Name of the thesis: An audiovisual works In my final thesis, I tried to summarize the current legal regulation of an audiovisual works and the rights and obligation relating thereto. In the thesis, I mainly deal with Czech private law legislation, as regulated particularly in Act No. 121/2000 Coll., Copyright Act, as amended, and with regards to License Agreement in Act No. 89/2012 Coll., Civil Code, as amended, or other legal acts. In the first chapter, I focus on different sources of legal regulation of an audiovisual works and its historical development in public international law, secondary law of the EU and also in national legislation. In the second, third and fourth chapter, I elaborate on the defintion of the term "audiovisual work" and its author, as well as the term and author of a "work audiovisually used" and "performances audiovisually used." These works and performances, together with audio records, constitute basic elements which audiovisual works might be composed of. In chapter five and six, I highlight the specific position of audio and audiovisual records producers and define the term of a "producer of audio record" and "producer of audiovisual record". Audiovisual Works with Reference to Film Co-productions - Summary: The audiovisual works are the main theme of this thesis. I have chosen this theme, because these works are very important for our society and we can not ignore them. We have to consider this segment of our society from various and different perspectives. I mean the various branches of law, film theory, history, financing (economics). It is multidisciplinary area and it contains cultural, social, economical, educational and also international points, which help us to improve and simplify international and multicultural structures and relationships. The thesis is divided into six chapters. Chapter One is introductory and provides basic identification with the topic of the thesis. Chapter Two focuses on general definition of the words "audiovisual work". We have to define this type of work in legal terms and also in the other "interdisciplinary" terms. Chapter Three recalls the fact that this issue must be seen from the historical point of view. We have to study historical copyright law, publications from 30s and 40s of the twentieth century dealing with film law and also law journals from this time period (e.g. "Soutěž a tvorba"). Audio-visual work and audio-visually used works and performances Abstract The aim of the diploma thesis on Audio-visual work and audio-visually used works and performances is to provide an overview of key concepts of the Czech audiovisual legislation. The thesis mainly focuses on private-law aspects of copyright, but it also touches upon the subject of public regulation in the field of public support of audio-visual sector, regulation of advertising and media, or liability for administrative and criminal offences committed by infringement of the relevant intellectual property rights. Emphasis is placed on the intellectual property related to the creation of audio-visual work as a subject matter of copyright protection and on the entities and individuals that participate in the creation and production of audio-visual work. The first part of the thesis covers basic copyright concepts of the Czech legal system and sources of law relevant to the audio-visual sector, and it briefly mentions the legal instrument of collective rights management in the Czech Republic. T h e s i s o n A u d i o v i s u a l w o r k s - A b s t r a c t The thesis deals with the legal regulation of audiovisual works in the Czech legal order. The thesis analyzes this legislation in detail with regard to the audiovisual experience, and also discusses some of the practical issues arising during the production and use of audiovisual works. In the introduction to the thesis, individual sources of legal regulation of audiovisual works are listed and also the key issues covered by the thesis. The first chapter defines the term of "an audiovisual work" and it also focuses on the development of the legal definition of this term. The second chapter is regarding the author of an audiovisual work; it describes who was considered to be an author of the audiovisual work in the past and who is considered to be an author under the current legislation. The third chapter defines another important term of the legal regulation of audiovisual works, namely so-called "works audiovisually used" (works which are used in the audiovisual work). It is also regarding the authors of works audiovisually used. The term "works audiovisually used" as such is not defined by Czech law and therefore its interpretation results in frequent inconsistencies. This thesis tries to find solution for these interpretation differences....
