Discrimination based on sexual orientation within the family law with a focus on the issue of child adoption

- Cohabitation and parenthood of homosexuals and their discrimination in this area The theme of this thesis suggests that the thesis is closely devoted to the issue of rights of homosexual men and women, respectively couples in the area of family law, especially the right to marry and the right to adopt a child. The main aim of this work is to give a comprehensive legal analysis of the issue using literature, publications and articles, but also using the case law of the European Court of Human Rights and at the same time to answer the question whether the legislation in Czech Republic is discriminating towards homosexual individuals, respectively couples by prohibiting same-sex marriage and not granting the right to joint adoption and second- parent adoption. The text is divided into introduction, five chapters and conclusion. The first chapter of this thesis mainly discusses the theoretical models of the legal regulation of homosexual couples living together. We can basically divide these into three groups - homosexual marriage, registered partnership and unmarried cohabitation.
