interpretation were used. This diploma thesis consists of six main chapters.
