United States Supreme Court case law on campaign finance

United States Supreme Court case law on campaign finance The diploma thesis deals with the development of US Supreme Court case law on the issue of electoral campaign finance while paying special attention to the question of the constitutionality of expenditure and contribution limits. Its main goal is to provide a comprehensive analysis of these cases to demonstrate how regulation of campaign finance works there, which is considerably different from systems found not only in the Czech Republic but also in Europe. At the same time, the author focuses primarily on providing insight into the more recent part of American case law, which has significantly loosened the whole regulatory system, especially regarding the financial participation of legal entities in electoral campaigns. The author divides the work into four parts. In the first part, the reader is introduced to the basic institutes and concepts that relate to the American campaign finance law and then compares them with their Czech counterparts in order to facilitate the understanding of the following three parts, which already cover the concrete cases. The Czech presidential election law and its comparison with presidential election amendments of European Union countries

The dissertation investigates a constitutional amendment to the 2012 legislation of the presidential election. The amendment introduced an election of the president through a popular vote, which was a historical milestone for the Czech legal system. However, the new adjustment was adopted in haste and evinces many deficiencies; that was proven in the 2013 presidential election. Therefore, the aim of the dissertation is to describe problematical parts of the new legal adjustment and find some possible solutions. The main topics are as follows: 1) modification of the basic concepts of the election system, 2) candidate nomination process, 3) election campaign funding and 4) ethical aspects of the election campaign. A comparison of legal adjustments of 14 EU countries with the direct presidential election (the Czech Republic, Bulgaria, Finland, France, Croatia, Ireland, Cyprus, Lithuania, Poland, Portugal, Austria, Romania, Slovakia and Slovenia) was done, in order to find appropriate solutions. Apart from the results of comparison, the dissertation is based on reports by GRECO, OSCE and the corresponding Czech judicature. Presidential campaign finance in the US: diminishing role of public funding

This bachelor thesis focuses on public financing of presidential campaigns in the United States and the fact that after decades of functioning successfully the system's use by presidential candidates diminished and virtually vanished in recent years. The aim of the thesis is to identify the particular reasons for this development and to propose suggestions for changes that would eventually make the system functional and lucrative for the candidates again. It sets forth a comprehensive description and analysis of the legislation and Supreme Court rulings concerning presidential campaign financing as well as an overview of the current state of public campaign finance law. It then examines those presidential elections in which some candidate(s) opted out of the public financing, whether for primary or general elections, and tries to find the reason behind the candidates' decisions to opt out. Based on that it determines the reasons which were a common denominator among the presidential candidates and which caused the diminishment of public financing and categorizes them. At the end it proposes possible solutions to these problems and the possibilities of reforming the public financing of presidential elections.
