Cochem model as an option in the use of childrens participation rights

My diploma thesis focuses on the active role of a child in the process of decision-making about custodial care and its conditions. This thesis describes what is known as Cochem's model, how this model treats a child's participation and how a child uses that participation when its family is going through divorce. Cochem's model is based on interdisciplinary collaboration, which is also mentioned. There are also particular cases from real life supported by views from a psychologic point of view.

Summary: This work proposes a closer look at the divorce-related topics with consequential impacts both on financial situation of divorced spouses and destinies of minor children as resulting from divorced marriages in Czech Republic. Till date, this issue has been solved in different ways at both district and regional courts. In our republic, a more unifying element is represented by decisions of the Supreme and Constitutional Courts. This is a very serious social phenomenon which, according to statistics affects a large number of parents, children, but also childless partners. Yet from ancient times this phenomenon is known to be socially undesirable being almost entirely rejected by the Catholic Church in its canon law. The increase in divorces has resulted namely from the advancement procedure of society. It is a societal phenomenon known to occur irrelatively of the states and political systems, from the totalitarian regimes through those autocratic, up to highly democratic systems of developed countries worldwide. During the creation of this work, up to 40% of marriages have been critically monitored as expected to be ended in divorce. The benefits and limits of the Cochen model from the point of view of a worker in social and legal protection of children.

The diploma thesis entitled "The Benefits and limitations of the Cochem model from the point of view of an OSPOD employee" deals with families undergoing adjustment of relations on one hand and with professionals who work with such families on the other. The diploma thesis aims to thoroughly describe the Cochem model, so that the results may be as useful as possible, especially for social workers working at OSPOD, but also for other professionals, who interact with the family during the situation adjustment process. This content can also serve as an informative basis for parents of minor children, who are currently going through a separation / divorce. The purpose of the master's thesis is to find out how OSPOD social workers in selected urban areas of Prague perceive the use of the Cochem model, whether and how they work with it. The aim of the research is to be inspired by knowledge from good practice and to shed light on the bad experiences of social workers.

Child custody proceedings and the Cochem practice Abstract The aim of this thesis is to describe and define, as thoroughly as possible, the child welfare judicial proceedings, particularly the child access and custody proceedings pursuant to section 466 b) and d) of Act No. 292/2013 Coll., on special court proceedings, as amended and to inform about the possibilities of its improvement through the use of the methods of the Cochem practice. The thesis consists of three main parts - part one and two are dedicated to the child access and custody proceedings, part three provides the reader with information about the Cochem practice. The first part of the thesis describes the child custody and access proceedings in general, it provides general information about the subjects of the proceedings (with focus on the court and the proceedings parties), furthermore it describes the position of the children' social and legal protection authorities and the Office for International Legal Protection of Children. In order to fully explain the procedural law regarding the child custody proceedings, this part also describes the substantive law. Cochem model in the application practice of Czech courts Abstract The presented diploma thesis titled "The Cochemic Model in the Application Practice of the Czech Courts" deals with the main principles of the Cochem model, which is based on the cooperation of the professions involved in the divorce proceedings, and which is currently being gradually introduced by some of the Czech courts. The aim of the thesis is to find out the results of the first application approaches, on the basis of which it would be possible to determine the possibilities of further application of the presented model within the framework of Czech guardianship procedures. The second goal of the diploma thesis is the complex elaboration of the topic in terms of substantive and procedural law and further clarification of the current legislative situation, including the reflection over de lege ferenda. First of all, the diploma thesis introduces the origin of the Cochem model, moreover, it also presents its first application in Germany in the first chapter.
