Timesharing v evropském a českém právu a jeho vazby na rozvoj cestovního ruchu - právně- ekonomické souvislosti

The bachelor thesis discusses the regulation of timesharing in European law and transposition legislation. The literary research describes the emergence and development of timesharing and the law that regulates this phenomenon. In the main part of the thesis the development of legal regulation and transposition into Czech legislation is evaluated. Furthermore, real consumer contracts are described. The Conclusion contains suggestions and recommendations for increasing the effectiveness of consumer protection.
Právní aspekty timesharingu v cestovním ruchu

Bachelor's thesis discusses about the impact of deceptive trade practices by timesharing companies on consumers. The theoretical part describes issues about consumer protection, unfair business practices, timesharing from the perspective of tourism, and juristic adjustment of timesharing both on Czech and European level. The practical part discusses the requirements of timesharing contracts and specific examples of unfair dealings by these companies. Furthermore, there are real cases of misled consumers that are exploered. At the end, there are some recommendations listed for consumers which advise on how to approach dealing with timeshares.
The protection of a consumer in consumer contracts

The diploma thesis deals with the protection of a consumer in consumer contracts with the fact that it is based on Czech law as well as on European Union legislation, because there are directions, which had to be implemented into the legal order of the Czech Republic. First of all I deal with basic characteristic of the legal regulation of consumer protection and its sources. The issue of consumer contracts is divided into three parts. The first one is just about contracts and rules, which determine all consumer contracts. The second part describes specific types of consumer contracts and finally I outlined perspective of a next development of this problem. I also try to focus on European aspect of regulation of consumer contracts and I found out, that Czech lawmaker has got a massive lack of knowledge in the implementation.
Consumer Contracts and possibility of withdrawal

This bachelor's thesis deals with the problematics of consumer contracts, the conception of which is relatively new in the Czech law system. The goal of this thesis is to give the reader the general idea about the principles of the consumer contracts problematics, its legal regulations and possibilities, how to defend oneself in particular situations, especially how to witdraw from the contract. The reader will learn, what actually consumer contracts are, who can be the participant of that contractual relations, then something about the legal institutes, which provide the protection to the consumer, especially we will focus on situations, when the consumer has the right to withdraw the contract. Due to the rising popularity of purchaces realized via internet is this thesis also going to devote to contracts made by the means of the communication at distance. Also contracts made out of the business premises are mentioned. In context of holidays we will mention also the contracts called time-sharing. At the end of the thesis we are to have a look at the most often types of consumer contracts, namely contract of purchase and contract for work, and how and when to withdraw from them.
